Justice KURIAN JOSEPH\n\n Dated :10\/11\/2008\n\n O R D E R\n                         KURIAN JOSEPH, J.\n               ----------------------------------------------\n                    W.P.(C) No.6199 of 2006\n               ----------------------------------------------\n                  Dated 10th November, 2008.\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">            Ext.P21 order passed by the District Collector,<\/p>\n<p>Trivandrum, whereby the District Collector confirmed his earlier<\/p>\n<p>order regarding the stop memo issued in the matter of use of jack<\/p>\n<p>hammer for blasting rocks, is under challenge.              It is stated in<\/p>\n<p>Ext.P21 that &#8220;Due to the uncontrolled quarrying operations some<\/p>\n<p>of the area became ponds and the free flow of drinking water is<\/p>\n<p>restricted, which may entail water scarcity in the near future. The<\/p>\n<p>Mining and Geology Department will look into this, in consultation<\/p>\n<p>with the Departments concerned and submit necessary proposals<\/p>\n<p>for a solution for overcoming this hazardous situation.&#8221;<\/p>\n<p id=\"p_1\">            2. There will be a direction to the third respondent to<\/p>\n<p>file a report before the District Collector as observed in the<\/p>\n<p>impugned order extracted above, within a period of three months<\/p>\n<p>from the date of production of a copy of the judgment and<\/p>\n<p>thereafter, the District Collector will review the order and pass<\/p>\n<p>fresh orders in the light of the report submitted by the third<\/p>\n<p>respondent. It is made clear that in the process, the petitioner as<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WP NO.6199\/06                     2<\/span><\/p>\n<p>well as the party respondents will also be afforded an opportunity<\/p>\n<p>for hearing.
