Muruganandam for R-1\n\t\t    Additional Government Pleader\n\t\t    No appearance for R-2\n- - - - - - - -\n:ORDER\n<\/pre>\n<p>\t\tThe petitioner prays for issuance of a Writ, in the nature of<br \/>\nCertiorari, to quash the order passed by the Appellate Authority, in exercise of<br \/>\npower under Section 41(2) of the Tamil Nadu Shops and Establishments Act 1947.\n<\/p>\n<p>\t\t2. The second respondent herein was employed as Salesman in a fair<br \/>\nprice shop on 08.01.2000, on temporary basis in pursuance to the Resolution<br \/>\npassed by the petitioner. After the second respondent had put in more than four<br \/>\nyears of service, he was terminated. It is not in dispute that the appointment<br \/>\nof the second respondent was against permanent vacancy.\n<\/p>\n<p>\t\t3. The case of the petitioner, is that as the appointment of the<br \/>\nsecond respondent was not made in terms of the Tamil Nadu Co-operative Societies<br \/>\nRules, therefore, the services were terminated, after issuance of a show cause<br \/>\nnotice.\n<\/p>\n<p>\t\t4. Feeling aggrieved by the order of termination, the second<br \/>\nrespondent filed an Appeal under Section 41(2) of the Tamil Nadu Shops and<br \/>\nEstablishments Act, 1947.\n<\/p>\n<p>\t\t5. An objection was taken by the petitioner, with regard to the<br \/>\njurisdiction of the Appellate Authority, to entertain the Appeal, on the ground<br \/>\nthat the respondent Society was situated within a village panchayat, therefore,<br \/>\nthe Tamil Nadu Shops and Establishments Act, 1947, was not applicable to it.\n<\/p>\n<p>\t\t6. The learned Appellate Authority rejected the plea, holding that<br \/>\ntwo other employees, whose services were terminated like that of the second<br \/>\nrespondent, had filed Appeal under Section 41(2) of the Act, and the petitioner<br \/>\ntook no objection to the jurisdiction of the Appellate Authority, to entertain<br \/>\nthe Appeal.\n<\/p>\n<p>\t\t7. After rejecting the preliminary objection as referred to above,<br \/>\nthe Appeal filed by the second respondent was accepted, and the order of<br \/>\ndismissal was set aside, vide order dated 10.10.2005.\n<\/p>\n<p>\t\t8. The reasons for passing the order, was that the instruction of<br \/>\nthe Government with regard to termination of services of the employees who were<br \/>\nnot appointed through employment exchange was not applicable to the employees,<br \/>\nwho were recruited prior to 2001.\n<\/p>\n<p>\t\t9. After passing of the order of reinstatement with consequential<br \/>\nbenefit of continuity of service and backwages, an application was moved by the<br \/>\nsecond respondent, undertaking therein to forego back wages and relief of<br \/>\ncontinuity of service but prayed for re-employment.\n<\/p>\n<p>\t\t10. This offer was accepted by the Management and the order passed<br \/>\nin Appeal was modified, ordering re-employment of Respondent No.2.\n<\/p>\n<p>\t\t11. Challenging the order, the petitioner has filed this writ<br \/>\npetition, on the ground of jurisdiction of the first respondent to entertain the<br \/>\nAppeal.\n<\/p>\n<p>\t\t12. The reasoning given by the Appellate Authority, to hold that it<br \/>\nhad the jurisdiction, cannot be sustained in law, as the conduct of the parties<br \/>\ncannot give jurisdiction to an Authority, which is not vested under the Act.\n<\/p>\n<p>\t\t13. It is also well settled, that one wrong exercise of power cannot<br \/>\ngive jurisdiction to exercise the power. Subsequently, it is brought to the<br \/>\nnotice of the Authority \/ Court that it has no jurisdiction.\n<\/p>\n<p>\t\t14. The question to be decided is whether the first respondent had<br \/>\nthe jurisdiction to entertain the Appeal.\n<\/p>\n<p>\t\t15. The term &#8220;Commercial Establishment&#8221; is defined under Section<br \/>\n2(3) of the Tamil Nadu Shops and Establishments Act, to reads as under:-\n<\/p>\n<p>\t\t&#8220;2(3) &#8220;Commercial Establishment&#8221; means an establishment which is not<br \/>\na shop but which carries on the business of advertising, commission, forwarding<br \/>\nor commercial agency, or which is a clerical department of a factory or<br \/>\nindustrial undertaking or which is an insurance company, joint stock company,<br \/>\nbank, broker&#8217;s office or exchange and includes such other establishment as the<br \/>\nState Government may by notification declare to be a commercial establishment<br \/>\nfor the purposes of this Act&#8221;.\n<\/p>\n<p>The petitioner admittedly fall within the definition of &#8220;commercial<br \/>\nestablishment&#8221;.\n<\/p>\n<p>\t\t16. The contention of the learned counsel for the petitioner, that<br \/>\nin view of Section 1(3)(iii) of the Act, the establishment of the petitioner<br \/>\nwill not be covered under the Act, as it is situated in the village panchayat,<br \/>\nwhich is not classified by the State Government, as Class I Panchayats under<br \/>\nSection 5(1)(a) of the Madras Village Panchayats Act, 1950.\n<\/p>\n<p>\t\t17. This contention of the learned counsel for the petitioner cannot<br \/>\nbe accepted, as after coming into force of Tamil Nadu Panchayat Act 1994, the<br \/>\nearlier Acts stood repealed by the new Act. In this Act, there is no<br \/>\ncategorisation  of panchayats in different classes. The Tamil Nadu Panchayat Act<br \/>\n1994, defines the Panchayat to mean a Village Panchayat, a Panchayat Union<br \/>\nCouncil or a District Panchayat constituted under the Act.\n<\/p>\n<p>\t\t18. The Bank establishment within the panchayat would be covered<br \/>\nunder the Panchayat Act 1994, and in view of the definition of industrial<br \/>\nestablishment, the petitioner will fall within the jurisdiction of the Appellate<br \/>\nAuthority. The contention of the learned counsel for the petitioner, therefore,<br \/>\ndeserved to be rejected.\n<\/p>\n<p>\t\t19. No other point has been urged.\n<\/p>\n<p>\t\t20. Otherwise also, no ground is made out to exercise, extra<br \/>\nordinary writ jurisdiction, to interfere with the order passed by the Appellate<br \/>\nAuthority, as the order was passed with the consent of the petitioner, after the<br \/>\nsecond respondent had given up his claim for back wages and continuity of<br \/>\nservice. In view of the consent, having been given, this Court is not inclined<br \/>\nto exercise the extra ordinary writ jurisdiction to interfere with the impugned<br \/>\norder.\n<\/p>\n<p>\t\t21.
