That on 27-5-06, when the claimant was
\nproceeding with his Seooty in front of Swapna I-‘Iotel,
\nShankarmutt road, Hassan, the driver of Tata Sumo<\/p>\n
bearing registration No.KA–O3-P–2574 drove the safne in<\/p>\n
a rash and negligent manner and dashed against<\/p>\n
As a result, the claimant sustained inju_ri.e_s_’.’=._Henee, lhe__ <\/p>\n
\ufb01led a claim petition before  Hassanl,’ <\/p>\n
compensation of <\/p>\n
impugned judgmentjl  award:\/:l1_\\e’.has awarded
\n at 6% p.a.
\nAggrievedil V.   Corripensation awarded by

\nenhancement’   <\/p>\n

claimant was admitted to Tejaswini Hospital, Mangalore
\nwith the history of road traffic accident. He has<\/p>\n
sustained cornminuted fracture of lower <\/p>\n
tibia and extra articular fracture of <\/p>\n
Claimant was operated. debridierr1er;tg_wgas.;\u00abdone and  t<\/p>\n
was discharged on 24-6-06. Sec__oi’1d. <\/p>\n
on 06-0606 with ilizirich””fi\u00a7\u00a7:ation  on<\/p>\n
24–6\u00ab~O8. He was   wasvrernoved and
\nplating was done and   inpatient from
\n17–9–os to 3o5 9;io6g land’iagainfreadrnitted on 30-11-06
\nfor  Doctor has further
\ndepos_ed._  examined the claimant on
\nl8~5~  and it shows fracture was<\/p>\n
 but  is: residual stiffness of left ankle and<\/p>\n
\u00bb thereVisrestriction of movements and claimant cannot<\/p>\n
H  fo’ru7lon’gVVdistance without support, since left leg of<\/p>\n
the petitiyoner is shortened by 1 cm. Claimant has<\/p>\n
it  Atsuffereld permanent disability of 30 to 35% to left lower<\/p>\n
‘limb.\n<\/p>\n

8. Considering the nature of injuries, Rs.25,000\/~
\nawarded by the Tribunal towards pain and suffering is<\/p>\n
on the lower side and it is deserved to be enhanoedvviby<\/p>\n

\nassessed  month. Doctor has stated<\/p>\n
he  isuffercdfp’disability of 30 to 35% to left lower<\/p>\n
   and his employer examined as P.W.1<\/p>\n
not stated what is the loss of earning<\/p>\n
