Justice THOMAS P.JOSEPH\n\n Dated :18\/10\/2010\n\n O R D E R\n                    THOMAS P.JOSEPH, J.\n            ====================================\n                     Tr.P(C) NO.273 of 2010\n            ====================================\n           Dated this the 18th  day of October, 2010\n\n\n                            O R D E R\n<\/pre>\n<p id=\"p_1\">      This petition is filed by the wife seeking   transfer of O.P.<\/p>\n<p>No.373 of 2010 from Family Court, Ernakulam to Family Court,<\/p>\n<p>Kollam. That is a petition filed by the respondent for restitution of<\/p>\n<p>conjugal rights.   Petitioner who is a resident of Pallithottam, in<\/p>\n<p>Kollam District filed O.P. No.883 of 2009 in Family Court, Kollam<\/p>\n<p>against respondent for recovery of money, gold ornaments, etc.<\/p>\n<p>She states that she is staying with her parents at Pallithottam, in<\/p>\n<p>Kollam District along with her minor child. She finds it difficult to<\/p>\n<p>travel to Family Court, Ernakulam. Moreover O.P. No.883 of 2009<\/p>\n<p>is pending in Family Court, Kollam and if the cases continued in<\/p>\n<p>two courts she has to attend both the courts. Hence she requested<\/p>\n<p>for transfer of the case from Family Court, Ernakulam to Family<\/p>\n<p>Court, Kollam.\n<\/p>\n<p id=\"p_1\">      2.    Petition is opposed by respondent. It is stated that<\/p>\n<p>petitioner is working as a Teacher at Chalakkudy, in Thrissur<\/p>\n<p>District staying in a hostel at Chalakkudy. Hence it is not difficult<\/p>\n<p>for petitioner to attend Family Court, Ernakulam which is midway<\/p>\n<p>Tr.P(C) No.273 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  -: 2 :-<\/span><\/p>\n<p>from her place of residence to place of employment. According to<\/p>\n<p>the learned counsel convenience of petitioner was also taken into<\/p>\n<p>account while filing      O.P. No.373 of 2010 in Family Court,<\/p>\n<p>Ernakulam.\n<\/p>\n<p id=\"p_2\">      3.    The Supreme Court in <a href=\"\/doc\/1858688\/\" id=\"a_1\">Sumitha Singh v. Kumar<\/p>\n<p>Sanjay and another<\/a> (AIR 2002 SC 396) and <a href=\"\/doc\/1640831\/\" id=\"a_1\">Arti Rani v.<\/p>\n<p>Dharmendra Kumar Gupta<\/a> ([2008] 9 SCC 353) has stated<\/p>\n<p>that while considering request for transfer of matrimonial<\/p>\n<p>proceedings convenience of the wife has to be looked into.     That<\/p>\n<p>of course does not mean that inconvenience of the husband has<\/p>\n<p>to be ignored.     It is not disputed that petitioner is working as<\/p>\n<p>Teacher in a private school at Chalakkudy. Leaned counsel states<\/p>\n<p>that petitioner cannot attend the courts every now and then since<\/p>\n<p>the school being a private school, she has to attend the school<\/p>\n<p>on Saturdays as well. It is stated that    if the cases are tried in<\/p>\n<p>two courts she has to take leave for two days. It is true that in<\/p>\n<p>connection with the job petitioner has to go to Chalakkudy. I must<\/p>\n<p>note that she is staying in a hostel at Chalakkudy. Going to the<\/p>\n<p>school where she is working is different from going to the court.<\/p>\n<p>There, petitioner has to face        the estranged husband and<\/p>\n<p>probably, his relatives also. In such a situation a young lady like<\/p>\n<p>Tr.P(C) No.273 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   -: 3 :-<\/span><\/p>\n<p>petitioner requires assistance from her relatives who may have to<\/p>\n<p>accompany her. In the circumstances mere fact that petitioner is<\/p>\n<p>working in Chalakkudy is no reason to reject prayer for transfer of<\/p>\n<p>the case to Family Court, Kollam. Respondent has a contention<\/p>\n<p>that he   has already filed objection in O.P. No.883 of 2009 in<\/p>\n<p>Family Court, Kollam and it is not necessary for him to appear in<\/p>\n<p>that court   every now and then. Convenience of both parties<\/p>\n<p>require that the cases are consolidated in the same court.<\/p>\n<p>Inconvenience if any of respondent can be reduced to some<\/p>\n<p>extent by directing that he need appear only when his physical<\/p>\n<p>presence is required. Hence I am inclined to allow this petition.<\/p>\n<p id=\"p_3\">      Resultantly, this petition is allowed in the following lines:<\/p>\n<pre id=\"pre_1\">            (i)    O.P.No.373 of 2010      pending in Family\n\n      Court, Ernakulam    is withdrawn from that court and\n\n      made over to Family Court, Kollam.\n\n\n\n\n<\/pre>\n<p id=\"p_4\">            (ii)   The transferor court while transmitting<\/p>\n<p>      records of the case to the transferee court shall fix<\/p>\n<p>      the date for appearance of parties in the transferee<\/p>\n<p>      court with due     intimation to the counsel on both<\/p>\n<p>Tr.P(C) No.273 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                -: 4 :-<\/span><\/p>\n<p>      sides.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">            (iii)  Family Court, Kollam  shall ensure that<\/p>\n<p>      O.P. No.373 of 2010 (transferred to it)    and O.P.<\/p>\n<p>      No.883 of 2009 (pending in that court) are posted as<\/p>\n<p>      far as possible on the same dates.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">            (iv)   It is made clear that except when<\/p>\n<p>      physical presence of respondent in the transferee<\/p>\n<p>      court is necessary he can appear through counsel.<\/p>\n<p id=\"p_9\">                                 THOMAS P.
