RAMKUMAR, J.\n            ---------------------------------------------------\n                Bail Application No.147 of 2011\n            ----------------------------------------------------\n            Dated this the 21st day of January, 2011\n\n                                 ORDER\n<\/pre>\n<p id=\"p_1\">      Petitioner, who is accused No.1 in O.R.No.4 of 2010 of<\/p>\n<p>Palappilly Forest Range, Thrissur, for offences punishable under<\/p>\n<p>Sections 27(1)(e)(iv),(iii) and 27(I) (d) of Kerala Forest Act 1961<\/p>\n<p><a href=\"\/doc\/1210757\/\" id=\"a_1\">(Amendment Act<\/a> 1993), seeks anticipatory bail.<\/p>\n<p id=\"p_1\">      2.    The    learned      Public     Prosecutor       opposed the<\/p>\n<p>application.\n<\/p>\n<p id=\"p_2\">      3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict dated 2-12-2010 of the Apex Court in <a href=\"\/doc\/1108032\/\" id=\"a_1\">Siddharam<\/p>\n<p>Satlingappa Mhetre v. State of Maharashtra and Others<\/a><\/p>\n<p>(2010 (4) KLT 930), I am of the view that anticipatory bail<\/p>\n<p>cannot be granted in a case of this nature, since the<\/p>\n<p>investigating officer has not had the advantage of interrogating<\/p>\n<p>the petitioner. But at the same time, I am inclined to permit the<\/p>\n<p>petitioner to surrender before the Investigating Officer for the<\/p>\n<p>purpose of interrogation and then to have his application for bail<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.147\/2011                 -:2:-<\/span><\/p>\n<p>considered by the Magistrate or the Court having jurisdiction.<\/p>\n<p>Accordingly,   the   petitioner    shall surrender    before   the<\/p>\n<p>investigating officer on 01\/02\/2011 or on        02\/02\/2011 for<\/p>\n<p>the purpose of interrogation and recovery of incriminating<\/p>\n<p>material, if any. In case the investigating officer is of the view<\/p>\n<p>that   having regard to the facts of the case arrest of the<\/p>\n<p>petitioner is imperative he shall record his reasons for the arrest<\/p>\n<p>in the case-diary as insisted in paragraph 129 of Siddharam<\/p>\n<p>Satlingappa Mhetre&#8217;s case (supra).           The petitioner shall<\/p>\n<p>thereafter be produced before the Magistrate or the Court<\/p>\n<p>concerned and permitted to file an application for regular bail.<\/p>\n<p>In case the interrogation of the petitioner is without arresting<\/p>\n<p>him, the petitioner shall thereafter appear before the Magistrate<\/p>\n<p>or the Court concerned and apply for regular bail on the same<\/p>\n<p>day or the next day.     The Magistrate or the Court on being<\/p>\n<p>satisfied that the petitioner has been interrogated by the police<\/p>\n<p>shall, after hearing the prosecution as well,      consider and<\/p>\n<p>dispose of his application for regular bail preferably on<\/p>\n<p>the same date on which it is filed.\n<\/p>\n<p id=\"p_3\"><span class=\"hidden_text\" id=\"span_1\">B.A.No.147\/2011                 -:3:-<\/span><\/p>\n<p id=\"p_4\">     4.     In case the petitioner while surrendering before the<\/p>\n<p>Investigating Officer has deprived       the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect       to the Magistrate or the<\/p>\n<p>Court concerned.
