DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/11\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tHeard<br \/>\nlearned advocates for the parties.\n<\/p>\n<p id=\"p_1\">\tMr.\n<\/p>\n<p id=\"p_2\">Bhushan Oza, learned advocate for the petitioner relied on Clause 6<br \/>\npertaining to age relaxation for the employees in the service of<br \/>\nGovernment of Gujarat on permanent or temporary basis continuously<br \/>\nfor a period of six months and in such a case age limit is to be<br \/>\nconsidered from the first date of the appointment and if such an<br \/>\nappointment is within age limit, case of the candidate is to be<br \/>\nconsidered pursuant to subject advertisement for the post of Medical<br \/>\nOfficer  (Allopathy) Class-II as advertised by respondent NO.2.  It<br \/>\nis also submitted that the petitioner was called for the interview<br \/>\nand thereafter his name came to be deleted.\n<\/p>\n<p id=\"p_3\">\tAgainst<br \/>\nthe above submissions, Mr. Premal Joshi, learned advocate for the<br \/>\nGPSC relied on the affidavit-in-reply and submits that after the<br \/>\nabove initial appointment on ad hoc basis for 11 months which was on<br \/>\n18.1.2010, a break in service was given and thereafter again on the<br \/>\nsame terms and conditions w.e.f. 28.12.2010, the petitioner was given<br \/>\na fresh appointment.\n<\/p>\n<p id=\"p_4\">\tIf<br \/>\nthe above factual aspect is considered in the backdrop of proviso of<br \/>\nRule 8(5) of Gujarat Civil Services Qualification and Recruitment<br \/>\n(General) Rules, 1967, the upper age limit prescribed for purpose of<br \/>\nrecruitment in such rules shall not apply to a candidate provided<br \/>\nsuch candidate had not crossed the age limit prescribed for the<br \/>\nconcerned post at the time of his previous appointments and,<br \/>\ntherefore, in the last appointment the petitioner was over age and<br \/>\nhad crossed 35 years.\n<\/p>\n<p id=\"p_5\">\tThe<br \/>\nabove proviso needs to be interpreted in light of Clause (6) of the<br \/>\nadvertisement which refer to requisite age limit of a candidate at<br \/>\nthe time of first appointment.  The matter deserves consideration.\n<\/p>\n<p id=\"p_6\">\tHence,<br \/>\nRule returnable on 15th December, 2011.\n<\/p>\n<p id=\"p_7\">\tMeanwhile,<br \/>\nby way of ad-interim relief respondent NO.2 is directed to interview<br \/>\nthe petitioner for the subject post.  However, the result be kept in<br \/>\nsealed cover and action to be taken subject to order that may be<br \/>\npassed by this Court.\n<\/p>\n<p id=\"p_8\">\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p id=\"p_9\">[ANANT<br \/>\nS.
