Sinha, APP\n                   For the O.P. no.2 : Mr. Anant Kumar Bhaskar,Advocate.\n                                                -----------\n<\/pre>\n<p id=\"p_1\">02   24.06.2010                  Heard both sides.\n<\/p>\n<p id=\"p_1\">                                 Petitioner, who is husband, questions the legality of<\/p>\n<p>                     the appellate order dated 6th March 2010, passed by the learned<\/p>\n<p>                     Additional Sessions Judge IIIrd, Saran at Chapra in Cr. Appeal no.<\/p>\n<p>                     64 of 2007, whereby the appeal so far as the petitioner is<\/p>\n<p>                     concerned has been dismissed with modification in sentence.<\/p>\n<p id=\"p_2\">                                 Petitioner along with his other family members such<\/p>\n<p>                     as mother, father and brother were put on trial for an offence(s)<\/p>\n<p>                     punishable under Sections 498A\/34, 323, 325 and \u00be of the <a href=\"\/doc\/1763444\/\" id=\"a_1\">Dowry<\/p>\n<p>                     Prohibition Act<\/a>. At the trial six witnesses including, the victim<\/p>\n<p>                     were examined to substantiate the charges\/allegations. The<\/p>\n<p>                     defence, however, did not examine any witness. On a<\/p>\n<p>                     consideration of the materials available on record, the learned trial<\/p>\n<p>                     Court found and held that the prosecution has successfully proved<\/p>\n<p>                     the charges punishable under Sections 498 A and 323<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Penal<\/p>\n<p>                     Code<\/a>. Accordingly, petitioner herein (husband) was sentenced to<\/p>\n<p>                     undergo R.I. for three years under <a href=\"\/doc\/538436\/\" id=\"a_2\">Section 498A<\/a> of the Penal Code<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            2<\/span><\/p>\n<p>      and a fine of Rs. five thousand with default clause was also<\/p>\n<p>      imposed. The petitioner was also convicted under <a href=\"\/doc\/1011035\/\" id=\"a_3\">Section 323<\/a> of<\/p>\n<p>      the Penal Code and sentenced to undergo R.I. for six months.<\/p>\n<p>      Petitioner along with other convicts preferred the aforesaid appeal.<\/p>\n<p>      Learned appellate Court, on reappraisal of the evidence available<\/p>\n<p>      on record, found and held that the evidence against other family<\/p>\n<p>      members was\/were frugal and\/or deficient. Accordingly the<\/p>\n<p>      mother, father and brother of the petitioner herein were given the<\/p>\n<p>      benefit of doubt and acquitted of all the charges. So far as the<\/p>\n<p>      present petitioner is concerned, the Court found as under:-<\/p>\n<blockquote id=\"blockquote_1\"><p>                         &#8220;&#8230;.Accused Rajesh has re-married<br \/>\n            during the course of trial and now the evidence of<br \/>\n            victim and other P.W.s who are close relative were<br \/>\n            in position to look all the affairs regarding manner<br \/>\n            of the occurrence, resegaste and all the episode as<br \/>\n            such in absence of independent witnesses their<br \/>\n            evidence can not be brushed aside. The evidence of<br \/>\n            sole victim is sufficient that one accused Rajesh<br \/>\n            severely assaulted the victim and has made cruelty<br \/>\n            and due to fear and assault she left her Sasural&#8230;..&#8221;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                  Learned counsel for the petitioner submits that the<\/p>\n<p>      witnesses are interested. The law is settled that the Court has to<\/p>\n<p>      examine an interested witness with due care and caution. Here is a<\/p>\n<p>      case where both the Courts below has considered the evidence on<\/p>\n<p>      record carefully and has come to a definite conclusion that the<\/p>\n<p>      charge of cruelty and ouster at the hands of the present petitioner<\/p>\n<p>      has been duly proved.
