Patna.\n                                                 Versus\n                                         1. The State of Bihar\n                                             -----------------\n<\/pre>\n<p id=\"p_1\">02.   12.09.2011              Heard learned counsel for the petitioner and the<\/p>\n<p>                     State.\n<\/p>\n<p id=\"p_1\">                              The petitioner is apprehending his arrest in a case<\/p>\n<p>                     registered under <a href=\"\/doc\/1436241\/\" id=\"a_1\">Section 420<\/a> of the Indian Penal Code and<\/p>\n<p>                     <a href=\"\/doc\/1189554\/\" id=\"a_1\">Section 130<\/a> of N.I. Act.\n<\/p>\n<p id=\"p_2\">                               In the complaint the allegation against petitioner is<\/p>\n<p>                     that he had given a cheque of Rs. 40,000\/- which bounced. The<\/p>\n<p>                     submission of the petitioner is that he is ready to pay the said<\/p>\n<p>                     amount to the complainant in equal instalments if he is<\/p>\n<p>                     granted bail.\n<\/p>\n<p id=\"p_3\">                               Considering the said undertaking, let the petitioner,<\/p>\n<p>                     above named be released on anticipatory bail in the event of<\/p>\n<p>                     arrest or surrender before the learned Court below within a<\/p>\n<p>                     period of four weeks from the date of receipt of the order on<\/p>\n<p>                     furnishing bail bond of Rs. 5,000\/- (Five Thousand) with two<\/p>\n<p>                     sureties of the like amount each or any other surety as fixed by<\/p>\n<p>                     the Court to the satisfaction of Sri Lalan Kumar, Judicial<\/p>\n<p>                     Magistrate, 1st Class, Barh (or its successor) in connection with<\/p>\n<p>                     Complaint Case No. 579(C) of 2010 subject to the conditions<\/p>\n<p>                     as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_2\">Section 438(2)<\/a> of the Code of Criminal<\/p>\n<p>                     Procedure as also subject to the following conditions:- (i) That<\/p>\n<p>                     one of the bailors will be a close relative of the petitioner who<\/p>\n<p>                     will give an affidavit giving genealogy as to how he is related<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 2<\/span><\/p>\n<p>           with the petitioner. The bailor will also undertake to inform the<\/p>\n<p>           Court if there is any change in the address of the petitioner. (ii)<\/p>\n<p>           That the affidavit shall clearly state that the petitioner is not an<\/p>\n<p>           accused in any other case and if he is he shall not be released<\/p>\n<p>           on bail. (iii) That the bailor shall also state on affidavit that he<\/p>\n<p>           will inform the court concerned if the petitioner is implicated in<\/p>\n<p>           any other case of similar nature after his release in the present<\/p>\n<p>           case and thereafter the court below will be at liberty to initiate<\/p>\n<p>           the proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p id=\"p_4\">           (iv) That the petitioner will be well represented on each date<\/p>\n<p>           and if he fails to do so on two consecutive dates, his bail will be<\/p>\n<p>           liable to be cancelled.\n<\/p>\n<p id=\"p_5\">                     The Court below will initially release the petitioner on<\/p>\n<p>           provisional bail for a period of four months and if he satisfies<\/p>\n<p>           before the Court that the entire Rs. 40,000\/- had been paid by<\/p>\n<p>           him, the Court below shall confirm provisional bail granted to<\/p>\n<p>           the petitioner on the conditions mentioned above.<\/p>\n<p id=\"p_6\">                                           (Anjana Prakash, J.)<br \/>\nVikash\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Diwakar Prasad Sinha vs The State Of Bihar on 12 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.26936 of 2011 1.
