Whether the judgment should be reported in the Digest?\n\n\nHEMANT GUPTA, J.\n<\/pre>\n<p id=\"p_1\">         The present petition, in public interest, has claimed firstly<\/p>\n<p>strict compliance of Noise Pollution (Regulation and Control) Rules,<\/p>\n<p>2000 so as to take action against violators and not to give permission<\/p>\n<p>for use of loudspeakers and music systems in silence zones and<\/p>\n<p>secondly to take action against commercial vehicles for using<\/p>\n<p>pressure\/musical horns in the local areas of State of Punjab.<\/p>\n<p id=\"p_1\">         The petitioner has alleged to have made a representation to<\/p>\n<p>the learned Deputy Commissioner in respect of the aforesaid<\/p>\n<p>grievances.\n<\/p>\n<p id=\"p_2\"> CWP No.4675 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                -2-<\/span><\/p>\n<p>         After hearing learned counsel for the petitioner, we do not<\/p>\n<p>find any directions are required to be issued in the present case as<\/p>\n<p>we find that Supreme Court has already issued directions in Noise<\/p>\n<p>Pollution (I), IN RE vs. Union of India and another, 2005(5) SCC<\/p>\n<p id=\"p_3\">727. Relevant directions read as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         &#8220;XII. Directions<\/p>\n<p>         It is hereby directed as under:\n<\/p><\/blockquote>\n<pre id=\"pre_1\">            (i) Firecrackers         XXX               XXX\n\n            (ii) Loudspeakers\n\n<\/pre>\n<blockquote id=\"blockquote_1\"><p>             175.     1. The noise level at the boundary of the public<br \/>\n             place, where loudspeaker or public address system or<br \/>\n             any other noise source is being used shall not exceed<br \/>\n             10 dB(A) above the ambient noise standards for the<br \/>\n             area or 75 dB(A) whichever is lower.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                      2. No one shall beat a drum or tom-tom or blow<br \/>\n             a trumpet or beat or sound any instrument or use any<br \/>\n             sound amplifier at night (between 10 p.m. and 6 a.m.)<br \/>\n             except in public emergencies.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                      3. The peripheral noise level of privately-owned<br \/>\n             sound system shall not exceed by more than 5 dB(A)<br \/>\n             than the ambient air-quality standard specified for the<br \/>\n             area in which it is used, at the boundary of the private<br \/>\n             place.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>             (iii) Vehicular noise<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_5\"><p>              176. No horn should be allowed to be used at night<br \/>\n              (between 10 p.m. and 6 a.m.) in residential areas<br \/>\n              except in exceptional circumstances.\n<\/p><\/blockquote>\n<pre id=\"pre_2\">              (iv) Awareness         XXX               XXX\n\n              (v) Generally\n CWP No.4675 of 2009\n<span class=\"hidden_text\" id=\"span_1\">                                                                  -3-<\/span>\n\n\n<\/pre>\n<blockquote id=\"blockquote_6\"><p>               178. 1. The States shall make provision for seizure<br \/>\n               and confiscation of loudspeakers, amplifiers and such<br \/>\n               other equipment as are found to be creating noise<br \/>\n               beyond the permissible limits.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>                      2. Rule 3 of the Noise Pollution (Regulation and<br \/>\n               Control) Rules, 2000 makes provision for specifying<br \/>\n               ambient air-quality standards in respect of noise for<br \/>\n               different areas\/zones, categorization of the areas for<br \/>\n               the purpose of implementation of noise standards,<br \/>\n               authorizing the authorities for enforcement and<br \/>\n               achievement of laid down standards. The Central<br \/>\n               Government\/State Governments shall take steps for<br \/>\n               laying down such         standards and notifying the<br \/>\n               authorities where it has not already been done.&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">\n<p id=\"p_5\">          A Division Bench of this Court in a judgment reported as<\/p>\n<p>has also issued directions in Namit Kumar vs. U.T. Chandigarh,<\/p>\n<p>1998(3) RCR (Civil) 367        in respect of use of pressure\/musical<\/p>\n<p>horns. It was directed to the following effect:-<\/p>\n<blockquote id=\"blockquote_8\"><p>         &#8220;No power or musical horns shall be permitted in any vehicle<br \/>\n         light or heavy. In other words, only the standard horns which<br \/>\n         are fixed by the manufacturer of the car would be permitted<br \/>\n         strictly in adherence to the provisions of Rule 119 of the<br \/>\n         Rules. All vehicles, buses, trucks and cars which are fitted<br \/>\n         with power or musical horns shall remove the same within a<br \/>\n         period of 15 days from the date of pronouncement of this<br \/>\n         judgment.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">         All Government and private vehicles were directed to be<\/p>\n<p>strictly complied with the aforesaid directions.<\/p>\n<p id=\"p_8\">         In view of the above that directions in respect of noise<\/p>\n<p>pollution on account of use of loud speakers &amp; musical\/pressure<br \/>\n CWP No.4675 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                                                -4-<\/span><\/p>\n<p>horns have already been issued, no further directions are required to<\/p>\n<p>be issued in the present petition.\n<\/p>\n<p id=\"p_9\">         Therefore, we dispose of the present writ petition with a<\/p>\n<p>direction to the learned Deputy Commissioner to decide the<\/p>\n<p>representation submitted by the petitioner and to take such<\/p>\n<p>necessary action as is contemplated in law. In the event, the<\/p>\n<p>directions mentioned above are not complied with, the petitioner shall<\/p>\n<p>have liberty to take recourse to the remedy including that of the<\/p>\n<p>contempt of the directions in an appropriate forum in accordance with<\/p>\n<p>law.\n<\/p>\n<p id=\"p_10\">         Writ petition is disposed of accordingly.<\/p>\n<pre id=\"pre_3\">        (T.S.
