Dagli,<br \/>\n\tlearned Advocate for the petitioner and Mr. Shivang Shukla, learned<br \/>\n\tAPP for the respondents.\n<\/p>\n<p id=\"p_1\">This<br \/>\n\tpetition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India read with<br \/>\n\tvarious provisions<a href=\"\/doc\/445276\/\" id=\"a_1\"> of Criminal Procedure Code<\/a> is filed with a prayer<br \/>\n\tto quash and set aside the judgment and order passed by the learned<br \/>\n\tDistrict and Sessions Judge, Porbandar in Criminal Revision<br \/>\n\tApplication No.9\/\/2010 decided on 08.02.2010 and also to quash and<br \/>\n\tset aside the judgment and order passed by learned Judicial<br \/>\n\tMagistrate First Class, Porbandar in an application<br \/>\n\tunder <a href=\"\/doc\/839149\/\" id=\"a_2\">Section 167(2)<\/a> of the Code.\n<\/p>\n<p id=\"p_2\">Mr.\n<\/p>\n<p id=\"p_3\">\tAshish M. Dagli, learned Advocate for the petitioner submits that a<br \/>\n\tcomplaint being C.R. No.II-120\/2009 was filed before Bhagvadar<br \/>\n\tPolice Station for offences punishable under Mines and <a href=\"\/doc\/2441339\/\" id=\"a_3\">Mineral Act<\/a><br \/>\n\tand also under <a href=\"\/doc\/1101188\/\" id=\"a_4\">Sections 379<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_5\">114<\/a> IPC against nine persons on<br \/>\n\t29.10.2009.  Since the investigation was not completed within 60<br \/>\n\tdays and one co-accused, Shri. Jaisukh Premji Singadia had<br \/>\n\tapproached the High Court of Gujarat by filing Criminal<br \/>\n\tMiscellaneous Application No.13726\/2009, the investigation was<br \/>\n\tstayed by this Court on 07.12.2009 and the investigating agency has<br \/>\n\ttaken shelter under the above order of the High Court for not filing<br \/>\n\tthe chargesheet within the stipulated time of 60 days.\n<\/p>\n<p id=\"p_4\">The<br \/>\n\tCourts below have accepted the above explanation of the<br \/>\n\tinvestigating agency and being aggrieved and dissatisfied by the<br \/>\n\torder passed by the Courts below, the petitioner has revoked the<br \/>\n\textraordinary jurisdiction of this Court under <a href=\"\/doc\/1712542\/\" id=\"a_6\">Article 226<\/a> of the<br \/>\n\tConstitution of India.\n<\/p>\n<p id=\"p_5\">At<br \/>\n\tthe outset, Mr. Ashish M. Dagli, learned Advocate for the petitioner<br \/>\n\thas placed reliance on the order dated 5th<br \/>\n\tMarch, 2010 passed by the learned<br \/>\n\tSingle Judge in Special Criminal Application No.274\/2010 and<br \/>\n\tsubmitted that the petitioner is on par with the petitioner of the<br \/>\n\tabove application and deserves same benefit in addition to the<br \/>\n\tground urged in the application.\n<\/p>\n<p id=\"p_6\">Mr.\n<\/p>\n<p id=\"p_7\">\tShivang Shukla, learned APP submitted that the charge-sheet could<br \/>\n\tnot be filed within stipulated time period of 60 days in view of the<br \/>\n\toperation of the stay granted by the High Court in the matter of the<br \/>\n\tco-accused.\n<\/p>\n<p id=\"p_8\">Having<br \/>\n\theard the learned Advocates appearing for the parties and on perusal<br \/>\n\tof the record, I am of the view that the reasoning of the Courts<br \/>\n\tbelow denying benefit of provisions of <a href=\"\/doc\/1815602\/\" id=\"a_7\">Section 167(2)<\/a> of the Code is<br \/>\n\tunjust and contrary to law, inasmuch as the stay granted by this<br \/>\n\tHigh Court qua the co-accused was not operating so far as other<br \/>\n\taccused are concerned and therefore, in Paragraphs 4 and 5, learned<br \/>\n\tSingle Judge has in order dated 5th March, 2010 passed in<br \/>\n\tSpecial Criminal Application No.274\/2010 observed as under :-\n<\/p>\n<p id=\"p_9\"> 4. I have heard<br \/>\n\t\tthe learned Advocate of both the sides at length and in great<br \/>\n\t\tdetail. On perusal of the reasoning given by the<br \/>\n\t\tlearned District &amp; Sessions Judge, Porbandar in Criminal<br \/>\n\t\tRevision Application No.7 of 2010, it becomes clear that the stay<br \/>\n\t\twhich was granted by the High Court in quashing petition was in<br \/>\n\t\trespect of that particular applicant who had approached the<br \/>\n\t\tHigh Court and the entire proceedings were not stayed.  This aspect<br \/>\n\t\thas not been dealt with by the learned Sessions Judge and since<br \/>\n\t\tblanket stay was not granted by the High Court against the FIR<br \/>\n\t\tbeing CR No.II-120 of 2009, I am of the view that the petition<br \/>\n\t\tdeserves to be allowed. Looking to other evidence on the record of<br \/>\n\t\tthe case, I am of the view that since stay was not granted against<br \/>\n\t\tall the accused to proceed with the investigation, investigating<br \/>\n\t\tofficer could have filed charge-sheet within stipulated time limit<br \/>\n\t\tand since charge-sheet was not filed within the stipulated time<br \/>\n\t\tlimit, the petitioner is entitled to invoke provisions of <a href=\"\/doc\/2441339\/\" id=\"a_8\">Section<br \/>\n\t\t167<\/a>[2]<a href=\"\/doc\/1569253\/\" id=\"a_9\"> of the Code<\/a> seeking default bail.  The petition, therefore,<br \/>\n\t\tdeserves to be allowed.\n<\/p>\n<p id=\"p_10\">5. For the foregoing reasons, the<br \/>\n\t\tpetition is allowed. Judgment and order dated 8.2.2010 passed by<br \/>\n\t\tthe learned District &amp; Sessions Judge, Porbandar in Criminal<br \/>\n\t\tRevision Application No.7 of 2010 as well as the judgment and order<br \/>\n\t\tdated 28.1.2010 passed by the learned Additional Civil Judge &amp;<br \/>\n\t\tJudicial Magistrate First Class, Porbandar in an application<br \/>\n\t\tpreferred under <a href=\"\/doc\/2441339\/\" id=\"a_10\">Section 167<\/a>[2]<a href=\"\/doc\/1569253\/\" id=\"a_11\"> of the Code<\/a> of Criminal Procedure<br \/>\n\t\tare hereby quashed and set aside.  The petitioner is ordered to be<br \/>\n\t\tenlarged on bail in connection with CR No.II-120 of 2009 for the<br \/>\n\t\toffence punishable under <a href=\"\/doc\/35596586\/\" id=\"a_12\">Section 4<\/a>[1], 4[1]-A and 21[1][2] of Mines<br \/>\n\t\tand <a href=\"\/doc\/25127\/\" id=\"a_13\">Minerals Act<\/a> along with <a href=\"\/doc\/2441339\/\" id=\"a_14\">Section 5-42<\/a> and <a href=\"\/doc\/196906472\/\" id=\"a_15\">13<\/a>[2] of Gujarat Mines<br \/>\n\t\tand Minerals Rules as well as under <a href=\"\/doc\/1101188\/\" id=\"a_16\">Sections 379<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_17\">114<\/a> of Indian<br \/>\n\t\tPenal Code registered with Bagvadar Police station on executing a<br \/>\n\t\tbond of Rs.10,000\/- [Rupees ten thousand only] with one surety of<br \/>\n\t\tthe like amount to the satisfaction of the Trial Court and subject<br \/>\n\t\tto the conditions that he shall :\n<\/p>\n<p id=\"p_11\">[a] not take undue advantage of<br \/>\n\t\this liberty or abuse his liberty;\n<\/p>\n<p id=\"p_12\">[b] not act in a manner injurious<br \/>\n\t\tto the interest of the prosecution;\n<\/p>\n<p id=\"p_13\">[c] surrender his passport, if<br \/>\n\t\tany, to the lower Court within a week;\n<\/p>\n<p id=\"p_14\">[d] not leave the State of Gujarat<br \/>\n\t\twithout the prior permission of the Sessions Court concerned;\n<\/p>\n<p id=\"p_15\">[e] mark his presence at the<br \/>\n\t\tconcerned Police Station on any day of first week of every English<br \/>\n\t\tcalendar month between 9.00 AM and 2.00 PM till the trial is over;\n<\/p>\n<p id=\"p_16\">[f] furnish the present address of<br \/>\n\t\this residence to the I.O. and also to the Court at the time of<br \/>\n\t\texecution of the bond and shall not change his residence without<br \/>\n\t\tprior permission of this Court;\n<\/p>\n<p id=\"p_17\">[g] maintain law and order.\n<\/p>\n<p id=\"p_18\">Considering<br \/>\n\tthe above aspect, I am inclined to accept the prayer of the<br \/>\n\tpetitioner and orders impugned of the Courts below are quashed and<br \/>\n\tset aside the petitioner is ordered to be released on bail on<br \/>\n\this executing a bond of Rs.10,000\/- [Rupees Ten Thousand only] with<br \/>\n\tone surety of the like amount to the satisfaction of the Trial Court<br \/>\n\tand subject to the conditions that the petitioner shall :-\n<\/p>\n<p id=\"p_19\">\t\t[a] not<br \/>\n\t\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_20\">\t\t[b] not<br \/>\n\t\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_21\">\t\t[c]<br \/>\n\t\tsurrender his passport, if any, to the lower Court within a week;\n<\/p>\n<p id=\"p_22\">\t\t[d] not<br \/>\n\t\tleave the State of Gujarat without the prior permission of the<br \/>\n\t\tSessions Court concerned;\n<\/p>\n<p id=\"p_23\">\t\t[e]<br \/>\n\t\tmark his presence at the concerned Police Station on any day of<br \/>\n\t\tfirst week of every English calendar month between 9.00 AM and 2.00<br \/>\n\t\tPM till the trial is over;\n<\/p>\n<p id=\"p_24\">\t\t[f]<br \/>\n\t\tfurnish the present address of his residence to the I.O. and also<br \/>\n\t\tto the Court at the time of execution of the bond and shall not<br \/>\n\t\tchange his residence without prior permission of this Court;\n<\/p>\n<p id=\"p_25\">\t\t[g]<br \/>\n\t\tmaintain law and order.\n<\/p>\n<p id=\"p_26\">If<br \/>\n\tbreach of the any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or to take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_27\">Bail<br \/>\n\tbond to be executed before the lower Court have jurisdiction to try<br \/>\n\tthe case.\n<\/p>\n<p id=\"p_28\">At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the petitioner on bail.\n<\/p>\n<p id=\"p_29\">The<br \/>\n\tpetition is accordingly, allowed.
