KAPADIA\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">J U D G M E N T<br \/>\n(Arising out of SLP(C) No.24424\/2004)<\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p id=\"p_1\">\tLeave granted.\n<\/p>\n<p id=\"p_2\">\tChallenge in this appeal is to the decision by a<br \/>\nlearned Single Judge of the Allahabad High Court holding<br \/>\nthat the auction sale on 18.8.1989 and confirmation thereof<br \/>\nwas illegal. Kedar Nath Dubey, the predecessor of the<br \/>\nappellant was the successful bidder. Objection filed by Sheo<br \/>\nNarain Dubey, the predecessor of non-official respondents<br \/>\nwas rejected by order dated 18.8.1989.\n<\/p>\n<p id=\"p_3\">A brief reference to the factual aspects would suffice.\n<\/p>\n<p id=\"p_4\">\tThe writ petitioner, Sheo Narain Dubey, the predecessor<br \/>\nof non-official respondents had taken a loan for purchasing<br \/>\npumping set from U.P. State Sahkari Agricultural Avam Gram<br \/>\nVikas Bank Limited, Salenpur, Deoria. As the said loan was<br \/>\nnot repaid within the stipulated time, proceedings were<br \/>\ninitiated for recovery of amount as arrears of land revenue<br \/>\nunder the Uttar Pradesh Zamindari Abolition and Land Reforms<br \/>\nAct, 1950 (in short &#8216;the Act&#8217;). Land belonging to the writ<br \/>\npetitioner was auctioned on 18.8.1989. Bid of Kedar Nath<br \/>\nDubey, the predecessor of the present appellant was<br \/>\naccepted. Sheo Narain Dubey filed objection under Rule<br \/>\n285(I) of the Uttar Pradesh Zamindari Abolition and Land<br \/>\nReforms Rules, 1953 (in short &#8216;the Rules&#8217;).  The stand taken<br \/>\nwas that there was material irregularity in the service of<br \/>\nnotice as well as in conducting the sale and thereby Rule<br \/>\n285(A) of the Rules had been violated. The said objection<br \/>\nwas rejected and the sale was confirmed. The writ petition<br \/>\nwas filed in 1991. Mutation proceedings had been undertaken<br \/>\nin the meantime by Kedar Nath. In the counter affidavit<br \/>\nfiled before the High Court, stand taken was that the order<br \/>\nof the concerned authority i.e. the Commissioner, Gorakhpur<br \/>\nDivision, Gorakhpur dated 7.1.1991 clearly indicated that<br \/>\nthe plea of the writ petitioner was untenable. When the<br \/>\namount alongwith interest and other dues were not paid, the<br \/>\nbank had requested for recovery proceedings. Form 73 and<br \/>\nForm 73 A were sent to the writ petitioner which were<br \/>\npersonally served. Thereafter date of auction was fixed on<br \/>\n18.8.1989 and the request notice was duly served. As Kedar<br \/>\nNath Dubey was the highest bidder, his bid was accepted.<br \/>\nConsidering the materials on record it was found that the<br \/>\nrequisite procedure and the prescribed rules had been<br \/>\nfollowed and there was no necessity for interfering in<br \/>\nauction. It was indicated that the loan account had already<br \/>\nbeen closed on 5.2.1991 as the entire amount had been<br \/>\nrecovered by sale of the land. It was highlighted with<br \/>\nreference to the order dated 7.1.1991 that Sheo Narain Dubey<br \/>\nwas a habitual loan taker and had defaulted on many<br \/>\noccasions in re-paying the loans.  The writ petitioner filed<br \/>\na rejoinder affidavit stating that there was no compliance<br \/>\nwith the requirements of confirmation. The writ petitioner&#8217;s<br \/>\nstand was that he wanted to deposit the amount on 1.5.1991<br \/>\nbut the same was not accepted and, therefore, he approached<br \/>\nAdditional District Magistrate (in short the &#8216;ADM&#8217;) to<br \/>\ndirect the Tehsildar, Salempur to accept the amount and the<br \/>\namount had been deposited on 6.5.1991.\n<\/p>\n<p id=\"p_5\">Primary stand before the High Court was that the<br \/>\nprescribed Rules were not followed, and in any event the<br \/>\nauction sale was confirmed by the Sub-Divisional Magistrate<br \/>\n(in short the &#8216;SDM&#8217;) who did not have the authority to<br \/>\nconfirm the sale or conduct the sale.  The confirmation was,<br \/>\naccording to the writ petitioner, by an incompetent<br \/>\nauthority and, therefore, the entire proceeding was invalid.<br \/>\nThe High Court took the view that the application filed by<br \/>\nthe writ petitioner for setting aside the auction sale was<br \/>\nfull of vague and evasive statements relating to the<br \/>\nallegation that the norms laid down in Rule 285(I) were not<br \/>\nconfirmed and there was material irregularity. The High<br \/>\nCourt, therefore, held that the Commissioner was right in<br \/>\nholding that the order passed by the Commissioner did not<br \/>\nsuffer from any infirmity. However, it was held that the<br \/>\ncrucial issue was that the Collector is the authority to<br \/>\nconfirm the sale. In this context reference was made to<br \/>\nRules 285-A, 285-H, 285-I, 285-J, 285-K and 285-L and it was<br \/>\nheld that under Rules 284 and 285 the confirmation of the<br \/>\nsale has to be done either by the Collector in person or by<br \/>\nan Assistant Collector specifically appointed by him in that<br \/>\nbehalf. It was held that the SDM did not have any authority.<br \/>\nA reference was made to a Notification dated 17.1.1976 to<br \/>\nconclude that the Assistant Collectors of the First Class<br \/>\nwho are in charge of the Sub Division can discharge the<br \/>\nfunction of the Collector subject to the condition that the<br \/>\nsales are approved by the Collector. The High Court was of<br \/>\nthe further view that except power of approval of sale, the<br \/>\nSDM has every other power of Collector. It was, therefore,<br \/>\nheld that the Collector alone is empowered to confirm the<br \/>\nsale and issue sale certificate.  The Assistant Collector is<br \/>\nnot authorized in that behalf in view of the scheme of the<br \/>\nRules as indicated in the notification dated 17th January,<br \/>\n1976.\n<\/p>\n<p id=\"p_6\">\tIn support of the appeal, learned counsel for the<br \/>\nappellant submitted that the High Court considered a new<br \/>\nground of challenge which is impermissible. After having<br \/>\nnoticed that the respondents did not make out a case for<br \/>\ninterference in terms of Rule 285-H it proceeded to consider<br \/>\nan issue which was not even pleaded in the Writ Petition.<br \/>\nHigh Court erroneously made reference to 17th January,<br \/>\n1976 notification without noticing that other notifications<br \/>\nwhich held the field clearly indicated that the Sub-<br \/>\nDivisional Officer has the power to accord approval to the<br \/>\nauction sale. Particular reference in this regard was made<br \/>\nto Notification dated 11.6.1953 and letter of the Secretary,<br \/>\nRevenue Board U.P. dated 7.7.1983. As the Writ Petitioner<br \/>\nrested its case on Rule 285-I and the High Court did not<br \/>\nfind anything irregular in the order of the Commissioner<br \/>\nholding that the provision to Rule 285-I had been complied<br \/>\nwith, no interference by the High Court was called for.\n<\/p>\n<p id=\"p_7\">\tIn response, learned counsel for the non-official<br \/>\nrespondents submitted that the question of confirmation was<br \/>\nintermittingly linked with the question of legality of the<br \/>\nauction which was impugned. According to him the High<br \/>\nCourt&#8217;s order does not suffer from any infirmity to warrant<br \/>\nany interference. Rules 285-A, 285-H, 285-I, 285-J, 285-K<br \/>\nand 285-L read as follows:\n<\/p>\n<p id=\"p_8\">&#8220;285-A  Every sale under Sections 284 and<br \/>\n285 shall be made either by the Collector in<br \/>\nperson or by an Assistant Collector specially<br \/>\nappointed by him in this behalf.  No such<br \/>\nsale shall take place on a Sunday or other<br \/>\ngazetted holiday, or until after expiration<br \/>\nof at least thirty days from the date on<br \/>\nwhich the proclamation under Rule 282 was<br \/>\nissued.\n<\/p>\n<p id=\"p_9\">285-H  Any person whose holding or other<br \/>\nimmovable property has been sold under the<br \/>\nAct, he may, at any time within thirty days,<br \/>\nfrom the date of sale, apply to have the sale<br \/>\nset aside on his depositing in the<br \/>\nCollector&#8217;s office.\n<\/p>\n<p id=\"p_10\">(a)\tfor payment to the purchaser, a sum<br \/>\nequal to 5% of the purchase money;\n<\/p>\n<p id=\"p_11\">and <\/p>\n<p id=\"p_12\">(b)\tfor payment on account of arrears,<br \/>\nthe amount specified in the<br \/>\nproclamation in Z.A. Form 74 for<br \/>\nrecovery of which sale was ordered,<br \/>\nless any amount which may, since<br \/>\nthe date of such proclamation of<br \/>\nsale have been paid on that<br \/>\naccount; and<\/p>\n<p id=\"p_13\">(c)\tthe cost of the sale.\n<\/p>\n<p id=\"p_14\">On the making of such deposit, the Collector<br \/>\nshall pass an order setting aside the sale.\n<\/p>\n<p id=\"p_15\">Provided that if a person applied under Rule<br \/>\n285-I to set aside such sale he shall not be<br \/>\nentitled to make an application under this<br \/>\nrule.\n<\/p>\n<p id=\"p_16\">285-I  (i) At any within thirty days from<br \/>\nthe date of sale, application may be made to<br \/>\nthe Commissioner to set aside the sale on the<br \/>\nground of some material irregularity or<br \/>\nmistake in publishing or conducting it; but<br \/>\nno sale shall be set aside on such ground<br \/>\nunless the applicant proves to the<br \/>\nsatisfaction of the Commissioner that he has<br \/>\nsustained substantial injury by reason of<br \/>\nsuch irregularity or mistake;\n<\/p>\n<p id=\"p_17\">(ii)\tdeleted.\n<\/p>\n<p id=\"p_18\">(iii) The order of the Commissioner passed<br \/>\nunder this rule shall be final.\n<\/p>\n<p id=\"p_19\">285-J  On the expiration of thirty days from<br \/>\nthe date of the sale if no such application<br \/>\nas is mentioned in Rule 285-H or Rule 285-I<br \/>\nhas been made or if such application has been<br \/>\nmade and rejected by the Collector or the<br \/>\nCommissioner, the Collector shall pass an<br \/>\norder confirming the sale after satisfying<br \/>\nhimself that the purchase of land in question<br \/>\nby the bidder would not be in contravention<br \/>\nof the provisions of Section 154 every order<br \/>\npassed under this rule shall be final.\n<\/p>\n<p id=\"p_20\">285-K  If no application under Rule 285-I is<br \/>\nmade within the time allowed therefore, all<br \/>\nclaims on the ground of irregularity or<br \/>\nmistake in publishing or conducting the sale<br \/>\nshall be barred.\n<\/p>\n<p id=\"p_21\">Provided that nothing contained in this rule<br \/>\nshall bar the institution of a suit in the<br \/>\ncivil court for the purpose of setting aside<br \/>\na sale on the ground of fraud.\n<\/p>\n<p id=\"p_22\">285-L  Whenever the sale of any holding or<br \/>\nother immovable property is set aside under<br \/>\nRule 285-H or Rule 285-I the purchaser shall<br \/>\nbe entitled to receive back his purchase<br \/>\nmoney plus an amount not exceeding five<br \/>\npercent of the purchase money as the<br \/>\nCollector or the Commissioner, as the case<br \/>\nmay be, may determine.&#8221;\n<\/p>\n<p id=\"p_23\">At this juncture, it would be necessary to take note of<br \/>\nthe Notification dated 11.6.1953 issued by the Revenue<br \/>\nDepartment and published in U.P. Gazette dated 13.6.1953.<br \/>\nThe Notification dated 11.6.1953 reads as follows:\n<\/p>\n<p id=\"p_24\">\t&#8220;Revenue Department Notification No.<br \/>\n1756\/1A-1073-53 dated June 11, 1953,<br \/>\npublished in U.P. Gazette dated June 13,<br \/>\n1953:\n<\/p>\n<p id=\"p_25\">In exercise of the powers conferred<br \/>\nby clause (4) of Section 3 of the<br \/>\nUttar Pradesh Zamindari Abolition<br \/>\nand Land Reforms Act, 1950 [(Act 1<br \/>\nof (1951)], the Governor is pleased<br \/>\nto empower all the Sub Divisional<br \/>\nOfficers in Uttar Pradesh except<br \/>\nthose in the districts of Almora,<br \/>\nGarhwal, Tehri Garhwal and Rampur<br \/>\nto discharge all the functions of a<br \/>\n&#8220;Collector&#8221; under the said Act.&#8221;\n<\/p>\n<p id=\"p_26\">The Notification makes the position clear that in all<br \/>\nthe districts of Uttar Pradesh except districts of Almora,<br \/>\nGarhwal, Tehri Garhwal and Rampur SDOs were authorized to<br \/>\ndischarge all the functions of the Collector under the Act.<br \/>\nA bare reading of the Notification dated 11.6.1953 as<br \/>\npublished in the official gazette dated 13.6.1953 shows that<br \/>\nit empowered all SDOs in Uttar Pradesh except those in the<br \/>\nenumerated districts to discharge all the functions of the<br \/>\nCollector under the Act. Letter of the Secretary, Revenue<br \/>\nBoard, U.P. dated 7.7.1983 also throws light on the<br \/>\ncontroversy. It related to discharge of power under various<br \/>\nprovisions of the Act. It noted that by notification of<br \/>\n5.12.1968 Sub-Divisional Officers have been authorized to<br \/>\ndischarge all functions of the Collector under the Act<br \/>\nexcept Section 198. Prima facie the stand of the appellant<br \/>\nis correct.  It appears that these pleas were not considered<br \/>\nby the High Court. We remit the matter to the High Court for<br \/>\nconsidering it in accordance with law. We make it clear that<br \/>\nno opinion has been expressed by us on the merits of the<br \/>\ncase. The High Court may dispose of the matter as<br \/>\nexpeditiously as possible as the writ petition is pending<br \/>\nfor more than a decade. It would be proper for the High<br \/>\nCourt to hear the matter afresh and take a decision on the<br \/>\nvarious issues involved, as there are certain vital<br \/>\nquestions which were not considered by the High Court.
