02.   31.03.2011            Petitioner     is    apprehending     his   arrest    in    a<\/p>\n
                   complaint case in which cognizance has been taken<\/p>\n
                   under Sections 341<\/a>, 342<\/a>, 323<\/a>, 120B<\/a>, 448<\/a>, 420<\/a>, 406<\/a>, 384<\/a><\/p>\n
                   of the I.P.C.\n<\/p>\n
                            The accusation is that the complainant made a<\/p>\n
                   development agreement with the petitioner but the<\/p>\n
                   petitioner      being   the     Managing       Director   of        the<\/p>\n
                   construction company has not constructed the share of<\/p>\n
                   flats of the complainant as per the agreement and<\/p>\n
                   subsequently in furnishing the same, complainant has to<\/p>\n
                   spent Rs. 15,00,000\/-.\n<\/p>\n
                            It is submitted by learned counsel for the<\/p>\n
                   petitioner that accusation is based on a contract and no<\/p>\n
                   criminal offence is made out and there was an arbitration<\/p>\n
                   clause also in the agreement.\n<\/p>\n
                            Considering the aforesaid facts, let the petitioner<\/p>\n
                   namely Md. Fakharuzzaman Ansari, in the event of his<\/p>\n
                   arrest or surrender before the Court below within a<\/p>\n
                   period   of     12   weeks     from   today,    be   released       on<\/p>\n
                   anticipatory bail on furnishing bail bond of Rs. 10,000\/-<\/p>\n
                   (ten thousand) with two sureties of the like amount each
\n                             2<\/span><\/p>\n
          to the satisfaction of Judicial Magistrate, Ist Class, Patna<\/p>\n
          in connection with Complaint Case No. 95(C ) of 2009.<\/p>\n
