1.   Heard.\n<\/p>\n
\n
2.   This  appeal  has been filed against the  impugned<\/p>\n
     order  dated  12.04.2010  passed  by  the  learned<\/p>\n
     Single  Judge  in W.P.(S) No.1562\/2010  dismissing<\/p>\n
     the said writ petition.\n<\/p>\n
\n
3.   Brief  facts  of  the  case  are  that  the   writ<\/p>\n
     appellant was allegedly caught red handed  by  the<\/p>\n
     vigilance  team while taking bribe.   Consequently<\/p>\n
     an  order  for suspension was passed on 14.07.2008<\/p>\n
     suspending him from the post of Patwari  by  order<\/p>\n
     of  Collector (Land Records), Durg.  In that order<\/p>\n
     it  was  mentioned  that on  25.06.2008  the  writ<\/p>\n
     appellant caught red handed while taking bribe  of<\/p>\n
     Rs.1500\/-  and this act is contrary to Rule  3  of<\/p>\n
     the  Chhattisgarh Civil Services (Conduct)  Rules,<\/p>\n
     1965  and  as such he was placed under  suspension<\/p>\n
     with  immediate effect.  Thereafter on 03.02.2009,<\/p>\n
     the suspension order was revoked.\n<\/p>\n

4.   On conclusion of the investigation, a charge sheet<\/p>\n
     was  filed against the writ appellant.  Consequent<\/p>\n
     to  which, he was placed under suspension again by<\/p>\n
     order  dated 23rd March, 2010. A special case  was<\/p>\n
     registered as 02\/2010 against the petitioner.<\/p>\n
5.   Rule  9(1)  of  the  Chhattisgarh  Civil  Services<\/p>\n
     (Classification, Control and Appeal)  Rules,  1966<\/p>\n
     deals  with  suspension.  It  provides  that   the<\/p>\n
     appointing authority or any authority to which  it<\/p>\n
     is  subordinate or the disciplinary  authority  or<\/p>\n
     any  other  authority empowered in that behalf  by<\/p>\n
     the  Governor,  by general or special  order,  may<\/p>\n
     place a Government servant under suspension in the<\/p>\n
     following circumstances :\n<\/p>\n
     (a)  Where  a disciplinary proceeding against  him
\n          is contemplated or is pending; or<\/p>\n
     (b)  Where  a case against him in respect  of  any
\n          criminal   offence  is  under  investigation,
\n          inquiry or trial :\n<\/p>\n
     Further, there are two provisos.  According to the<\/p>\n
     first   proviso,   a  Government   Servant   shall<\/p>\n
     invariably  be  placed  under  suspension  when  a<\/p>\n
     challan   for   a   criminal   offence   involving<\/p>\n
     corruption  or  other  moral  turpitude  is  filed<\/p>\n
     against him.\n<\/p>\n

6.   Learned counsel for the writ appellant raises  the<\/p>\n
     contention  that  once  the suspension  order  was<\/p>\n
     passed  and  revoked, the order  of  re-suspension<\/p>\n
     could  not  have been passed and the same  is  not<\/p>\n
     sustainable  in  the eye of law as  the  order  of<\/p>\n
     revocation cannot be reviewed.\n<\/p>\n
7.   On  the  other hand, learned State Counsel opposes<\/p>\n
     the appeal and submits that there is no illegality<\/p>\n
     in  the  impugned second order of  suspension.  He<\/p>\n
     placed reliance on the decision of M.P. High Court<\/p>\n
     (Gwalior   Bench)   in   Letters   Patent   Appeal<\/p>\n
     No.202\/1999 (Chandra Pal Singh Pundhir  -vs.  M.P.<\/p>\n
     Board  of Secondary Education, Bhopal and  others<\/a>)<\/p>\n
     reported  in 2002 (4) M.P.H.T. 213 (DB) which  was<\/p>\n
     filed against the order of learned Single Judge in<\/p>\n
     the  writ  petition, in which the second order  of<\/p>\n
     suspension  was  under  challenge.   The   learned<\/p>\n
     single judge of M.P. High Court has observed  that<\/p>\n
     considering  the ratio laid down  by  the  Supreme<\/p>\n
     Court in U.P. Rajya Krishi Utpadan Mandi Pa;rishad<\/p>\n
     Vs.  Rajiv  Rajan reported in 1993 Supp.  (3)  SCC<\/p>\n
     483, the order passed by the Board, suspending the<\/p>\n
     petitioner again appears to be proper and there is<\/p>\n
     no  reason  to  interfere with the  order  of  the<\/p>\n
     suspension passed by the Board. Similar contention<\/p>\n
     was raised in LPA that the second suspension order<\/p>\n
     amounts to review.  Referring to first proviso  to<\/p>\n
     Clause  (1) of Rule 9 of the Madhya Pradesh  Civil<\/p>\n
     Services  (Classification,  Control  and   Appeal)<\/p>\n
     Rules  in  the  said case i.e.,  Chandrapal  Singh<\/p>\n
     Pundhir  (supra), the Division Bench of M.P.  High<\/p>\n
     Court  observed  that the second suspension  order<\/p>\n
     was  passed  by  the  Chairman  of  the  Board  on<\/p>\n
     pendency of Criminal Case No.2690\/1998 against the<\/p>\n
     petitioner  and in the second order of suspension,<\/p>\n
     it  was specifically mentioned that looking to the<\/p>\n
     nature  of  criminal case, the  second  suspension<\/p>\n
     order  is  passed. Therefore, the  Division  Bench<\/p>\n
     opined  that  it  is  not a review  of  the  first<\/p>\n
     suspension order and further in case of U.P. Rajya<\/p>\n
     Utpadan Mandi Parishad Vs. Rajiv Rajan (supra), it<\/p>\n
     has  been clearly laid down by the Apex Court that<\/p>\n
     there is no restriction on the authority to pass a<\/p>\n
     suspension order for the second time.<\/p>\n
8.   We  have perused the first suspension order  which<\/p>\n
     was  not  passed on the basis of any investigation<\/p>\n
     or  trial   but was passed on the allegation  that<\/p>\n
     his act was contrary to Rule 3 of the Chhattisgarh<\/p>\n
     Civil Services (Conduct) Rules, 1965 and the  said<\/p>\n
     suspension  on that ground was revoked.   But  the<\/p>\n
     impugned  order of suspension has been  passed  on<\/p>\n
     submission  of the charge-sheet against  the  writ<\/p>\n
     appellant   in   the  criminal  court   which   is<\/p>\n
     permissible in view of first proviso to Clause (1)<\/p>\n
     of  Rule  9  of  CCA Rules that on  submission  of<\/p>\n
     Challan  for  a  criminal  offence  in  the  Court<\/p>\n
     involving corruption or other moral turpitude  the<\/p>\n
     Government  servant  shall  invariably  be  placed<\/p>\n
     under  suspension  and  therefore,  it  cannot  be<\/p>\n
     termed as Review or a second order.  In fact under<\/p>\n
     that  provision the impugned order was  the  first<\/p>\n
     order of suspension.\n<\/p>\n

9.   In view of the above, we do not find it a fit case<\/p>\n
     for  interference in the impugned order passed  by<\/p>\n
     the  learned  single Judge. The  writ  appeal  is,<\/p>\n
     therefore,  misconceived and is dismissed  at  the<\/p>\n
     admission stage.\n<\/p>\n
\n
10.  However,  this will not debar the petitioner  from<\/p>\n
     filing   an  appeal  if  the  impugned  order   of<\/p>\n
     suspension is appealable.  No cost.<\/p>\n
