S.J.MUKHOPADHAYA)<\/p>\n<p>\tIn<br \/>\nall these Appeals, the appellants have challenged the common judgment<br \/>\ndated 25th November 2009 or part thereof, whereby the<br \/>\nlearned Single Judge has laid down certain principles for<br \/>\ndetermination of question of waiver of agricultural debt.\n<\/p>\n<p id=\"p_1\">\tLearned<br \/>\ncounsel appearing on behalf of the respondent would submit that the<br \/>\naforesaid common judgment dated 25th November 2009 fell<br \/>\nfor consideration before a Division Bench of this Court in the case<br \/>\nof &#8220;Kantibhai Chhotubhai Patel v\/s. Union of India&#8221;, in<br \/>\nLetters Patent Appeal No.1484\/2010 and analogous cases, wherein by a<br \/>\ncommon judgment dated 11th March 2011, the Division Bench<br \/>\nof this Court, while reversing some of the findings given by the<br \/>\nlearned Single Judge, clarified the matter and disposed of the<br \/>\nAppeals with certain observations and liberty to the farmers.\n<\/p>\n<p id=\"p_2\">\tLearned<br \/>\ncounsel appearing on behalf of the appellants, while accepting that<br \/>\nthe judgment dated 11th March 2011 passed in the case of<br \/>\n&#8220;Kantibhai Chhotubhai Patel&#8221; (supra) covers the present<br \/>\nAppeals, would contend that no specific finding has been given with<br \/>\nregard to the land purchased by some of the farmers for agriculture<br \/>\npurpose and activities allied to agriculture out of the loan amount.\n<\/p>\n<p id=\"p_3\">\tWe<br \/>\nhave heard learned counsel for the appellants and the respondent and<br \/>\nalso perused the judgment.\n<\/p>\n<p id=\"p_4\">\tWe<br \/>\nhave noticed that the Division Bench of this Court, while disposing<br \/>\nof the case of &#8220;Kantibhai Chhotubhai Patel&#8221; (supra), has<br \/>\ndealt with the question of loan which has been given for agriculture<br \/>\npurpose and activities allied to agriculture. Whether an individual<br \/>\nagriculturist has utilized the loan for agriculture purpose or<br \/>\nactivities allied to agriculture, being based on the question of<br \/>\nfacts of each case, such issue has not been decided by this Court but<br \/>\nleft it open for the concerned Bank to examine and decide such claim,<br \/>\nif any, made by individual farmer(s). The observation of the learned<br \/>\nSingle Judge that such examination has to be done by the nodal agency<br \/>\nhas only been reversed.\n<\/p>\n<p id=\"p_5\">\tIn<br \/>\nview of the aforesaid judgment rendered in the case of &#8220;Kantibhai<br \/>\nChhotubhai Patel&#8221; (supra) and the clarification as made above,<br \/>\nand as the appellants are also covered by such judgment, no separate<br \/>\norder need be passed in the present case. The farmers and members of<br \/>\nthe cooperative societies are given liberty to claim as per the<br \/>\njudgment rendered in the aforesaid case.
