SIRI JAGAN, J.\n               - - - - - - - - - - - - - - - - - - - - - - -\n                   W.P.(C)No. 20021 of 2010\n               - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 20th day of December, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner retired from service of the respondent<\/p>\n<p>as Assistant Editor Grade-II with effect from 31.12.2008.<\/p>\n<p>Petitioner&#8217;s grievance is that, the petitioner is not being<\/p>\n<p>paid retirement benefits like pension, gratuity, commuted<\/p>\n<p>value of pension, etc. The petitioner therefore seeks the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;i)  Issue a writ of Mandamus directing the respondents to<br \/>\n          consider and pass appropriate orders granting full<br \/>\n          pension to the petitioner, Commuted pension, Gratuity.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     ii)  Direct the 1st respondent to ratify the deputation period<br \/>\n          of the petitioner in the Cochin University forthwith.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     iii) Direct the 2nd respondent to grant increments for the<br \/>\n          period when she had availed with permission, medical<br \/>\n          leave, and refix the salary and pensionery benefits.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     iv)  Direct the respondents to grant the arrears of pensionery<br \/>\n          benefits as Item (ii) above with in a time frame.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     v)   Direct the respondents to grant 18% interest on the<br \/>\n          above amount.&#8221;<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">     I have heard the learned Government Pleader,<\/p>\n<p>standing counsel appearing for the 2nd respondent and the<\/p>\n<p>W.P.(C)No. 20021 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -2-<\/span><\/p>\n<p>standing counsel appearing for the 4th respondent.       The<\/p>\n<p>delay in disbursal of retirement benefits due to the<\/p>\n<p>petitioner is on account of the fact that, pension<\/p>\n<p>contribution payable by the 4th respondent for the period<\/p>\n<p>the petitioner worked on deputation is not being paid by the<\/p>\n<p>4th respondent. The counsel for the 2nd respondent has a<\/p>\n<p>contention that, the 4th respondent should also fix the pay<\/p>\n<p>and the pay fixation statement has to be approved by the<\/p>\n<p>3rd respondent also.     The counsel for the 4th respondent<\/p>\n<p>submits that, the amount demanded by the 2nd respondent is<\/p>\n<p>Rs.75,984\/- and the pension contribution payable by the<\/p>\n<p>4th respondent in respect to the petitioner is only<\/p>\n<p>Rs.67,560\/-. He submits that, cheque for the said amount<\/p>\n<p>would be handed over to the 2nd respondent within two<\/p>\n<p>weeks.      I am not going into the dispute regarding the<\/p>\n<p>amount. It is for the respondents 2 and 4 to settle the same<\/p>\n<p>between themselves.       The correct amount of pension<\/p>\n<p>contribution payable by the 4th respondent in respect of the<\/p>\n<p>service of the petitioner shall be paid to the 2nd respondent<\/p>\n<p>W.P.(C)No. 20021 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -3-<\/span><\/p>\n<p>by the 4th respondent within two weeks. The 3rd respondent<\/p>\n<p>shall consider the pay fixation statement in respect of the<\/p>\n<p>petitioner and pass orders and forward the same to the<\/p>\n<p>2nd respondent within one month. The petitioner shall be<\/p>\n<p>paid all retirement benefits with arrears within one month<\/p>\n<p>therefrom. The petitioner&#8217;s claim for increment shall be<\/p>\n<p>considered by the 2nd respondent and orders passed within<\/p>\n<p>the above said time limit.\n<\/p>\n<p id=\"p_3\">      The writ petition is disposed of as above.<\/p>\n<p id=\"p_4\">                                                S.
