Respondents\n\nPRAYER\n\nWrit Petition is filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India\npraying to issue a Writ of Certiorari calling for the records pertaining to the\nimpugned order in Lr.No.4342\/F.303\/DOI\/2008-1, dated 13.11.2008 on the file of\nthe second respondent and quash the same.\n\n!For Petitioner\t... Mr.T.Lajapathi Roy\n^For Respondents... Mr.Pala Ramasamy\n\t\t    Special Government Pleader\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">\tThe petitioner challenges the Order of the second respondent dated<br \/>\n13.11.2008, whereby the registration of the petitioner as Class II State Level<br \/>\nContractor was temporarily suspended until further orders.\n<\/p>\n<p id=\"p_1\">\t2. Mr.T.Lajapathi Roy, learned Counsel appearing for the petitioner,<br \/>\nsubmitted that the impugned order is very cryptic and no reason has been stated<br \/>\nin the impugned order, and therefore, the same is liable to be quashed.\n<\/p>\n<p id=\"p_2\">\t3. Mr.Pala Ramasamy, learned Special Government Pleader appearing for the<br \/>\nrespondents, produced a Circular dated 09.04.1992, issued by the Tamil Nadu<br \/>\nWater Supply and Drainage Board Secretarial, Madras 5, and submitted that before<br \/>\nissuing show cause notice, the authorities have got right to suspend the<br \/>\nregistration of a Contractor, when they are satisfied with the malpractices<br \/>\ncommitted by the Contractor. Therefore, initially, the second respondent has<br \/>\nissued the suspension order followed by a show cause notice dated 19.11.2008,<br \/>\nwherein, reasons have been stated, and therefore, there is nothing illegal in<br \/>\nthe impugned order passed by the second respondent.\n<\/p>\n<p id=\"p_3\">\t4. A perusal of the above Circular would reveal that even for suspending a<br \/>\nContractor, there must be a prima facie satisfaction by the authority. As per<br \/>\nClause 4.1 of the above Circular, suspension of business can be ordered by<br \/>\nfollowing the procedure as stated below:-\n<\/p>\n<p id=\"p_4\">\t&#8220;Suspension of business may be ordered for an indefinite period where,<br \/>\npending full enquiry into the allegations, the competent authority is of the<br \/>\nview that it is not desirable that business with the Contractor should continue.<br \/>\nSuch an order may be passed if the competent authority is prima facie of the<br \/>\nview that the Contractor is guilty of an offence involving moral turpitude in<br \/>\nrelation to business dealings which if established would result in banning<br \/>\nbusiness dealings with the Contractor&#8221;.\n<\/p>\n<p id=\"p_5\">\t5. Therefore, it is seen from the above clause that even for suspending a<br \/>\nContractor, the competent authority must come to a conclusion that it is not<br \/>\ndesirable that business with the Contractor should continue. Such an order may<br \/>\nbe passed if the competent authority is prima facie of the view that the<br \/>\nContractor is guilty of an offence involving moral turpitude in relation to<br \/>\nbusiness dealings which if established would result in banning business dealings<br \/>\nwith the Contractor. Therefore, the right of the second respondent to suspend<br \/>\nthe business is not questioned. But, at the same time, while suspending a<br \/>\nContractor, the competent authority must have decided that it is not desirable<br \/>\nthat business with the Contractor should continue and he must be of the prima<br \/>\nfacie view, as stated above. In this case, the impugned order does not disclose<br \/>\nany such thing.\n<\/p>\n<p id=\"p_6\">\t6. For the forgoing reasons, the impugned order dated 13.11.2008 passed by<br \/>\nthe second respondent is quashed and this Writ Petition is allowed. However, it<br \/>\nis open to the second respondent to pass orders in accordance with law, if it is<br \/>\nso advised. No costs.
