     Assailing the judgment of the learned single Judge<\/p>\n
dated 28.9.2005 in WP(C).No.984\/2005, the unsuccessful<\/p>\n
petitioners had come up in appeal. The petitioners, who<\/p>\n
were holding TCH certificate issued by the Government of<\/p>\n
Karnataka were appointed as Lower Primary School<\/p>\n
Assistants in AMUP School, Kanmanam, Thanur in<\/p>\n
Malappuram district.    The 4th respondent, the Assistant<\/p>\n
Educational Officer, Thanur declined to approve the<\/p>\n
appointment for the reason that the certificates held by the<\/p>\n
appellants were not approved by the State Government.<\/p>\n
Though, the Manager went in appeal, he was not<\/p>\n
successful. Therefore, the appellants, who were working<\/p>\n
from 28.3.1994 were terminated with effect from the<\/p>\n
WA.No.944 of 2006.\n<\/p>\n

afternoon of 31.10.1995.      Later, the State Government<\/p>\n
approved the TCH holders for appointment in State service<\/p>\n
and by GO.(MS)No.18\/97\/G.Edn. dated 17.1.1997 and GO<\/p>\n
(MS)No.348\/97\/G.Edn.     dated     2.9.1997 issued  orders<\/p>\n
directing to approve the service of the thrown out TCH<\/p>\n
holders.     The appellants moved the Government and<\/p>\n
obtained order of approval of their appointment with effect<\/p>\n
from 1995-’96.     Though, the Manager assailed the said<\/p>\n
order he was unsuccessful.         The appointments of the<\/p>\n
appellants were directed to be considered. In the light of<\/p>\n
the above Government Orders, the Deputy Director of<\/p>\n
Education     directed the    Manager    to re-appoint the<\/p>\n
appellants.    Later, the first appellant was appointed in<\/p>\n
KPNMUPS, Thanur and the second appellant was appointed<\/p>\n
at AMLPS, Kormanthala and they joined duty with effect<\/p>\n
from 12.8.1999.\n<\/p>\n
     2.   Holders of Teachers Training Certificate (TTC)<\/p>\n
who were appointed in the vacancy created by the<\/p>\n
WA.No.944 of 2006.\n<\/p>\n

termination of the appellants, though moved this Court<\/p>\n
were unsuccessful. There were a series of litigations. By<\/p>\n
Ext.P1 judgment dated 28.1.2004 in OP.No.6959\/2003 filed<\/p>\n
by the appellants and another, another Division Bench of<\/p>\n
this Court clarified that:\n<\/p>\n
          “in view of the revisional order passed by the
\n          Government setting aside the termination,
\n          the entire period from the date of re-
\n          appointment in 1994 should be counted for
\n          their pensionary benefits.”\n<\/p><\/blockquote>\n
Quoting    Ext.P1    judgment,   the   appellants  preferred<\/p>\n
representation to grant them monetary benefits from the<\/p>\n
date of their initial appointment though Ext.P1 doesn’t<\/p>\n
contain any order to that effect. Their request was turned<\/p>\n
down by the authorities. Being aggrieved, they moved this<\/p>\n
Court with the writ petition seeking a writ of mandamus<\/p>\n
commanding the respondents to immediately disburse all<\/p>\n
benefits to the appellants from the date of their initial<\/p>\n
appointment as teachers with interest at the rate of 18%<\/p>\n
per annum.      The learned single Judge disposed the writ<\/p>\n
WA.No.944 of 2006.\n<\/p>\n
\n                            -: 4 :-<\/span><\/p>\n
petition directing the respondents to pay the salary for the<\/p>\n
period from 28.3.1994 till 31.10.1995 for which period they<\/p>\n
had actually worked.       Being aggrieved by the order<\/p>\n
declining salary for the period they were kept out of service,<\/p>\n
this writ appeal was filed with a delay of 98 days.<\/p>\n
     2.   Notice was ordered on petition to condone the<\/p>\n
delay. Notice to respondents 1 and 3 were acknowledged.<\/p>\n
Notice to respondents 2 and 4 were returned. Appellants<\/p>\n
were directed to remit fresh process. But, the appellant did<\/p>\n
not care to remit the process fee though nearly four years<\/p>\n
elapsed. Respondents 2 and 4, being the Deputy Director of<\/p>\n
Education, Malappuram and the Assistant Educational<\/p>\n
Officer, Thanur, the Government Pleader was asked to take<\/p>\n
notice.   He took notice.      Accordingly, the petition to<\/p>\n
condone the delay and the appeal were heard.<\/p>\n
     3.   Ext.P1 judgment, being one delivered in a writ<\/p>\n
petition filed by the appellants and another, would be<\/p>\n
binding on the appellants. The relevant portion of Ext.P1<\/p>\n
WA.No.944 of 2006.\n<\/p>\n
\n                            -: 5 :-<\/span><\/p>\n
which we quoted above would show that, in the earlier<\/p>\n
round of litigation, this Court, after declining their claim for<\/p>\n
salary from the initial date of appointment, ordered that for<\/p>\n
the pensionary benefit, such period would be counted. In<\/p>\n
view of Ext.P1, the appellants are, in fact, estoped from<\/p>\n
moving another petition seeking a writ for the same relief.<\/p>\n
However, the learned single Judge had directed the<\/p>\n
respondents to disburse the salary for the period during<\/p>\n
which they had actually worked. The learned single Judge<\/p>\n
while declining the reliefs sought had found that Ext.P1<\/p>\n
judgment would be binding upon the appellants. It could<\/p>\n
not be ignored that the services of the appellants were<\/p>\n
terminated by the Manager obviously for the reason that at<\/p>\n
the time of appointment the certificates held by them were<\/p>\n
not approved by the State Government.            In the above<\/p>\n
circumstance, it cannot be said that the services of the<\/p>\n
appellants were terminated by the Manager with malafides.<\/p>\n
The claim for salary during the period during which they<\/p>\n
WA.No.944 of 2006.\n<\/p>\n
\n                          -: 6 :-<\/span><\/p>\n
had not actually worked was rightly rejected by the learned<\/p>\n
single Judge. There is total lack of banafides in claiming<\/p>\n
salary for the period during which the appellants had not<\/p>\n
rendered any service. We find no reason to entertain this<\/p>\n
appeal after condoning the delay. Accordingly, the petition<\/p>\n
to condone the delay and the appeal are dismissed as<\/p>\n
devoid of merit.\n<\/p>\n
