However, he is named in the charge<br \/>\nsheet. He has submitted that other co-accused viz. Dashrathbhai @<br \/>\nDacho Ramjibhai Vasfodiya, Nilesh @ Pinto Rameshbhai Patel and Ashish<br \/>\n@ Lepto Pravinbhai Chavda have been released on bail by order dated<br \/>\n08.03.2011, 04.04.2011 and 25.04.2011 respectively. He has also<br \/>\nsubmitted that in view of so-called role allegedly played by the<br \/>\napplicant and particularly in view of fact that other co-accused have<br \/>\nbeen released on bail, present application may be allowed and the<br \/>\napplicant may be granted bail.\n<\/p>\n<p id=\"p_3\">4.\tThe<br \/>\napplication is opposed by Mr.Dabhi, learned APP, who has submitted<br \/>\nthat the applicant committed the alleged offence which is serious in<br \/>\nnature and that therefore the application deserves to be rejected.\n<\/p>\n<p id=\"p_4\">5.\tHaving<br \/>\nheard the learned counsel for both the sides and considering the<br \/>\nfacts and circumstances of the case as well as the material produced<br \/>\non record of this case, the gravity of the offence, the quantum of<br \/>\npunishment, the allegations against the applicant, the manner in<br \/>\nwhich the applicant is allegedly involved in the case as per the<br \/>\nallegation of the prosecution, coupled with the fact that charge<br \/>\nsheet is filed and other co-accused have been released on bail, I am<br \/>\nof the view that the applicant deserve to be released on regular<br \/>\nbail, I am inclined to allow this application and release the<br \/>\napplicant.\n<\/p>\n<p id=\"p_5\">6.<br \/>\n\tHence,<br \/>\nthis application is allowed. It is directed that the present<br \/>\napplicant  in connection with offence bearing<br \/>\nCR<br \/>\nNo.I-227 of 2010  registered<br \/>\nwith Vidhyanagar<br \/>\nPolice Station,<br \/>\nbe released on bail, in respect of the offences alleged against him<br \/>\nin this application, on his executing and furnishing a bond of<br \/>\nRs.15,000\/- (Rupees: Fifteen Thousand Only) with two solvent sureties<br \/>\nof like amount, by the concerned Police Officer, and on condition<br \/>\nthat he shall:-\n<\/p>\n<p id=\"p_6\">\t(a)<br \/>\nnot take undue advantage of or abuse the liberty.\n<\/p>\n<p id=\"p_7\">(b)<br \/>\nnot act in manner injurious to the interest of the prosecution.\n<\/p>\n<p id=\"p_8\">(c)<br \/>\nmaintain law and order.\n<\/p>\n<p id=\"p_9\">(d)<br \/>\nnot leave the State of Gujarat without prior permission of the<br \/>\nSessions Court concerned.\n<\/p>\n<p id=\"p_10\">(e)<br \/>\nfurnish the address of his residence at the time of execution of bond<br \/>\nand shall not change the residence without prior permission of the<br \/>\nSessions Court\/this Court.\n<\/p>\n<p id=\"p_11\">(f)<br \/>\nsurrender his passport, if any, to the lower court within 4 days from<br \/>\nthe date of this order.\n<\/p>\n<p id=\"p_12\">(g)<br \/>\nmark his presence at Vidhyanagar Police<br \/>\nStation,<br \/>\ninitially<br \/>\non 23rd<br \/>\nJune, 2011 and<br \/>\nthereafter on every first and fifteenth day of every month,<br \/>\nbetween<br \/>\n11.00 a.m. to<br \/>\n3.00 p.m. till the trial is over;\n<\/p>\n<p id=\"p_13\">(h)<br \/>\nnot enter the revenue limit of Anand district till the trial is over<br \/>\nand for 6 months shall not enter revenue limits of Anand District<br \/>\nwithout prior permission of the Sessions Court, but for marking his<br \/>\npresence and attending the Court in connection with this case the<br \/>\napplicant will be free to enter the limits for a period to the extent<br \/>\nnecessary and will leave the limits of Anand District immediately<br \/>\nafter the case is adjourned.\n<\/p>\n<p id=\"p_14\">7.\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nany other offence for the time being.\n<\/p>\n<p id=\"p_15\">8.\tIf<br \/>\nbreach of any of the above conditions is committed the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take any appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_16\">9.\tBail-bond<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_17\">10.\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations, which are purely prima facie, tentative and preliminary<br \/>\nnature and have been made only for the purpose of examining prayer<br \/>\nfor bail pending the trial. The Court shall arrive at its own<br \/>\nconclusion independently on the basis of the evidence and other<br \/>\naspects of the case.\n<\/p>\n<p id=\"p_18\">11.\tRule<br \/>\nis made absolute to the aforesaid extent.
