The relevant part of<br \/>\n\tsuch directions as appearing in paragraph No.15 of the order dated<br \/>\n\t13th August, 2010, read as under:\n<\/p>\n<p id=\"p_1\">&#8220;Accordingly,<br \/>\nthe Registry is directed to issue notice to Shri Natvarlal Mafatlal<br \/>\nPatel, Deputy Commissioner of Commercial Tax (Enforcement),<br \/>\nDivision-6, Bhavnagar to show cause on or before 13th<br \/>\nSeptember, 2010 as to why he should not be punished for having<br \/>\ncommitted contempt of Court  and to place the matter before the<br \/>\n Bench taking up contempt matters for further proceedings.\n<\/p>\n<p id=\"p_2\">When<br \/>\n\tone reads the last part of the direction which has been underlined<br \/>\n\tin the aforesaid extract to supply emphasis, the Court is<br \/>\n\tconstrained to note that Registry of the High Court has exceeded its<br \/>\n\tpowers in placing the matter before the Hon&#8217;ble the Chief Justice on<br \/>\n\tadministrative side disregarding the specific direction made on<br \/>\n\tjudicial side.  Hence, despite the fact that on administrative side,<br \/>\n\tthe Hon&#8217;ble the Chief Justice has specially assigned the matter to<br \/>\n\tthis Bench, the Registry is once again directed to comply with the<br \/>\n\tdirection made by this Court in order dated 13th August,<br \/>\n\t2010 and place the matter before the Bench taking up contempt<br \/>\n\tmatters for further proceedings.\n<\/p>\n<p id=\"p_3\">It<br \/>\n\tmust be borne in mind that the essence of such a direction is to<br \/>\n\tensure that the alleged defaulter\/contemner is not left with a<br \/>\n\tfeeling that a Bench which was prima facie of an opinion, has not<br \/>\n\tgiven a fair and just treatment in dealing with a subject matter,<br \/>\n\twhich arose out of the proceedings relatable to the regular roster.\n<\/p>\n<p id=\"p_4\">The<br \/>\n\tRegistry is, therefore, directed to ensure that the matter is placed<br \/>\n\tbefore the Regular Bench taking up contempt matters in accordance<br \/>\n\twith roster.\n<\/p>\n<p id=\"p_5\">[D.A.MEHTA,<br \/>\nJ.]<\/p>\n<p>[HARSHA<br \/>\nDEVANI, J.]<\/p>\n<p>parmar*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Suo vs Unknown on 27 September, 2010 Author: D.A.Mehta,&amp;Nbsp;Honourable Ms.Justice H.N.Devani,&amp;Nbsp;
