PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel for both sides.<br \/>\n     This appeal  by special  leave arises from the order of<br \/>\nthe Kerala  High Court\tdated April 10, 1996 made in CMA No.<br \/>\n68\/96. This  Court while issuing the notice on July 30, 1996<br \/>\nstated as under:\n<\/p>\n<blockquote><p>     &#8220;Mr.Subba Rao,  learned counsel for<br \/>\n     the petitioner  says that he has no<br \/>\n     objection\tas   regards  injunction<br \/>\n     restraining   the\tpetitioner  from<br \/>\n     alienating the  land of erecting or<br \/>\n     inducting\t third\t  parties   into<br \/>\n     possession. He says that his client<br \/>\n     has been  growing cardamom.  Unless<br \/>\n     some  of\tthe  trees  are\t cut  or<br \/>\n     removed it would not be possible to<br \/>\n     carry on  the cardamom  plantation.<br \/>\n     Only to  that extent subject to any<br \/>\n     further condition\tmay be\timposed,<br \/>\n     the injunction  may be  vacated  or<br \/>\n     suitably  modified,   We\tdo   not<br \/>\n     propose to go into at this stage on<br \/>\n     this limited issue.&#8221;<\/p><\/blockquote>\n<p>     Pursuant thereto,\ta counter-affidavit has been file by<br \/>\nthe respondent\tstating\t that  the  appellant  has  obtained<br \/>\nplantations of\tthe cardamom. He disbanded the entire labour<br \/>\nforce.\tOnly   tow  persons   are  kept\t in  charge  of\t the<br \/>\nplantations and,  therefore, there  is to  need to  cut\t and<br \/>\nremove any  trees. Shri\t Subba Rao,  learned counsel for the<br \/>\nappellant has stated that the appellant has been carrying on<br \/>\nthe planting  of  cardamom.  The  trees\t that  obstruct\t the<br \/>\ncardamom cultivation  are required to be cut: similarly, the<br \/>\ntrees suffer  afflicted wi  diseases have to be cut so as to<br \/>\nkeep infection\tfree atmosphere,  Under those circumstances,<br \/>\nit is  necessary that  he may be permitted to cut the trees.<br \/>\nShri Vishwanantha  Iyer,  learned  senior  counsel  for\t the<br \/>\nrespondent, States  that since\tthe cardamom plantations are<br \/>\nrequired to be done only in the monsoon season, i.e., June ,<br \/>\nJuly or March and April and the first season is yet to start<br \/>\nand since  there are,  at present, no crops there is no need<br \/>\nto cut\tthe trees.  In view  of the allegations and counter-<br \/>\nallegations, we\t cannot set  the matter\t at rest here. Under<br \/>\nthese circumstances,  the trial Court is directed to appoint<br \/>\nan advocate Commissioner to make a personal inspection after<br \/>\nnotice to  the parties\tand to\tsubmit a  report whether the<br \/>\ncardamom plantations  have been\t raised by the appellant and<br \/>\nif so  in what\textent of the land the plantations have been<br \/>\nraised. On  the receipt\t of the report from the Commissioner<br \/>\nwith a\tfinding that  cardamom plantations have been raised,<br \/>\nnecessary directions  should be issued to cut such number of<br \/>\ntrees  which   require\tfor   uninterrupted  cultivation  of<br \/>\ncardamom plantations  and also\tsuch of the plants which are<br \/>\naffected by  pests so  as to  keep the plantations free from<br \/>\ninfection. The\tpetitioner is required to obtain crop loans.<br \/>\nHe could also obtain crop loan from the banks etc. The trial<br \/>\nCourt is directed to dispose of the suit by December 1996.\n<\/p>\n<p>     The appeal is accordingly disposed of. the appellant is<br \/>\ndirected to approach the civil Court with and application to<br \/>\nappoint a  Commissioner forthwith.  The directions  given by<br \/>\nthe High  Court for  disposal for  the suit stand upheld. No<br \/>\ncosts.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India S.
