AFPELLABFFS\n\n[By Sri Aravind Kumar, ASG]\n\n   'WINSTON TAN\n\nSf O.WINS'I'ON TAN\nR[A'I'.FLA'I' NOD04\nKAMALA MANSION\nGROUND FLOOR\n\nROMENADE PLACE\n\n \n\n\n\n Ne'\n\n\ufb01led by the respondents 1 and 2 herein, \n\nthe order dated 23-6~2005, Whereunder the   \n\nto have been acquired by the re_spc;'ndents_1 :-got \n\nforfeited in View of Section 6'.,theV' fioreilcgiii\u00bb\nExchange Manipulators.    Act, 1976\n[for short, the Act],   Judge quashed\nthe same  .::&amp;'remende(i:::,   to the second\nrespondent   further direction to\nthe   and 2 -- Writ petitioners\nand to vihoid  proceeding further in the\n\nmatter, in  the principles of natural justice.\n\n  Rdo\ufb01oiid\ufb01ilts 3 and 4- are the original owners of the\n\n  from whom the respondents 1 and 2 --\n\n-V  have purchased it, after the initiation of the\n V' \"faction tinder Section 6 of the Act, but however, the\n respondents 3 and 4, despite service of notice  them,\n\n V  u heiroided the proceedings, both before the learned Single\n\nJudge as well as before this court, in spite of newspaper\n\npublication of the notice in The Times of India, dated 2&amp;2-\n\n \n\n\n\n2009, notifying that the matter will be takenfup' \n\nhearing today.\n\n3. The undisputed facts  __  \nare treated as 'the persons',    \u00e9ection\n2(1) of the Act, on  t_'t'1eV_'of  Act are\nattracted. A detention   came to be\npassed against\"   the provisions\nof the   and Prevention of\nAtct,~:'_'vv_:9'7uftVVFIOFEPOSA], pm-suam to\n\nwhich preeeedhigdtte. the property acquired by the\n\nV respondents   4, as provided under Section 6 of the Act,\n\n   'on 8- 1i2H;t2003. An explanation was called from\n\n and 4 by the said notice issued under\n\n . Section V-6(i}:\"'of the Act. Thereafter on 21-442004, the\n\nit 0' ' \ufb02--respo_ndVents 3 and 4 were served with a second notice to\n\n-0   their explanation on or before 4-5-2004. On receipt\n\n\" efithe second notice dated 2144-12004, respondents 3 and-4\n\nsubmitted their explzmation on 26\u00ab5\u00ab~2004, wherein the\n\nrespondents 3 and 4 also sought for personal hearing, on\n\n    \n\n\n\nwhich date the proceeding was adjourned  at\n\nthe request of respondents 3 and 4 and \n\nto 25-27-2004 and \ufb01nally it was  4pg1o-2foo4o p giyin~g  \n\nfair opportunity to the respondents_T3- and \navoided personal hearing. 2  was \nadjourned to 16-3-20!.\u00a3:)p_$j. toVv't3(V)\ufb02-3~20O5, on\nwhich date too, the  absent.\nAs a result,  3 and 4\non 3-5~200:'.$..,.  directorate, as they\ncontinued   -and' an order of forfeiture was\n\npassed   Section 7(1) of the Act, which\n\nV was    petition.\n\n  V' In inxeanwh\ufb02e, on 10-2~2005, respondents 3 and 4\n\nsotd   in question in favour of the respondents I\n\nand 2 ~44 xtriit petitioners.
