Petitionenaccused filed<br \/>\n91 of Cr.P.C. r\/W Section 68 of Indian<br \/>\napplication under Section 3&#8217;ilV1&#8217;v&#8221;-ppf<br \/>\ndirection to the eomplainant__;&#8217;_l:to:&#8217;\\furnish  Hrlocurnents<br \/>\nmentioned in the schecluie..l:l&#8221; _  it<\/p>\n<p>3. Complainant  for an offence<\/p>\n<p>punishable   alleging that. the<\/p>\n<p>Cheque   the petitioner has been dishonoured.<\/p>\n<p>4. Petpitiioner  complainant to produce the<\/p>\n<p>mone;-;r\u00a7l&#8217;encling l1e_ense as his capacity to lend the loan and to<\/p>\n<p> V  thefofllence punishable under Section 138 of N.I.Act. He<\/p>\n<p>also-l&#8217;__sough&#8217;tVp_loif&#8217;recalling PW-1 for further erosswexamination. &#8216;<\/p>\n<p> _ Trial!cou&#8217;1&#8217;t-ieonsidering the material, found that. for the<\/p>\n<p> &#8216;  pl&#8221;p1_A;;fpose&#8221;oi; proving the offence under Section 138 of N.I.Act. the<\/p>\n<p> opllcolrnplainant is required to prove the ingredients of the said<\/p>\n<p>  provisions and there is no need to summon the document such<\/p>\n<p>it as money lending license. Further, it also found that PW-I was<\/p>\n<p>\u00e9\ufb02a<\/p>\n<p>crossexaminecl by the accused and there is no reason arisen<\/p>\n<p>as to why again he should be cross&#8211;examined.<\/p>\n<p>5. The documents sought to be summoned are absolutely<\/p>\n<p>irrelevam for the purpose of proving the offence un(ier<\/p>\n<p>138 of the N.I.Act. If any thing is there, it is for <\/p>\n<p>prove in his defence.
