SANKARAN, J.\n\n         ------------------------------------\n\n                 W.P.(C).NO. 12478 OF  2007\n\n         ------------------------------------\n\n             Dated this the 24th day of May, 2007\n\n\n\n                          JUDGMENT\n<\/pre>\n<p>H.L.DATTU, C.J.\n<\/p>\n<p>    The reliefs sought for in this Writ Petition are:\n<\/p>\n<p>    i) To declare that the first respondent commission<\/p>\n<p>    has   no   powers   to   exercise   any   of   the   powers   of   a<\/p>\n<p>    constitutional   court   particularly   under   Article<\/p>\n<p>    226   of   the   Constitution   of   India   and   its   actions<\/p>\n<p>    in   constituting   a   team   of   police   officers   to<\/p>\n<p>    conduct  investigations,   enquiries  etc.   are  totally<\/p>\n<p>    void,   unconstitutional   and   made   in   violation   of<\/p>\n<p>    the provisions of the Code of Criminal Procedure.\n<\/p>\n<p>    ii)   To   call   for   the   records   leading   upto   Ext.P3<\/p>\n<p>    and   quash   the   same   by   the   issuance   of   a   Writ   of<\/p>\n<p>    Certiorari or any other appropriate writ, order or<\/p>\n<p>    direction.\n<\/p>\n<p>    2.        At   the   time   of   entertaining   this   Writ<\/p>\n<p>Petition,   this   Court   had   directed   the   learned<\/p>\n<p>Government Advocate to seek necessary instructions from<\/p>\n<p>the respondents.\n<\/p>\n<p>    3.        The   matter   is   posted   again   today   for<\/p>\n<p>admission.\n<\/p>\n<p>W.P.(C)NO.12478 OF 2007<\/p>\n<p>                                 :: 2 ::\n<\/p>\n<p>        4.     Learned   Government   Advocate   on   instructions<\/p>\n<p>would   submit   that   pursuant   to   the   notice   issued<\/p>\n<p>(Ext.P3),   the   petitioner   had   appeared   before   the<\/p>\n<p>respondents and his statement is recorded.\n<\/p>\n<p>        5.     In   view   of   this   development,   in   our   opinion,<\/p>\n<p>for   the   present   we   need   have   to   consider   the   first<\/p>\n<p>relief of the petitioner.\n<\/p>\n<p>        Accordingly,   we   dispose   of   this   Writ   Petition.\n<\/p>\n<p>Liberty   is  reserved  to  the  petitioner  to  approach  this<\/p>\n<p>Court, if need arise in future.  All the contentions of<\/p>\n<p>both the parties are left open.
