SHAH\n\t\t\n\t\n\n \n\nDate\n: 17\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent application has been preferred by the applicants claiming to<br \/>\nbe heirs and legal representatives of original petitioner No.1<br \/>\npermitting them to be brought on record as petitioner No.1\/1 and 1\/2<br \/>\nas well as permitting them to bring heirs and legal representatives<br \/>\nof original respondent No.3\/2 on record.\n<\/p>\n<p>2.\t\tIt<br \/>\nis to be noted that so far as prayer of the applicants to be brought<br \/>\nthem on record as petitioner Nos.1\/1 and 1\/2  as heirs and legal<br \/>\nrepresentatives of petitioner No.1  is concerned, the same is barred<br \/>\nby limitation. There is no prayer to condone the delay and set aside<br \/>\nthe abatement in the present application.\n<\/p>\n<p>3.\t\tAt<br \/>\nthis stage, Mr.Pandya, learned advocate appearing on behalf of the<br \/>\napplicants seeks permission to withdraw the present application with<br \/>\na liberty to file fresh application with appropriate prayer to<br \/>\ncondone the delay and to set aside the order of abatement so far as<br \/>\noriginal petitioner No.1 is concerned and with a liberty to file<br \/>\nfresh application for bringing heirs and legal representatives of<br \/>\nrespondent No.3\/2 on record, after obtaining death certificate of<br \/>\noriginal respondent No.3\/2 and getting pedhinama.\n<\/p>\n<p>4.\t\tPermission<br \/>\nis accordingly granted.
