In view of this, requirement for pre-deposit of penalty is waived and its recovery is stayed till the disposal of the appeal.<\/p>\n<p>3. Learned Counsel for the appellant points out that during the pendency of the stay application Revenue authorities had detained the goods. The detention was entirely unwarranted. The Revenue authorities are directed to release the goods to the appellant.
