Hatim, A.P.P.\n                                      -----\n<\/pre>\n<p>\/15.12.2009              Petitioners have invoked the inherent power of this Court<br \/>\n                under Section 482 of the Code of Criminal Procedure for<br \/>\n                quashment of their entire criminal proceeding including the order<br \/>\n                impugned dated 6.11.2006 passed by the learned Chief Judicial<br \/>\n                Magistrate, Sahibganj by which cognizance of the offence was<br \/>\n                taken under Section 7 of the Essential Commodities Act, 1955 as<br \/>\n                also under Sections 3\/4 of the Explosive Substance Act against<br \/>\n                them in Sahibganj (T) P.S. Case No.178 of 2005, corresponding to<br \/>\n                G.R. No.401 of 2005.\n<\/p>\n<p>                         Prosecution was launched on the basis of the written report<br \/>\n                presented by the informant Block Supply Officer, Sahibganj before<br \/>\n                the officer-in-charge of Sahibganj Police Station stating, inter alia,<br \/>\n                that he had received information on 18.11.2005 that the local<br \/>\n                L.P.G. distributor, namely, Shri Bishnu Deo Singh had been selling<br \/>\n                L.P.G. refills in black market with the help of his employees. A team<br \/>\n                was organized for conducting raid comprising Executive Magistrate,<br \/>\n                District Supply Officer and many other officers including the police<br \/>\n                force and the team conducted raid in the house of one Beni Prasad<br \/>\n                Tanti. It was alleged that Beni Prasad Tanti though escaped, but in<br \/>\n                course of search, three filled L.P.G. cylinders of Indane Gas were<br \/>\n                recovered to which no explanation could be given. However, wife of<br \/>\n                the said Beni Prasad Tanti narrated that these cylinders were kept<br \/>\n                in her house by her neighbour Sambhu Prasad Gupta , who was<br \/>\n                an employee of the local gas distributor, namely, Shri Bishnu Deo<br \/>\n                Singh. From that place, the raiding party went to the residential<br \/>\n                office of the local distributor-petitioner No.1 Shri Bishnu Deo Singh<br \/>\n                but it was alleged that he escaped after locking his office and the<br \/>\n                members of his family did not co-operate in such inquiry by<br \/>\n                producing the coupons of the gas cylinders. His office was sealed<br \/>\n                in presence of the senior officers and finally, it was alleged that the<br \/>\n<span class=\"hidden_text\">                                                                      2<\/span><\/p>\n<p>petitioner No.1 Shri Bishnu Deo Singh          with the help of his<br \/>\nemployees, had kept three filled gas cylinders in the house of the<br \/>\npetitioner no.3 Beni Prasad Tanti so that the cylinders could be<br \/>\nsold in the black market. It was requested to take action against all<br \/>\nthe three petitioners under Section 7 of the Essential Commodities<br \/>\nAct as also under relevant Sections of the Explosive Substance<br \/>\nAct.\n<\/p>\n<p>       Learned Sr. Counsel Mr. Rajeeva Sharma, at the outset,<br \/>\nsubmits that in the facts and circumstances of the case, criminal<br \/>\nprosecution of the petitioners for the alleged offence either under<br \/>\nSection 7 of the Essential Commodities Act or under Sections 3\/4<br \/>\nof the Explosive Substance Act is not maintainable and therefore,<br \/>\nentire prosecution is liable to be quashed. Learned Sr. Counsel<br \/>\nfurther submits that the Chief Judicial Magistrate has taken<br \/>\ncognizance of the offence under such sections without specifying<br \/>\nas to which provision of the control order or unification order has<br \/>\nbeen violated by the petitioners as framed under Section 3 of the<br \/>\nEssential Commodities Act so as to call for their punishment under<br \/>\nSection 7 of the Essential Commodities Act.\n<\/p>\n<p>       Admittedly,   petitioner   No.1   had   obtained   licence   for<br \/>\ndistribution of L.P.G. cylinders of      Indane company and also<br \/>\nobtained licence from the Deputy Chief Controller of Explosive,<br \/>\nExplosive Department, Government of India, which was renewed<br \/>\nupto 31.3.2006 as would be evident from Annexeure-2 of this<br \/>\npetition. Such licence used to be issued to the licensee, distributing<br \/>\nL.P.G. cylinders under the Explosive Act but not under the<br \/>\nExplosive Substance Act and therefore, the prosecution of the<br \/>\npetitioners under Explosive Substance Act would amount to<br \/>\nmiscarriage of justice when there is no allegation at all that they<br \/>\nhad contravened any provision of Explosive Substance Act much<br \/>\nless causing explosion by using explosive substance. Entire<br \/>\nallegations are misconstrued and the evidence could not refer that<br \/>\nthe petitioners had ever hands in selling the Indane L.P.G. cylinders<br \/>\nin black market.\n<\/p>\n<p>       I find substance in the argument advanced on behalf of the<br \/>\npetitioners that the prosecution failed to show and specify the<br \/>\nprovisions of control order or the unification order allegedly<br \/>\ncontravened by the petitioners so as to call for their punishment<br \/>\nunder Section 7 of the Essential Commodities Act. It is settled law<br \/>\nthat the accused would be highly prejudiced if the penal provision of<br \/>\nlaw for the offence alleged to have been committed by him could<br \/>\nnot be disclosed at the time of taking cognizance. I find from the<br \/>\n<span class=\"hidden_text\">                                                                            3<\/span><\/p>\n<p>       record that neither the informant nor the learned Chief Judicial<br \/>\n       Magistrate has disclosed and specified such provision of law as<br \/>\n       framed under Section 3 of the Essential Commodities Act, allegedly<br \/>\n       contravened by the petitioners so as to call for punishment under<br \/>\n       Section 7 of the Essential Commodities Act. Similarly, from the<br \/>\n       facts and circumstances, I find that the petitioners have not violated<br \/>\n       any provision of the Explosive Substance Act much less offence<br \/>\n       alleged under Sections 3\/4 of the said Act and therefore, the<br \/>\n       cognizance of the offence taken in those sections referred to<br \/>\n       hereinbefore is not relevant against any of the petitioners.<br \/>\n       Consequently, I observe that their criminal prosecution would be a<br \/>\n       clear manifestation of miscarriage of justice.\n<\/p>\n<p>              I find merit in this petition. Accordingly, cognizance order<br \/>\n       impugned dated 6.11.2006, recorded in Sahibganj (T) P.S. Case<br \/>\n       No.178 of 2005, corresponding to G.R. No.401 of 2005 against the<br \/>\n       petitioners for the alleged offence under Section 7 of the Essential<br \/>\n       Commodities Act, 1955 as also under Sections 3\/4 of the Explosive<br \/>\n       Substance Act is quashed and this petition is allowed.\n<\/p>\n<p>                                                 (D.K.
