Justice K.T.SANKARAN\n\n Dated :02\/01\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                 -----------------------------------------------\n                      W.P.(C).No.172 of 2009\n                 -----------------------------------------------\n                 Dated this the 2nd January, 2009\n\n\n\n                              JUDGMENT\n<\/pre>\n<p>      The petitioner is working as Associate Professor in<\/p>\n<p>Anesthesiology, Government Medical College, Thrissur.                   It is<\/p>\n<p>stated that her home station is Thiruvananthapuram. The<\/p>\n<p>petitioner states that she joined service on 20.11.1990 as<\/p>\n<p>Lecturer   in Anesthesiology in Government Medical College,<\/p>\n<p>Thiruvananthapuram where she continued till March 2000. She<\/p>\n<p>was promoted as Assistant Professor in Anesthesiology and<\/p>\n<p>posted in the Government Medical College, Kozhikode where she<\/p>\n<p>continued till December 2000. Thereafter, she was transferred<\/p>\n<p>to Government Medical College, Alappuzha. In 2003, petitioner<\/p>\n<p>was   again    transferred       to    Government            Medical College,<\/p>\n<p>Thiruvananthapuram. She continued at Thiruvananthapuram till<\/p>\n<p>31.10.2006. Petitioner was promoted as Associate Professor and<\/p>\n<p>posted in Government Medical College, Thrissur where she<\/p>\n<p>joined on 8.11.2006. She is continuing at Thrissur. Pointing out<\/p>\n<p>that the petitioner has maximum out station service and that she<\/p>\n<p><span class=\"hidden_text\">WPC No. 172\/2009                 2<\/span><\/p>\n<p>is entitled to get a transfer to her home station, the petitioner<\/p>\n<p>submitted     Exts.P1,  P2    and    P3   representations.  These<\/p>\n<p>representations have not been disposed of so far. The reliefs<\/p>\n<p>prayed for in the writ petition are the following:<\/p>\n<blockquote><p>     &#8220;(i) issue a writ of mandamus or any other appropriate<\/p>\n<p>           writ, order or direction commanding the respondents<\/p>\n<p>           to transfer and post petitioner in the vacancy of<\/p>\n<p>           Associate Professor in Anesthesiology, Government<\/p>\n<p>           Medical College, Thiruvananthapuram which arise<\/p>\n<p>           consequent to the promotion of Dr.Linette as<\/p>\n<p>           Professor in Anesthesiology forthwith and<\/p>\n<\/blockquote>\n<blockquote><p>     (ii)  such other order or direction deems fit and proper for<\/p>\n<p>           this Hon&#8217;ble Court in facts and circumstances of the<\/p>\n<p>           case.&#8221;<\/p><\/blockquote>\n<p>     2.    Heard the learned counsel for petitioner and the<\/p>\n<p>learned   Government     Pleader,    who    took  notice  for the<\/p>\n<p>respondents.    The only request made by the petitioner is to<\/p>\n<p>consider Exts.P1 to P3 by the first respondent and to take a final<\/p>\n<p>decision in the matter.\n<\/p>\n<p>     In the facts and circumstance of this case, the writ petition<\/p>\n<p><span class=\"hidden_text\">WPC No. 172\/2009                 3<\/span><\/p>\n<p>is disposed of directing first respondent to consider and dispose<\/p>\n<p>of Exts.P1 to P3 as expeditiously as possible and at any rate<\/p>\n<p>within a period of six weeks from the date of receipt of a copy of<\/p>\n<p>this judgment.
