The Returning Officer  rejected\nhis  nomination\t paper\ton the ground that  his\t failure  to\ndelete the words 'Scheduled Caste' meant that he belonged to\nthe  scheduled caste which was not true,  and  consequently,\nthe  nomination\t paper\twas not\t filled\t up  properly.\t The\nrespondent  was declared elected.  The High  Court,  holding\nthat  the candidate, whose nomination paper was rejected  by\nthe   Returning\t Officer.  had\tnot  properly\tfilled\t his\nnomination  paper,  upheld the rejection and  dismissed\t the\nelection petition challenging the respondent's election.\nAllowing the appeal to this Court.\nHELD  : (1) The seat for which the candidates contested\t was\nnot a reserved seat.  There is no statutory provision in the\nRepresentation\tof the People Act, 1951, or elsewhere  which\nenjoins\t a candidate who is contesting the election  for  a.\ngeneral seat, and not for a reserved seat, to specify in his\ndeclaration his caste or tribe. [571G]\n(2)The Returning Officer admitted in his evidence that\tat\nthe  time  of the scrutiny of the nomination papers  he\t was\naware\tthat  the  candidate,  whose  nomination  paper\t  he\nrejected,  was not a member of the scheduled caste and\tthat\nhe had deposited Rs. 501- as security.\tTherefore, the omis-\nsion to strike off scheduled caste\/tribe in the form did not\namount\tto  a defect in the eye of law, much less was  it  a\ndefect of a substantial character, warranting the  rejection\nof the nomination paper. Raghuveer<\/a>  singh  [1968]  3,\t S.C.R.\t 246\nfollowed.,\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CIVIL APPELLATE JURISDICTION : Civil Appeal No. 602 of 1973.<br \/>\nFrom  the Judgment&#8217;s Order dated the 6th February,  1973  of<br \/>\nthe Patna High Court in Election Petition No. 6 of 1972.<br \/>\nR.K. Garg, S C. Agarwala, S. S. Bhatnagar and V. J. Francis,<br \/>\nfor the appellant.\n<\/p>\n<p>D. Goburdhan, for the respondent.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\nSARKARIA,  J. Durga Prasad Singh, respondent herein,  Khatir<br \/>\nAli  and Abdul Hamid, filed their nomination  papers  before<br \/>\nthe  Returning ,Officer for contesting the election  to\t the<br \/>\nBihar\tLegislative  Assembly  from   147-Jamtara   Assembly<br \/>\nConstituency  (General).   The\tdate for  :scrutiny  of\t the<br \/>\nnomination  papers  was\t February  9,  1972-  The  Returning<br \/>\nOfficer\t rejected the nomination papers of Khatir,  Ali\t and<br \/>\nAbdul  Hamid  ignoring the objections that  were  raised  on<br \/>\ntheir behalf.  Durga Prasad Singh was declared duly elected.\n<\/p>\n<p><span class=\"hidden_text\">571<\/span><\/p>\n<p>The  appellant,\t an elector of the  Constituency,  filed  an<br \/>\nElection  Petition challenging the election of Durga  Prasad<br \/>\nSingh inter alia on the ground that the nomination papers of<br \/>\nAbdul Hamid and Khatir All had been improperly rejected.   A<br \/>\nlearned\t single\t Judge\tof the High  Court,  who  tried\t the<br \/>\nPetition  decided that issue against the petitioner, and  in<br \/>\nconsequence, dismissed the Petition.  Hence this appeal.<br \/>\nBefore us, Mr. R. K. Garg, learned Counsel for the Appellant<br \/>\nhas.  confined\this  arguments\tto  the\t rejection  of\t the<br \/>\nnomination paper of Abdul Hamid, only.\tIt is submitted that<br \/>\nthe  defect  on the basis of&#8217; which  the  Returning  Officer<br \/>\nrejected Abdul Hamid&#8217;s nomination papers, was not a &#8216;defect&#8217;<br \/>\nin the eye of law.  At any rate, proceeds. the argument,  it<br \/>\nwas  not  a defect of a substantial  character\twhich  could<br \/>\njustify rejection of the nomination papers.<br \/>\nThere is merit in this contention.\n<\/p>\n<p>What  happened\twas  that  in  the  column  of\tthe  printed<br \/>\nnomination  form,  meant  for making a\tdeclaration  of\t the<br \/>\ncandidates&#8217;  of the Scheduled Caste\/Tribe contesting  for  a<br \/>\nReserved.  Seat, Abdul Hamid had not (a) filled his specific<br \/>\ncaste  in the bank &#8216;Meant for that purpose and further,\t (b)<br \/>\nhe  had\t in that column, left the  words  &#8216;Scheduled  Caste&#8217;<br \/>\nunscored.   The\t Returning Officer rejected  the  nomination<br \/>\npapers\ton the ground that the failure of the  candidate  to<br \/>\ndelete the words &#8216;Scheduled Caste&#8217; means that &#8220;he belongs to<br \/>\nScheduled  Caste which is not true&#8221; said consequently,\t&#8220;the<br \/>\nnomination papers are not filled up properly&#8221;.<br \/>\nThe  learned Judge of the High Court upheld this  rejection,<br \/>\nholding that &#8220;the candidate&#8217;s filling of these entries\twere<br \/>\non  the face of it, not proper and did not comply  with\t the<br \/>\nrequirements  of law on this subject&#8221; and further that\tthis<br \/>\ndefect\twas not &#8220;trivial or technical&#8221; but of a\t substantial<br \/>\ncharacter.\n<\/p>\n<p>In  our\t opinion,  in the circumstances\t of  the  case,\t the<br \/>\nrejection  of  the  nomination papers  of  Abdul  Hamid\t was<br \/>\nmanifestly erroneous.  The High Court&#8217;s view that in scoring<br \/>\nout  only the word &#8216;Jan-Jati&#8217; (Tribe) and leaving  the\tword<br \/>\n&#8216;Jati&#8217;\t(caste)\t untouched in the aforesaid  column  of\t the<br \/>\nnomination form, Abdul Hamid had failed &#8220;to comply .With the<br \/>\nrequirement  of\t the law on the subject&#8221; was  entirely\tmis-<br \/>\nconceived.    It  overlooked  the  fact\t that  the   Jamtara<br \/>\nConstituency was a &#8216;General&#8217; Constituency, and the seat\t for<br \/>\nwhich the candidates wanted to contest the election was\t not<br \/>\na Reserved seat.  Section 33(2) of the Representation of the<br \/>\nPeople Act, 1951, or any other statutory provision does\t not<br \/>\nenjoin upon a candidate who is contesting the election for a<br \/>\nGeneral Seat, and not for a Reserved seat, to specify in his<br \/>\ndeclaration  his  caste or tribe.   Further,  the  Returning<br \/>\nOfficer\t appearing as R. W. 2, had clearly admitted that  at<br \/>\nthe  time of the scrutiny of the nomination papers,  he\t was<br \/>\naware  that  Abdul Hamid was not a member of  the  Scheduled<br \/>\nCaste and that he had deposited Rs. 250\/- as security.\t The<br \/>\nomission to strike off the column in the printed  nomination<br \/>\nform  relating to Scheduled Caste\/Tribe did not amount to  a<br \/>\ndefect\tin  the eye of law, much less was it a defect  of  a<br \/>\nsubstantial   character,   warranting\trejection   of\t the<br \/>\nnomination paper.\n<\/p>\n<p><span class=\"hidden_text\">572<\/span><\/p>\n<p><a href=\"\/doc\/1779537\/\">In Amolak Chand v. Raghuveer Singh,<\/a>(1) the nomination papers<br \/>\nof two candidates contesting for a General Constituency were<br \/>\nrejected  on a similar ground.\tHolding that  the  rejection<br \/>\nwas improper, Ramaswami J. speaking for the Court stated the<br \/>\nlaw on the point thus:\n<\/p>\n<blockquote><p>\t      &#8220;The printed form 2A is meant both for General<br \/>\n\t      and  Reserved Constituencies but while  it  is<br \/>\n\t      obligatory  for  candidates  in  the  reserved<br \/>\n\t      constituency  to\tmake a\tdeclaration  in\t the<br \/>\n\t      proper  column  that  he\tis  a  member  of  a<br \/>\n\t      particular  caste or tribe, there is  no\tsuch<br \/>\n\t      rule  with  regard  to  General  Constituency.<br \/>\n\t      Section 33(2) of the Act imposes an obligation<br \/>\n\t      on the candidate in the reserved\tconstituency<br \/>\n\t      to  make a declaration in the  proper  column,<br \/>\n\t      but there is no such direction in the  statute<br \/>\n\t      with  regard to the General Constituency.\t  In<br \/>\n\t      our  opinion, the mention of the caste of\t the<br \/>\n\t      candidate\t in the nomination form was a  clear<br \/>\n\t      superfluity  because it was not necessary\t for<br \/>\n\t      the  candidate to fill in the column  when  he<br \/>\n\t      was contesting in a General Constituency. .&#8221;\n<\/p><\/blockquote>\n<p>In the light of what has been said above, we would,  reverse<br \/>\nthe  finding of the High Court and hold that the  nomination<br \/>\npapers\tof  Abdul  Hamid were  improperly  rejected  by\t the<br \/>\nReturning Officer.\n<\/p>\n<p>In  the\t result, we would on this short ground,\t allow\tthis<br \/>\nappeal and the Election Petition and declare the election of<br \/>\nDurga  Prasad  Singh,  Respondent herein to  be\t void.\t The<br \/>\nappellant shall have his costs<br \/>\nthroughout.\n<\/p>\n<p>V. P.
