         Petitioner is the accused in Crime<\/p>\n
No.663\/2009   of       Vatakara              police      station<\/p>\n
registered for the offences under Sections<\/p>\n
324   and 308 of Indian Penal Code.                           By<\/p>\n
Annexure-A1 order, he was released on bail<\/p>\n
on conditions. One of the condition is that<\/p>\n
he shall surrender his passport and shall<\/p>\n
not  leave  the       jurisdiction                  of  Vatakara<\/p>\n
police station without previous permission<\/p>\n
of the investigating officer.                        He was also<\/p>\n
directed to report before the investigating<\/p>\n
officer on all days in between 8 and 10<\/p>\n
a.m  for   a    period            of        two      weeks  and<\/p>\n
thereafter  on all Mondays, till the final<\/p>\n
report   is       filed.              Petitioner           filed<\/p>\n

Crl.M.P.3371\/2009 before the Sessions court for<\/p>\n
modifying the condition and to permit him to go<\/p>\n
abroad contending that as he is employed, if he<\/p>\n
is not        permitted to go    abroad, it would<\/p>\n
affect his livelihood.\n<\/p>\n
            2. By   Annexure-A3  order     learned<\/p>\n
Sessions Judge allowed the       petition in part.<\/p>\n
But none of the conditions were modified and it<\/p>\n
was only found that if period of       passport is<\/p>\n
to expire, petitioner could take steps to renew<\/p>\n
the    passport.   This  petition is  filed  under<\/p>\n
Section 482 of Code of Criminal Procedure to<\/p>\n
lift condition Nos.2,3 and 5 in Annexure-A1<\/p>\n
order.\n<\/p>\n
            3. Learned counsel appearing for the<\/p>\n
petitioner and learned Public Prosecutor were<\/p>\n
heard.\n<\/p>\n
            4. Learned Public Prosecutor submitted<\/p>\n

that though investigation is not completed, it<\/p>\n
is almost over and final report could     be filed<\/p>\n
without      much  further delay.  Learned  Public<\/p>\n
Prosecutor      submitted that  though an  offence<\/p>\n
under Section 308 of Indian Penal Code is also<\/p>\n
alleged, it is based on the allegation that if<\/p>\n
the injured had not evaded, when the petitioner<\/p>\n
hit him with a stone, it would have caused     his<\/p>\n
death and the injury is not grievous. In the<\/p>\n
nature and circumstances of the case, it is not<\/p>\n
in    the    interest  of justice  to prevent  the<\/p>\n
petitioner from going abroad and thereby cause<\/p>\n
loss of his employment in Gulf.      On sufficient<\/p>\n
undertaking, petitioner could be permitted to<\/p>\n
go abroad      and for that purpose the conditions<\/p>\n
could be modified or lifted.\n<\/p>\n
            5. If the investigating officer wants<\/p>\n
to interrogate the petitioner further he could<\/p>\n

be     directed     to  be   present   before   the<\/p>\n
investigating officer on particular days before<\/p>\n
he    leaves    India. If    petitioner  is  to  be<\/p>\n
permitted      to  go  abroad,    there  should be<\/p>\n
sufficient assurance that he would be available<\/p>\n
for trial.\n<\/p>\n
            Petition is disposed lifting condition<\/p>\n
Nos.2 and 5. The petitioner is entitled to get<\/p>\n
the passport released from the Magistrate on<\/p>\n
the following conditions.\n<\/p>\n
            1) petitioner shall appear before the<\/p>\n
investigating officer on 21\/1\/2010, 22\/1\/2010<\/p>\n
and     23\/1\/2010    between  10  and   12     a.m.<\/p>\n
Investigating officer shall interrogate        him,<\/p>\n
if necessary on those days.        Petitioner shall<\/p>\n
execute      a bond   for Rs.1,00,000\/- (Rupees One<\/p>\n
Lakh only) with two solvent sureties each for<\/p>\n
the like sum before the Magistrate, undertaking<\/p>\n

\n                          5<\/span><\/p>\n
to return to India and will be available for<\/p>\n
trial      as and when required in this case.   On<\/p>\n
execution of bond, passport shall be released<\/p>\n
to the petitioner. Petitioner is permitted to<\/p>\n
leave India for      six months from the date of<\/p>\n
the release of the passport and shall appear<\/p>\n
before the Magistrate within six months from<\/p>\n
that day. Petitioner shall       also furnish his<\/p>\n
address in the Gulf country as well as the<\/p>\n
address of his counsel, to whom notice is to be<\/p>\n
issued,     if  warranted,  by  the  investigating<\/p>\n
officer     for his appearance.\n<\/p>\n<\/p>\n
