( Oral )<\/p>\n<p>            The petitioner, who is Panch of Gram Panchayat Village<\/p>\n<p>Budheri, Sub Tehsil Behal (Loharu) District Bhiwani and one of the<\/p>\n<p>complainants against respondent No.2, Sarpanch of the Gram Panchayat,<\/p>\n<p>has filed this petition under Articles 226\/227 of the Constitution of India for<\/p>\n<p>quashing the order dated 5.8.2008 (Annexure P-12), passed by the Appellate<\/p>\n<p>Authority, the Financial Commissioner and Principal Secretary to<\/p>\n<p>Government,     Haryana,    Development      and   Panchayats     Department,<\/p>\n<p>Chandigarh, whereby the order of suspension passed against respondent<\/p>\n<p>No.2 has been set aside, while observing as under :<\/p>\n<blockquote><p>                   &#8220;I have heard the counsels for the parties and gone<br \/>\n            through the record available on the file. Perusal of preliminary<br \/>\n<span class=\"hidden_text\"> CWP No. 16958 of 2008                                                  -2-<\/span><\/p>\n<p>             enquiry report reveals that the first charge leveled against the<br \/>\n             appellant is not based on the findings of the enquiry report.<br \/>\n             Further the comments on the reply to the show cause notice<br \/>\n             given by the Development and Panchayat Officer, Bahal reveal<br \/>\n             that the second allegation is devoid of any merit. As such I am<br \/>\n             of the view that the allegations levelled against the appellant do<br \/>\n             not warrant his suspension during the pendency of regular<br \/>\n             enquiry.
