PUBLIC PROSECUTOR for\nRespondent \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed, after filing of charge-sheet, under section 439<br \/>\nof the Code of Criminal Procedure by the applicant who has  been<br \/>\narrested in connection with C.R. No. I &#8211; 24 of 2010  registered with<br \/>\nFatehpura Police Station, District: Dahod for the offence punishable<br \/>\nunder sections 323, 325, 506, 114, 326 and 302 of the Indian Penal<br \/>\nCode.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicant submitted that the applicant is an<br \/>\ninnocent person and a false case is foisted on him. He submitted that<br \/>\nthe FIR came to be lodged after a delay of more than two weeks.<br \/>\nThough the incident occurred on 25.04.2010, the FIR was lodged on<br \/>\n10.05.2010 with a concocted and got up story.  He submitted that the<br \/>\ndeceased was passed away after one month and there is no nexus<br \/>\nbetween the so called injuries and the death. He submitted that it is<br \/>\nnot the case of Section 302 of the I.P.C., but only it is a case of<br \/>\nSection 304, Part- II of the I.P.C. He submitted that considering the<br \/>\nrole attributed to the applicant and reflected in the FIR at Annexure<br \/>\n&#8216;A&#8217; to the application, this is a fit case to enlarge the applicant<br \/>\non regular bail.\n<\/p>\n<p>\tAs against<br \/>\nthe aforesaid, learned APP submitted that considering the role played<br \/>\nby the applicant, no discretionary relief can be granted to the<br \/>\napplicant, and the application deserves to be dismissed.\n<\/p>\n<p>\tHaving<br \/>\nheard the rival submissions of learned advocates and having<br \/>\nconsidered the role attributed to the applicant and reflected in the<br \/>\nFIR at Annexure A,  the quantum of punishment etc., and the<br \/>\nco-accused is released by this Court, I am of the view that the<br \/>\napplicant is required to be enlarged on regular bail at this stage on<br \/>\nstringent conditions, without entering into the merits of the case<br \/>\nand  without discussing the evidence in detail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn the<br \/>\nfacts and circumstances of the case, the application is allowed and<br \/>\nthe applicant is  ordered to be enlarged on bail in connection with<br \/>\nC.R. No. I &#8211; 24 of 2010  registered with Fatehpura Police Station,<br \/>\nDistrict: Dahod, on his executing a bond of Rs.10,000\/-  [Rupees Ten<br \/>\nthousand only] with one surety of the like amount to the satisfaction<br \/>\nof the trial court and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender<br \/>\nhis passport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e].\tmark<br \/>\nhis presence at the concerned Police Station on 1st day of<br \/>\neach English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>[f].\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf breach<br \/>\nof any of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or to take appropriate action<br \/>\nin the matter.\n<\/p>\n<p>\tBail bond<br \/>\nto be executed before the lower Court having jurisdiction to try the<br \/>\ncase.\n<\/p>\n<p>\tAt the<br \/>\ntrial, the trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute to the aforesaid extent.
