Justice P.Q.BARKATH ALI\n\n Dated :28\/07\/2010\n\n O R D E R\n                   A.K.BASHEER &amp; P.Q.BARKATH ALI, JJ.\n                  - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                                   W.A.No.1279 OF 2010\n                  - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                         Dated this the 28th day of July 2010\n\n                                         JUDGMENT\n<\/pre>\n<p id=\"p_1\">Basheer, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">     Appellant is a stage carriage operator on the route Kottayam-<\/p>\n<p>Kumarakom via Thazhathangadi.\n<\/p>\n<p id=\"p_3\">     2. According to the appellant, Thazhathangadi is an accident prone<\/p>\n<p>area where several accidents have occurred in the recent past resulting in<\/p>\n<p>heavy loss of life. It is the contention of the appellant that situation may<\/p>\n<p>become worse, if the transport authorities issue more permits to new<\/p>\n<p>operators on the said route.                 The case of the appellant is that even<\/p>\n<p>variation of the existing permits on the said route may create havoc.<\/p>\n<p id=\"p_4\">     3. He highlighted all the above aspects in Ext.P1 request which he<\/p>\n<p>submitted    before       the      Regional            Transport            Authority,   Kottayam.<\/p>\n<p>Apparently, since no decision was taken on the said request, appellant filed<\/p>\n<p>a writ petition under the <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India with the<\/p>\n<p>following sole prayer:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;issue a writ of mandamus or any other writs, order or<\/p>\n<p>     direction directing the respondent Secretary, Regional<\/p>\n<p>     Transport Authority, Kottayam to take steps to consider<\/p>\n<p>     Ext.P1 request of the petitioner and not to grant further new<\/p>\n<p>     stage carriage permits or variation of permits on the portion<\/p>\n<p>W.A.No.1279 OF 2010<br \/>\n                                  :: 2 ::\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\">\n<p>      between Kumarakom and Kottayam via Thazhathangadi as<\/p>\n<p>      the infrastructure of the road is unfit to carry more<\/p>\n<p>      vehicles.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">\n<p id=\"p_6\">      4. The learned Single Judge dismissed the writ petition holding that<\/p>\n<p>the situation as projected by the appellant does not call for issue of any<\/p>\n<p>direction as sought for by the appellant. The learned Judge took the view<\/p>\n<p>that it cannot be assumed that the authorities concerned would not bestow<\/p>\n<p>its attention to the issue highlighted by the appellant.    It was further<\/p>\n<p>noticed by the learned Judge that the appellant had no case that any<\/p>\n<p>permit had been granted in violation of the existing law.<\/p>\n<p id=\"p_7\">      Having heard learned counsel for the appellant and having<\/p>\n<p>considered the contentions raised by the appellant, we do not find any<\/p>\n<p>reason to interfere with the view taken by the learned Single Judge. We<\/p>\n<p>are in respectful agreement with the observations made by the learned<\/p>\n<p>Single Judge in the impugned judgment.
