{"id":265868,"date":"2010-09-24T00:00:00","date_gmt":"2010-09-23T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/government-pleader-for-vs-5-on-24-september-2010"},"modified":"2015-08-19T17:59:26","modified_gmt":"2015-08-19T12:29:26","slug":"government-pleader-for-vs-5-on-24-september-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/government-pleader-for-vs-5-on-24-september-2010","title":{"rendered":"Government Pleader For vs &#8211; 5 on 24 September, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Government Pleader For vs &#8211; 5 on 24 September, 2010<\/div>\n<div class=\"doc_author\">Author: Ks Jhaveri,&amp;Nbsp;<\/div>\n<pre id=\"pre_1\">   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nSCA\/2690\/2000\t 3\/ 3\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 2690 of 2000\n \n\n======================================\n\n\n \n\nJAYANTILAL\nDAMJIBHAI LATHIA \n\n \n\nVersus\n \n\nSTATE\nOF GUJARAT &amp; OTHERS\n \n\n======================================\n \nAppearance : \nMR\nHARIN P RAVAL for Petitioner(s) : 1, \nGOVERNMENT PLEADER for\nRespondent(s) : 1 - 5, 7, \nRULE SERVED for Respondent(s) :\n6, \n====================================== \n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\nDate\n: 24\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThis<br \/>\nCourt passed the following order on 2nd March 2006:-\n<\/p>\n<p id=\"p_1\"> Before<br \/>\nthe learned advocate for the petitioner argues the matter in detail<br \/>\nand at length, it is stated by the learned Assistant Government<br \/>\nPleader, on behalf of the concerned authority that now final order<br \/>\nhas been passed by the City Survey Superintendent, Rajkot in<br \/>\npursuance of the order dated 21st<br \/>\nApril, 2001 passed by this Court and this order is appealable under<br \/>\nsection 203 of The Bombay Land Revenue Code, 1879.\n<\/p>\n<p id=\"p_2\">2.<br \/>\n\t\tAt this stage, the learned counsel for the petitioner submitted<br \/>\n\tthat impugned order has been received today and therefore, some time<br \/>\n\tmay be granted to the petitioner to challenge the impugned order<br \/>\n\tunder section 203 of The Bombay Land Revenue Code, 1879; but<br \/>\n\tmeanwhile, status quo which has been granted by this Court vide<br \/>\n\torder dated 17th April, 2000 and which has been confirmed<br \/>\n\tby the order dated 21st April, 2001 and which has been<br \/>\n\tcontinued till today, may be continued till the stay application is<br \/>\n\tdecided by the appellate authority, namely Collector, Rajkot under<br \/>\n\tsection 203 of the Code of 1879 and 10 days thereafter.\n<\/p>\n<p id=\"p_3\">3.<br \/>\n\tHaving heard the learned counsel for both the sides and looking to<br \/>\n\tthe facts and circumstances of the case, I hereby permit the<br \/>\n\tpetitioner to prefer an appeal under section 203 of the Code, 1879<br \/>\n\tbefore the District Collector, Rajkot. In the meanwhile, status quo<br \/>\n\tgranted by this Court vide order dated 17th<br \/>\n\tApril, 2000 which is confirmed by the subsequent order passed by<br \/>\n\tthis Court and continued till today shall remain operative for 10<br \/>\n\tdays after the order passed by the Collector, Rajkot upon stay<br \/>\n\tapplication which will be preferred by the petitioner alongwith the<br \/>\n\tappeal. The appeal will be preferred by the petitioner on or before<br \/>\n\t24th<br \/>\n\tMarch, 2006. The learned advocate for the petitioner submitted that<br \/>\n\tthe appeal will be preferred as early as possible and on or before<br \/>\n\t24th<br \/>\n\tMarch, 2006. The stay application which will be preferred by the<br \/>\n\tpetitioner alongwith the appeal shall be decided by the Collector,<br \/>\n\tRajkot within a period of three months from the date of receipt of<br \/>\n\tsuch application.\n<\/p>\n<p id=\"p_4\">4.<br \/>\n\tThe respondent no. 6 has been issued a notice for initiating<br \/>\n\tcontempt proceedings. It is reported to the learned Assistant<br \/>\n\tGovernment Pleader by the officer of the concerned authority that<br \/>\n\trespondent no. 6 has expired. Apart from this aspect of the matter,<br \/>\n\tin view of the final order passed by this Court, all the orders so<br \/>\n\tfar as contempt notice is concerned, are brought to an end including<br \/>\n\tnotice for issuance of contempt proceedings.<br \/>\n\tDirect service permitted.\n<\/p>\n<p id=\"p_5\">\tIn<br \/>\nspite of the same, the legal heirs are not brought on record.<br \/>\nHence, as a last chance, matter is adjourned to 11th<br \/>\nOctober 2010.
