(Oral)\n<\/pre>\n<p id=\"p_1\">Crl.M.A.No.3\/2011<\/p>\n<p id=\"p_1\">1.      Vide     this    application   the   petitioner   has     sought<\/p>\n<p>restoration of the petition, which was dismissed for non-<\/p>\n<p>prosecution vide order dated 13.12.2010.                  It has been<\/p>\n<p>recorded in the said order that even on the second call no<\/p>\n<p>one appeared for the petitioner and even on last two<br \/>\n<span class=\"hidden_text\" id=\"span_1\">        Crl.L.P.No.2527\/2007                        Page 1 of 4<\/span><br \/>\n consecutive dates petitioner remained unrepresented.<\/p>\n<p id=\"p_2\">2.    The present petition is restored subject to cost of<\/p>\n<p>`15,000\/- to be paid in favour of &#8216;Welfare Fund for Children<\/p>\n<p>and Destitute Women&#8217; at Nirmal Chhaya, Jail Road, Tihar,<\/p>\n<p>New Delhi, within two weeks from today. Proof of the same<\/p>\n<p>be placed on record.\n<\/p>\n<p id=\"p_3\">Crl.M.C.2527\/2007<\/p>\n<p id=\"p_4\">1.    With the consent of the parties, the matter is taken up<\/p>\n<p>for final disposal.\n<\/p>\n<p id=\"p_5\">2.    The instant petition is being filed on the basis of<\/p>\n<p>compromise deed arrived at Amritsar and the same was filed<\/p>\n<p>in the Court of Vivek Puri, Ld. ADJ, at Amritsar.<\/p>\n<p id=\"p_6\">3.    As per clause 4 of the said compromise, it is recorded<\/p>\n<p>as under :\n<\/p>\n<pre id=\"pre_1\">          \"That        the     plaintiff   undertakes     to\n          withdraw           the   above-said   case    and\n<\/pre>\n<p id=\"p_7\">          contempt proceedings pending in this<br \/>\n          Hon&#8217;ble Court against defendants.\n<\/p>\n<p id=\"p_8\">\n          This compromise is valid for case FIR<br \/>\n          No.586\/2002 u\/s 63 Copy Right Act and<br \/>\n          u\/s 78\/79 Trade Mark Act, PS Lahori<br \/>\n          Gate, Delhi. The plaintiff in view of the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">      Crl.L.P.No.2527\/2007                       Page 2 of 4<\/span><br \/>\n            compromise and for this reason Prince<br \/>\n           Sagar shall co-operate in getting the<br \/>\n           said FIR quashed in the High Court as<br \/>\n           per law.&#8221;\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">4.     Ld. counsel for respondent No.2 disputes the second<\/p>\n<p>part of para 4, which is hand-written. However, he submits<\/p>\n<p>that said hand-written portion was not in the compromise<\/p>\n<p>deed when respondent No.2 put his signature and handed<\/p>\n<p>over    the    same      to   the   opposing   counsel.     The   said<\/p>\n<p>compromise arrived only in Suit No.(RBT) 23 of 2003\/2006 in<\/p>\n<p>the Court of Ld. ADJ Shri Vivek Puri, at Amritsar.<\/p>\n<p id=\"p_11\">5.     Respondent No.2 also disputes the signature on hand-<\/p>\n<p>written portion.\n<\/p>\n<p id=\"p_12\">6.     Ld. counsel for the petitioner submits that ld. ADJ,<\/p>\n<p>District Courts, Amritsar has recorded the settlement in<\/p>\n<p>order dated 26.10.2006. In addition to that vide order dated<\/p>\n<p>26.10.2006 it was recorded that the terms and conditions of<\/p>\n<p>compromise Ex.C1 were correct and parties shall remain<\/p>\n<p>bound by it.           Accordingly, the suit was dismissed as<\/p>\n<p>withdrawn as settled in the compromise.<\/p>\n<p id=\"p_13\">7.     Though ld. counsel for the respondent has disputed the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">       Crl.L.P.No.2527\/2007                        Page 3 of 4<\/span><br \/>\n hand-written portion of para 4 of the compromise deed and<\/p>\n<p>initial put thereon.\n<\/p>\n<p id=\"p_14\">8.    However, present petition was filed way back in 2007.<\/p>\n<p>Ld. counsel for the respondent has made appearance in the<\/p>\n<p>matter on 31.03.2009.         He only raised objection and<\/p>\n<p>disputed this fact today in the court, however, has placed<\/p>\n<p>nothing on record to rebut the same.\n<\/p>\n<p id=\"p_15\">8.    Keeping in view the above settlement, which took place<\/p>\n<p>between the parties, I am of the view that the aforesaid<\/p>\n<p>settlement is binding in nature, therefore, I quash FIR No.586<\/p>\n<p>dated 14.12.2002 under Section 63 of the Copyrights Act<\/p>\n<p>and under Section 78\/79 of the Trademarks Act, registered<\/p>\n<p>at PS Lahori Gate and proceedings emanating therefrom.<\/p>\n<p id=\"p_16\">9.    Accordingly, Crl.M.C. No.2527\/2007 is allowed.<\/p>\n<p id=\"p_17\">10.
