ISAHAK\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p id=\"p_1\">2.   17.06.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p id=\"p_1\">                             The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Sections 25(1-b)A and 26<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian<\/p>\n<p>                  Penal Code<\/a>.\n<\/p>\n<p id=\"p_2\">                              Considering that the petitioner is in custody since<\/p>\n<p>                  5.12.2009 for recovery of two country made pistols and two<\/p>\n<p>                  empty cartridges, let the petitioner above named, be<\/p>\n<p>                  released on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>                  thousand) with two sureties of the like amount each to the<\/p>\n<p>                  satisfaction   of   Additional   Chief    Judicial   Magistrate,<\/p>\n<p>                  Hilsa,(Nalanda), in Hilsa P.S. Case No. 442 of 2009<\/p>\n<p>                  subject to the following conditions: (i)That one of the bailors<\/p>\n<p>                  will be a close relative of the petitioner who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioner and the other shall be the brother of the petitioner.<\/p>\n<p>                  The bailors will undertake to furnish information to the court<\/p>\n<p>                  about any change in the address of the petitioner. (ii)That<\/p>\n<p>                  the bailor shall also state on affidavit that he will inform the<\/p>\n<p>                  court concerned if the petitioner is implicated in any other<\/p>\n<p>                  case of similar nature after his release in the present case<\/p>\n<p>                  and thereafter the court below will be at liberty to initiate the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p id=\"p_3\">        (iii)That the petitioner will give an undertaking that he will<\/p>\n<p>        receive the police papers on the given date and be present<\/p>\n<p>        on date fixed for charge and if he fails to do so on two given<\/p>\n<p>        dates and delays the trial in any manner, his bail will be<\/p>\n<p>        liable to be cancelled for reasons of misuse.
