KAPADIA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T <\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tOrder passed by learned Single Judge of the Allahabad<br \/>\nHigh Court giving certain directions while dealing with<br \/>\napplication filed under Sections 14 and 15 of the Contempt<br \/>\nof Courts Act, 1971 (in short the &#8216;Act&#8217;) read with Article<br \/>\n215 of the Constitution of India, 1950 (in short the<br \/>\n&#8216;Constitution&#8217;) is challenged in this appeal. The foundation<br \/>\nof such application was alleged non-compliance of the<br \/>\ndirections given by the learned Single Judge of the High<br \/>\nCourt in Writ Petition no.129\/84 by order dated 16th<br \/>\nSeptember, 1997.  By the impugned order learned Single Judge<br \/>\nhas given certain directions while disposing of the Contempt<br \/>\nPetition.\n<\/p>\n<p>\tAccording to the learned counsel for the appellants<br \/>\nsuch directions could not have been given while dealing with<br \/>\napplication for contempt.  Such exercise of power is not<br \/>\nauthorized in law.  During the hearing of the application by<br \/>\nthe High Court the respondent no.1 (applicant before the<br \/>\nHigh Court) had contended that in view of the judgment<br \/>\npassed by the learned Single Judge in the Writ Petition the<br \/>\napplicant was entitled to arrears of salary etc. The<br \/>\nappellant and the functionaries of the State who were<br \/>\nimpleaded as respondents in the contempt proceedings took<br \/>\nthe stand that there was no positive direction for giving<br \/>\narrears of salary and, therefore, non-payment would not<br \/>\nconstitute wilful violation to attract action in terms of<br \/>\nSection 12 of the Act.\n<\/p>\n<p>The High Court was of the view that no positive<br \/>\ndirections could have been issued for arrears of salary.<br \/>\nThe Competent Committee was yet to consider the question of<br \/>\nregularization under the U.P. Regularization of Adhoc<br \/>\nAppointments (on posts outside purview of U.P. Public<br \/>\nService Commission) Rules, 1979 (in short the &#8216;Rules&#8217;).<br \/>\nReference was made also to certain decisions to hold that<br \/>\nonce the order of termination is set aside, it is to be<br \/>\ndeemed that incumbent had continued in service and would be<br \/>\nentitled to salary and allowances as if there was no break<br \/>\nin service.  It was also held that when an authority acts in<br \/>\ndisregard to a settled position in law, the commission or<br \/>\nomission would amount to contempt even if such an act may<br \/>\nnot amount to wilful disobedience. The contempt court can<br \/>\nact like an executing Court and can issue further directions<br \/>\nto compel the authority for taking action which is in<br \/>\nconsonance with settled law.  It was accordingly held that<br \/>\nrespondent no.1-the applicant was entitled to arrears of<br \/>\nsalary from the date of his termination upto the date of<br \/>\nreinstatement in service.  The contempt petition was<br \/>\naccordingly disposed of.\n<\/p>\n<p>\tIn support of the appeal, learned counsel for the<br \/>\nappellant submitted that it is not in dispute that no<br \/>\nspecific direction was given regarding arrears.  In fact, by<br \/>\noffice order no.NI(Lecturer)Yojana\/1693-1\/83\/98-99 dated<br \/>\n10.8.1998, it was clearly stipulated that the respondent<br \/>\nno.1 shall not be paid salary for the distributed period but<br \/>\nshall be entitled for the benefit of increments earned<br \/>\nearlier as usual.\n<\/p>\n<p>\tLearned counsel for the respondent no.1 submitted that<br \/>\nthe High Court had rightly taken note of the fact that as<br \/>\norder of termination was set aside, and the natural<br \/>\nconsequence is payment of back wages.  Merely because the<br \/>\nearlier order of the High Court did not specifically deal<br \/>\nwith this aspect, that cannot be a ground to deny the<br \/>\nbenefits to him.\n<\/p>\n<p>While dealing with an application for contempt, the<br \/>\nCourt is really concerned with the question whether the<br \/>\nearlier decision which has received its finality had been<br \/>\ncomplied with or not.  It would not be permissible for a<br \/>\nCourt to examine the correctness of the earlier decision<br \/>\nwhich had not been assailed and to take the view different<br \/>\nthan what was taken in the earlier decision.  A similar view<br \/>\nwas taken in <a href=\"\/doc\/1936737\/\">K.G. Derasari and Anr. V. Union of India and<br \/>\nOrs.<\/a> (2001 (10) SCC 496). The Court exercising contempt<br \/>\njurisdiction is primarily concerned with the question of<br \/>\ncontumacious conduct of the party who is alleged to have<br \/>\ncommitted default in complying with the directions in the<br \/>\njudgment or order. If there was no ambiguity or<br \/>\nindefiniteness in the order, it is for the concerned party<br \/>\nto approach the higher Court if according to him the same is<br \/>\nnot legally tenable. Such a question has necessarily to be<br \/>\nagitated before the higher Court. The Court exercising<br \/>\ncontempt jurisdiction cannot take upon itself power to<br \/>\ndecide the original proceedings in a manner not dealt with<br \/>\nby the Court passing the judgment or order.  Right or wrong<br \/>\nthe order has to be obeyed. Flouting an order of the Court<br \/>\nwould render the party liable for contempt. While dealing<br \/>\nwith an application for contempt the Court cannot traverse<br \/>\nbeyond the order, non-compliance of which is alleged. In<br \/>\nother words, it cannot say what should not have been done or<br \/>\nwhat should have been done. It cannot traverse beyond the<br \/>\norder. It cannot test correctness or otherwise of the order<br \/>\nor give additional direction or delete any direction. That<br \/>\nwould be exercising review jurisdiction while dealing with<br \/>\nan application for initiation of contempt proceedings.  The<br \/>\nsame would be impermissible and indefensible.  In that view<br \/>\nof the matter, the order of the High Court is set aside.\n<\/p>\n<p>\tIf the appellant has any grievance so far as the order<br \/>\ndated 10.8.1998 is concerned denying him the arrears of<br \/>\nsalary, he may, if so advised, approach the appropriate<br \/>\nforum for such remedy as is available in law.\n<\/p>\n<p>The appeal is allowed to the aforesaid extent with no<br \/>\norder as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Director Of Education, &#8230; vs Ved Prakash Joshi &amp; Ors on 15 July, 2005 Author: A Pasayat Bench: Arijit Pasayat, S.H.
