Respondent\n\n\n\n                This Criminal Revision Case is filed under  <a href=\"\/doc\/1457888\/\" id=\"a_1\">Sections  397<\/a>  and\n<a href=\"\/doc\/1571667\/\" id=\"a_1\">401<\/a> Cr.P.C.    against the order dated 16.7.2004 made in Crl.M.P.No.74 of 2004\nin S.C.No.16 of 2003 on the file of the Additional Sessions Court\/ Fast  Track\nCourt, Namakkal. \n\n!For Petitioners :  Mr.N.Manokaran\n\n^For Respondent :  Mr.V.Jayaprakash Narayanan,  \n                G.A.(Crl.side)\n\n\n:O R D E R \n<\/pre>\n<p id=\"p_1\">        The above criminal revision case has been filed praying to  set  aside<br \/>\nthe  order  dated 16.7.2004 made in Crl.M.P.No.74 of 2004 in S.C.No.16 of 2003<br \/>\non the file of the Additional Sessions Court\/Fast Track Court, Namakkal.\n<\/p>\n<p id=\"p_1\">        2.      Today,   when  the  above  Revision  Case  was  taken  up  for<br \/>\nconsideration, on a perusal of the materials placed on record and upon hearing<br \/>\nthe learned counsel for the petitioners, it comes to be seen that originally a<br \/>\ncase was registered against the petitioners under <a href=\"\/doc\/455468\/\" id=\"a_2\">Section 307<\/a>   I.P.C.  and on<br \/>\na later stage at the time of framing of the charges on an application filed on<br \/>\nthe part of the  prosecution,  three  more  Sections  have  been  added  i.e.,<br \/>\n<a href=\"\/doc\/1011035\/\" id=\"a_3\">Sections 323<\/a>, <a href=\"\/doc\/724142\/\" id=\"a_4\">324<\/a> and <a href=\"\/doc\/1517318\/\" id=\"a_5\">436<\/a> of I.P.C.  and it is the subject matter of the above<br \/>\ncriminal revision case.\n<\/p>\n<p id=\"p_2\">        3.   On  the  part  of  the learned counsel appearing on behalf of the<br \/>\npetitioners in the criminal revision case, he would argue to the  effect  that<br \/>\nwhile  the  major  charge  under  <a href=\"\/doc\/455468\/\" id=\"a_6\">Section 307<\/a> itself is there, the lower court<br \/>\nshould not have gone into adding up of <a href=\"\/doc\/1011035\/\" id=\"a_7\">Sections 323<\/a>, <a href=\"\/doc\/724142\/\" id=\"a_8\">324<\/a>, and <a href=\"\/doc\/1517318\/\" id=\"a_9\">436<\/a> I.P.C,  that<br \/>\ntoo, without the ingredients being made available but on the part of the lower<br \/>\ncourt  as  per  its order, it would see that sufficient ingredients being made<br \/>\nout for those sections to be added.\n<\/p>\n<p id=\"p_3\">        4.  <a href=\"\/doc\/1172704\/\" id=\"a_10\">Section 216<\/a> of Cr.P.C.  provides that:\n<\/p>\n<p id=\"p_4\">        (1) Any Court may alter or add  to  any  charge  at  any  time  before<br \/>\njudgment is pronounced.\n<\/p>\n<p id=\"p_5\">        (2)  Every  such alteration or addition shall be read and explained to<br \/>\nthe accused.\n<\/p>\n<p id=\"p_6\">        (3) If the alteration or addition to a charge is such that  proceeding<br \/>\nimmediately  with  the  trial  is  not likely, in the opinion of the Court, to<br \/>\nprejudice the accused in his defence or the prosecutor in the conduct  of  the<br \/>\ncase,  the Court may, in its discretion, after such alteration or addition has<br \/>\nbeen made, proceed with the trial as if the altered or added charge  had  been<br \/>\nthe original charge.\n<\/p>\n<p id=\"p_7\">        (4)  If the alteration or addition is such that proceeding immediately<br \/>\nwith the trial is likely, in the  opinion  of  the  Court,  to  prejudice  the<br \/>\naccused or the prosecutor as aforesaid, Court may either direct a new trial or<br \/>\nadjourn the trial for such period as may be necessary.\n<\/p>\n<p id=\"p_8\">        (5)  If  the  offence stated in the altered or added charge in one for<br \/>\nthe prosecution of which previous sanction is necessary, the case shall not be<br \/>\nproceeded with until such  sanction  is  obtained  unless  sanction  has  been<br \/>\nobtained  for a prosecution on the same facts as those on which the altered or<br \/>\nadded charge is founded.&#8221;\n<\/p>\n<p id=\"p_9\">        5.  From the above reading of the Section, it could be seen  that  the<br \/>\nsaid  Section  gives  enormous  power  to the trial Court to add up, delete or<br \/>\nalter the charges and therefore, the trial  Court  which  is  one  having  the<br \/>\nentire  materials  placed on record and having perused the same wants to alter<br \/>\nthe charge for the reasons assigned and hence, no interference by  this  court<br \/>\nneed  be  made  into such of the acts committed on the part of the trial Court<br \/>\nand even in the case in hand though on the part of the petitioners,  they  are<br \/>\nable  to  say that the ingredients are not so well made out in the case of the<br \/>\nprosecution so as to add up the Sections, still they are not able  to  explain<br \/>\nas  to  how it is prejudicial to their interest or as to how it is against the<br \/>\ndictum of law, the charges have been altered and therefore,  the  altering  of<br \/>\nthe charges  by  the  trial Court has to be approved.  Whatever be the charges<br \/>\nframed, unless on evidence it is proved, merely adding up of the  Sections  is<br \/>\nnot  going to matter during trial and therefore, the petitioners need not much<br \/>\nworry about the adding of the Sections in the framing of the  charges  but  to<br \/>\nfocus  their  attention to disprove the case of the prosecution and hence, the<br \/>\nfollowing order.\n<\/p>\n<p id=\"p_10\">        In result,\n<\/p>\n<p id=\"p_11\">        i) The above criminal revision case does not merit acceptance for  the<br \/>\nreasons assigned the same is dismissed.\n<\/p>\n<p id=\"p_12\">        ii)  The  order  dated16.7.2004  made in Crl.M.P.No.74 of 2004 in S.C.<br \/>\nNo.16 of 2003 on the file of the Additional Sessions Court\/Fast  Track  Court,<br \/>\nNamakkal, is confirmed;\n<\/p>\n<p id=\"p_13\">        iii)  Consequently,  the stay petition filed in C.M.P.No.10684 of 2004<br \/>\nis also dismissed.\n<\/p>\n<p id=\"p_14\">Index:  Yes<\/p>\n<p>Internet:  Yes<br \/>\nvsi<\/p>\n<p>To\n<\/p>\n<p id=\"p_15\">1.
