Rule<br \/>\n\tis fixed forthwith at the request of learned advocates for the<br \/>\n\tparties.\n<\/p>\n<p id=\"p_2\">The<br \/>\n\tpetitioner-second party workman in Reference (LCJ) No. 145 of 2000<br \/>\n\thas approached this Court under Articles 226 and 227 of the<br \/>\n\tConstitution of India challenging the order and award passed by the<br \/>\n\tPresiding Officer, Labour Court, Junagadh, camp at Porbandar, in so<br \/>\n\tfar as it did not order reinstatement and in lieu thereof granted<br \/>\n\tlump sum amount that too without taking into consideration an<br \/>\n\tappropriate factors for arriving at appropriate lump sum payment.\n<\/p>\n<p id=\"p_3\">This<br \/>\n\tCourt (Coram: K.A. Puj, J.) on 30\/12\/2010 after hearing learned<br \/>\n\tadvocate for the petitioner passed the following order :\n<\/p>\n<p id=\"p_4\"> Notice<br \/>\n\t\tfor final disposal returnable on 18.01.2011 <\/p>\n<p>The<br \/>\n\tfacts in brief deserve to be set out as under.\n<\/p>\n<p id=\"p_5\">\tThe<br \/>\n\tpetitioner was constrained to raise industrial dispute as despite<br \/>\n\this long service from 1\/6\/1996 and prior to his earlier services<br \/>\n\trendered with the  respondent, his services were terminated with<br \/>\n\teffect from 15\/5\/2000 without following the mandatory provisions of<br \/>\n\tlaw namely <a href=\"\/doc\/500379\/\" id=\"a_1\">Industrial Disputes Act<\/a>, 1947. The said dispute was<br \/>\n\treferred to the Competent Court, wherein, in was marked as Reference<br \/>\n\t(LCJ) No. 145 of 2000, which came to be partly allowed, as stated<br \/>\n\thereinabove, vide order dated 10\/11\/2010. Having been aggrieved and<br \/>\n\tdissatisfied with said order, present petition is preferred, which<br \/>\n\thas now been confined  only to the quantum of compensation awarded<br \/>\n\tin lieu of reinstatement and any other claim.\n<\/p>\n<p id=\"p_6\">Shri<br \/>\n\tPrachchhak, learned advocate appearing for the petitioner contended<br \/>\n\tthat Rs.13,000\/- with cost of reference of Rs.1,000\/- is too meager<br \/>\n\tamount to be awarded keeping in mind the actual services rendered by<br \/>\n\tthe petitioner before his termination is effected. He submitted that<br \/>\n\tin a given case, Supreme Court has awarded Rs.40,000\/- even if the<br \/>\n\tworkman had not completed more than two to three years of service.<br \/>\n\tHowever, he submitted that the appropriate enhancement of the<br \/>\n\tcompensation be ordered by the Court.\n<\/p>\n<p id=\"p_7\">Shri<br \/>\n\tDevnani, learned advocate appearing for the respondent relied upon<br \/>\n\tunreported decision of this Court in case of  BHURABHAI<br \/>\n\tVEJABHAI AGATH VS. PRESIDENT\/CHIEF OFFICER dated<br \/>\n\t23.12.2010 and contended that in such a case, the compensation is<br \/>\n\tawarded keeping in mind all factors and this Court therefore, is of<br \/>\n\tthe view that Rs.13,000\/- as compensation is too meager then the<br \/>\n\tCourt may enhance the same but not more than Rs.40,000\/- in any<br \/>\n\tcase.\n<\/p>\n<p id=\"p_8\">This<br \/>\n\tCourt has heard learned advocates for the parties and perused the<br \/>\n\torder of this Court relied upon by Shri Devnani in support of his<br \/>\n\tsubmission. The fact remains to be noted that the workman had in<br \/>\n\tfact put in more than 4 years service with respondent and his<br \/>\n\tservices came to be terminated unceremoniously without following due<br \/>\n\tprocess of law. However, in the submission of learned advocate for<br \/>\n\tthe petitioner, the workman had in fact earlier also rendered<br \/>\n\tservices, which otherwise could be considered to have been rendered<br \/>\n\tfrom 1981, instead of 1996. In view of the submission made by<br \/>\n\tadvocate for respective parties, this Court is of the view that<br \/>\n\tamount of Rs.13,000\/- is in fact an amount, which cannot said to be<br \/>\n\tan amount adequate enough to meet with the ends of justice. The<br \/>\n\tamount of compensation, is therefore, required to be enhanced<br \/>\n\taccordingly. In my view, instead of Rs.13,000\/- if the workman is<br \/>\n\tordered to be paid lump sum amount of Rs.40,000\/-, then, the ends of<br \/>\n\tjustice would be met appropriately. The award impugned is therefore<br \/>\n\tmodified and now as per the modified award, the workman is entitled<br \/>\n\tto receive Rs.40,000\/- towards all his claims raised. The amount of<br \/>\n\tRs.40,000\/- plus Rs.1000\/- towards cost, which has been awarded by<br \/>\n\tthe Reference Court, be paid within four weeks from the date of<br \/>\n\treceipt of writ of this Court. In case if the said amount is not<br \/>\n\tpaid within four weeks from the date of receipt of writ, then, the<br \/>\n\tamount thereafter be paid with interest at the rate of 18% p.a. and<br \/>\n\tit would be open to the workman to move this Court for appropriate<br \/>\n\trelief for compliance with this order. Petition is allowed to the<br \/>\n\taforesaid extent. Rule made absolute.
