Societies Act<\/a>, 2003. The Appellant may accordingly<br \/>\napproach his society to obtain the relevant information.\n<\/p>\n<p id=\"p_11\">       The SPIO\/GM, has correctly applied <a href=\"\/doc\/758550\/\" id=\"a_4\">Section 8<\/a> of the RTI Act, 05 for withholding the<br \/>\ninformation.&#8221;\n<\/p>\n<p id=\"p_12\">Relevant facts emerging during hearing:\n<\/p>\n<p id=\"p_13\">The following were present.\n<\/p>\n<p id=\"p_14\">Appellant: Mr. Harcharan Singh<br \/>\nRespondent: Mr. L.R. Garg PIO<br \/>\nThe respondent states that the information is exempt under <a href=\"\/doc\/758550\/\" id=\"a_5\">Section 8<\/a> (1) (d) &amp; (e).<br \/>\nThe respondent states that other banks could also offer such services; hence disclosure<br \/>\nof information by them of the details of loans would affect their competitive position.<br \/>\nThe respondent and appellant are asked to give their written submissions on the issue<br \/>\nof whether the exemptions under <a href=\"\/doc\/758550\/\" id=\"a_6\">Section 8<\/a> (1) (d) &amp; (e) apply in this case. Both are<br \/>\nasked to give their submissions to the Commission before 20 February 2009.<br \/>\nThe appellant has<\/p>\n<p>Decision announced on 4 March 2009:\n<\/p>\n<p id=\"p_15\">        The appellant has not given any submissions. The respondent Mr. L.R.Garg<br \/>\nhas given written submissions on 3 February 2009 arguing why the information<br \/>\nshould not be disclosed. It particularly states:\n<\/p>\n<p id=\"p_16\">        &#8220;The perusal of Appendix F of the Appeal would make the matter clear. In the<br \/>\nAppendix F of the Appeal it is clearly mentioned that Sh. Harcharan Singh has<br \/>\ndeposited a sum of Rs .12, 500- through the said society to discharge the loan liability<br \/>\nof the society and same has been deposited by the society with the DCHFC along with<br \/>\namount collected by the society from other members.\n<\/p>\n<p id=\"p_17\">        DCHFC took loan from Life Insurance Corporation of India (LIC) to finance<br \/>\nits member societies by entering into loan agreement and mortgage deed. Therefore,<br \/>\n there exists fiduciary relationship between LIC and DCHFC and between DCHFC<br \/>\nand loanee society.\n<\/p>\n<p id=\"p_18\">        Central Information Commission (CIC) in Appeal No. 41\/ICPB\/2006 dated<br \/>\n30062006 in respect of Maj. J.S. Kohli &#8211; VS-Telecom Regulatory Authority of India,<br \/>\nin which information of the details of the borrower and loans being in the nature of<br \/>\ncommercial confidence and the information available in its fiduciary relationship,<br \/>\ndisclosure of the said information was denied and accordingly appeal dismissed by the<br \/>\nHon&#8217;ble CIC.\n<\/p>\n<p id=\"p_19\">        With regard Paras 7 &amp; 8, it is submitted that the Appellant has sought the<br \/>\ninformation in respect of the transactions between the DCHFC the said society, and<br \/>\nbetween DCHFC and LIC, from where the DCHFC borrowed the funds. All these<br \/>\ntransactions are entered into commercial confidence and there exists fiduciary<br \/>\nrelationship between LIC and DCHFC, between DCHFC and said society. The<br \/>\nAppellant can not force the public authority to divulge the information which has<br \/>\nbeen held in the fiduciary relationship and which directly affects their commercial<br \/>\ninterest.\n<\/p>\n<p id=\"p_20\">        Further, the Appellant has been provided information which was not found to<br \/>\nbe held in fiduciary relationship and commercial confidence.&#8221;<br \/>\n The Commission accepts that the respondent&#8217;s contention of the exemptions under<br \/>\n<a href=\"\/doc\/758550\/\" id=\"a_7\">Section 8<\/a> (1) of the RTI act appear to be justified.\n<\/p>\n<p id=\"p_21\">The Appeal is dismissed.\n<\/p>\n<p id=\"p_22\">This decision is announced in open chamber.<br \/>\nNotice of this decision be given free of cost to the parties.\n<\/p>\n<p id=\"p_23\">                                                                         Shailesh Gandhi<br \/>\n                                                               Information Commissioner<br \/>\n                                                                           4 March 2009<\/p>\n<p>(In any case correspondence on this decision, mention the complete decision number.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Central Information Commission Mr. Harcharan Singh vs Delhi Co-Operative Housing &#8230;
