KURIAKOSE, J.\n                 ----------------------------------\n                  W.P.(C) NO. 26903 of 2003\n                 ----------------------------------\n           Dated this the 27th day of July , 2007\n\n\n                           JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The grievance of the petitioner,        who is one of the<\/p>\n<p>respondents in a claim petition before the Motor Accidents Claims<\/p>\n<p>Tribunal, Neyyattinkara, is that on the basis of a bogus<\/p>\n<p>complaint, Crime No.449\/99 of the Parassala Police station has<\/p>\n<p>been registered and that the Parassala police have submitted a<\/p>\n<p>final report which has been taken on file as C.C.729\/2000.<\/p>\n<p>According to Sri.R.T.Pradeep the learned counsel for the<\/p>\n<p>petitioner, the C.C. is now consigned to     L.P.Register since the<\/p>\n<p>accused who is a fictitious person could not be apprehended so<\/p>\n<p>far.   One of the prayers in the writ petition is        to direct<\/p>\n<p>respondents 1 to 4 to conduct         reinvestigation into   crime<\/p>\n<p>No.449\/99 so that the real culprit involved in the accident could<\/p>\n<p>be brought to court and the petitioner, who claims to be totally<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC No.26903\/2003                2<\/span><\/p>\n<p>innocent in the matter, could be absolved of his liability under<\/p>\n<p>the claim before the MACT.\n<\/p>\n<p id=\"p_1\">      2. Though notice was ordered to the respondents on this<\/p>\n<p>writ petition as far back as in 2003, it is seen that the petitioner<\/p>\n<p>has not been able to complete service on all the respondents. On<\/p>\n<p>a previous occasion when this case came up for consideration on<\/p>\n<p>the basis of submissions made, the case was ordered to be<\/p>\n<p>posted when moved again. Even now service is not complete.<\/p>\n<p>Even though the counsel for the petitioner would request for<\/p>\n<p>ordering reinvestigation into the crime      presently pending as<\/p>\n<p>C.C. No. 729\/2000 before the Magistrate court, I am not inclined<\/p>\n<p>to grant the above relief. I decline the relief sought for in the<\/p>\n<p>writ petition.  However,    I permit the petitioner to move the<\/p>\n<p>learned Magistrate    with appropriate    application  alerting the<\/p>\n<p>learned Magistrate by the grounds raised in the writ petition and<\/p>\n<p>seeking orders under Section 173 (8) of the <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.          If the<\/p>\n<p>learned Magistrate receives any such application from the<\/p>\n<p>petitioner within one month of the petitioner receiving a copy of<\/p>\n<p>this judgment, the learned Magistrate will dispose of that<\/p>\n<p>application after hearing the State, the petitioner and anybody<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC No.26903\/2003             3<\/span><\/p>\n<p>else who also according to the learned Magistrate ought to be<\/p>\n<p>heard in the matter.\n<\/p>\n<p id=\"p_2\">                           PIUS C.
