DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">Learned<br \/>\n\tcounsel appearing for the applicants submits that investigation<br \/>\n\tis over and charge sheet is filed.  It is further submitted<br \/>\n\tthat the allegations levelled in the FIR against the<br \/>\n\tapplicants are to the extent that the victim was mentally tortured<br \/>\n\tfor not clearing C.P.Ed. examination and expenses incurred by the<br \/>\n\tapplicants herein have gone in vain.  It is further submitted that<br \/>\n\tthe deceased had failed in C.P.Ed. even before marriage and the<br \/>\n\tapplicant had no connection with that.  It is further submitted that<br \/>\n\tthe applicant have roots in the society, will not flee from justice<br \/>\n\tand by imposing suitable conditions, the applicants may be enlarged<br \/>\n\ton bail.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p id=\"p_2\">Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact that<br \/>\n\tcharge sheet is filed, without discussing the evidence in<br \/>\n\tdetail, at this stage, I am inclined to enlarge the applicants on<br \/>\n\tbail  in connection with C.R.No.I-223\/2010 of Sahera Police Station<br \/>\n\tfor the offences punishable under <a href=\"\/doc\/92983\/\" id=\"a_1\">sections 306<\/a>, <a href=\"\/doc\/538436\/\" id=\"a_1\">498-A<\/a> &amp; <a href=\"\/doc\/112749\/\" id=\"a_2\">114<\/a> of<br \/>\n\tthe Indian Penal Code, on furnishing   bond of Rs.10,000\/- (Rupees<br \/>\n\tten thousand only) each with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the<br \/>\n\tapplicants shall :\n<\/p>\n<p id=\"p_3\">[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p id=\"p_4\">[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_5\">[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p id=\"p_6\">[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m .\n<\/p>\n<p id=\"p_7\">[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p id=\"p_8\">[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the bond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p id=\"p_9\">[g]\tsurrender<br \/>\npassports, if any, to the Lower Court immediately.\n<\/p>\n<p id=\"p_10\">If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p id=\"p_11\">Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_12\">Rule<br \/>\n\tis made absolute.
