NO. 2816 OF 2009\n             = = = = = = = = = = = = = = =\n         Dated this the 15th day of March, 2010.\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, North Paravur in O.P.(MV)554\/04.<\/p>\n<p>The claimant who had sustained a fracture on the upper end<\/p>\n<p>of the right tibia is assessed 7% disability by the Tribunal<\/p>\n<p>and the compensation is calculated. Assessment of disability<\/p>\n<p>without the help of a disability certificate under ordinary<\/p>\n<p>circumstances is a very hazardous task which a Court cannot<\/p>\n<p>afford to take.     If the Court feels a person is having<\/p>\n<p>disability, the Court has got the power under the provisions<\/p>\n<p>of the M.V.Act to refer that person to a Medical Board and<\/p>\n<p>obtain a report or certificate as the case may be and after<\/p>\n<p>hearing the parties concerned can award compensation.<\/p>\n<p>There are cases where disability certificates are produced<\/p>\n<p>and the Courts are in the habit of decreasing or increasing<\/p>\n<p>the disability and calculate the compensation. In such cases<\/p>\n<p>there are at least some materials before the Tribunal given<\/p>\n<p>M.A.C.A. 2816 OF 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  -:2:-<\/span><\/p>\n<p>by an expert which can be gone into and without those<\/p>\n<p>materials it is not proper for the Tribunal to assess the<\/p>\n<p>disability correctly.    I make it very clear that I am not<\/p>\n<p>making any observation to the effect that there is no<\/p>\n<p>disability at all for the petitioner herein. So the methodology<\/p>\n<p>now is to remit the case back to the Tribunal and refer him to<\/p>\n<p>a Medical Board with an expert Orthopedic specialist, get<\/p>\n<p>certificate and then decide the matter in accordance with<\/p>\n<p>law.   The insurance company also has the risk of paying<\/p>\n<p>higher compensation if the disability assessed is high. Since<\/p>\n<p>the matter is going back let there be a determination of the<\/p>\n<p>compensation afresh in accordance with law.            For that<\/p>\n<p>purpose parties are permitted to produce both documentary<\/p>\n<p>as well as oral evidence in support of their respective<\/p>\n<p>contentions.     The Tribunal on appearance of the party is<\/p>\n<p>directed to refer him to a Medical Board and then proceed in<\/p>\n<p>accordance with law. Parties are directed to appear before<\/p>\n<p>the Tribunal on 23.4.2010.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">                              M.N.
