Balachandran, J.\n            --------------------------\n             W.P.(C)No.35182 of 2008 L\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">    Petitioner is the judgment debtor in O.S.No.<\/p>\n<p>950\/00 on the file of the Sub Court, Thrissur.<\/p>\n<p>Respondents\/decree holders filed E.P.No.23\/08 in<\/p>\n<p>the court below to have the money decree obtained<\/p>\n<p>by them executed and amounts recovered by sale of<\/p>\n<p>the property belonging to the judgment debtor,<\/p>\n<p>which was charged under the decree.\n<\/p>\n<p id=\"p_1\">    2.  The grievance of the petitioner is that the<\/p>\n<p>execution  court  has   not  at  all  adopted   the<\/p>\n<p>procedures to be followed in such cases and has<\/p>\n<p>casually settled the proclamation as submitted by<\/p>\n<p>the decree holders and ordered the property to be<\/p>\n<p>proclaimed for sale vide order dated 3.10.2008 and<\/p>\n<p>posted the case for sale, whereas, on 3.10.2008, an<\/p>\n<p>objection has been filed by the petitioner to Rule<\/p>\n<p>66  notice  pointing   out  that   the  amount  of<\/p>\n<p>Rs.50,000\/- shown as the value of the property is<\/p>\n<p>very meagre and that the property is really worth<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 35182\/08               2<\/span><\/p>\n<p>Rupees Eight lakhs.\n<\/p>\n<p id=\"p_2\">     3.     Petitioner has produced the endorsements<\/p>\n<p>made by the court below on E.P.No.23\/08, which<\/p>\n<p>shows that the execution court has ordered Rule 22<\/p>\n<p>notice to the judgment debtor and posted the case<\/p>\n<p>to 24.3.2008 and thereafter to 5.6.2008.     But, on<\/p>\n<p>that day, there was no sitting and the case was<\/p>\n<p>adjourned to 10.7.2008.    On 10.7.2008, the judgment<\/p>\n<p>debtor prayed for time to file counter and the case<\/p>\n<p>was adjourned to 15.8.2008, on which day also,<\/p>\n<p>there was no sitting and the case was adjourned to<\/p>\n<p>15.9.2008.     The endorsement in the order sheet on<\/p>\n<p>15.9.2008 is &#8220;settlement of proclamation, steps on<\/p>\n<p>3.10.2008&#8221;. The endorsement on 3.10.2008 is &#8220;for<\/p>\n<p>proclamation on 22.10.2008&#8221; and the endorsement on<\/p>\n<p>22.10.2008 is &#8220;for sale, steps &#8211; 2.12.2008&#8221;.     From<\/p>\n<p>the order passed on 15.9.2008, it is not clear as<\/p>\n<p>to whether proclamation was settled on that day and<\/p>\n<p>for what purpose was the EP adjourned to 3.10.2008.<\/p>\n<p>Filing of objection by the judgment debtor on<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 35182\/08               3<\/span><\/p>\n<p>3.10.2008 is not made mention of. Unless settlement<\/p>\n<p>of proclamation is had, the property cannot be<\/p>\n<p>proclaimed for sale.    It does not appear from the<\/p>\n<p>order of the execution court as to whether the<\/p>\n<p>court has accepted the upset price shown in the<\/p>\n<p>draft proclamation or has applied its mind to the<\/p>\n<p>value of the property in the proclamation schedule.<\/p>\n<p id=\"p_3\">     4.    Further, when Rule 22 notice is issued to<\/p>\n<p>the judgment debtor, what one expects is for the<\/p>\n<p>judgment     debtor  to   file   objection   to   the<\/p>\n<p>executability of the decree and not objection to<\/p>\n<p>the draft proclamation.    Immediately after ordering<\/p>\n<p>Rule 22 notice and the judgment debtor entering<\/p>\n<p>appearance pursuant thereto, without any further<\/p>\n<p>notice under Rule 66, the court has passed on to<\/p>\n<p>the stage of settlement of proclamation, without an<\/p>\n<p>order being passed allowing the decree holders to<\/p>\n<p>execute the decree, when only the stage of Rule 22<\/p>\n<p>notice will be over.      On the whole, the entire<\/p>\n<p>steps adopted by the execution court to bring the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">WPC 35182\/08               4<\/span><\/p>\n<p>property to sale on the application of the decree<\/p>\n<p>holders is not at all in conformity with the<\/p>\n<p>provisions under Order XXI CPC.\n<\/p>\n<p id=\"p_4\">     5. In the result, even without notice to the<\/p>\n<p>respondents\/decree holders, I set aside the entire<\/p>\n<p>proceedings     adopted by  the execution   court  on<\/p>\n<p>Exhibit     P2   execution application   ever   after<\/p>\n<p>15.8.2008 and direct the court below to proceed<\/p>\n<p>afresh from that stage. Petitioner is directed to<\/p>\n<p>produce a copy of this judgment in the court below<\/p>\n<p>forthwith with notice to the respondents\/decree<\/p>\n<p>holders, as this writ petition is being disposed of<\/p>\n<p>without     notice  to them.   The   sale  posted  to<\/p>\n<p>2.12.2008 is stopped.\n<\/p>\n<p id=\"p_5\">     The writ petition is disposed of with the above<\/p>\n<p>directions.
