{"id":266099,"date":"2011-07-11T00:00:00","date_gmt":"2011-07-10T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/sunil-kumar-sinha-vs-amit-kumar-anr-on-11-july-2011"},"modified":"2017-06-06T20:14:39","modified_gmt":"2017-06-06T14:44:39","slug":"sunil-kumar-sinha-vs-amit-kumar-anr-on-11-july-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/sunil-kumar-sinha-vs-amit-kumar-anr-on-11-july-2011","title":{"rendered":"Sunil Kumar Sinha vs Amit Kumar &amp; Anr on 11 July, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Sunil Kumar Sinha vs Amit Kumar &amp; Anr on 11 July, 2011<\/div>\n<p id=\"p_1\">                    IN THE HIGH COURT OF JUDICATURE AT PATNA<br \/>\n                  CIVIL WRIT JURISDICTION CASE No.10850 of 2011<\/p>\n<p>                          SUNIL KUMAR SINHA &#8211; Petitioner\/s(s)<br \/>\n                                       Versus<br \/>\n                          AMIT KUMAR &amp; ANR &#8211; Respondent\/s(s)<br \/>\n                                    ___________<\/p>\n<p id=\"p_1\">2.   11.07.2011                  Heard the learned counsel for the petitioner.<\/p>\n<p id=\"p_2\">                                 This writ application has been filed against the<\/p>\n<p>                       order dated 29.4.2011 passed by Sub Judge 9 th<\/p>\n<p>                       Muzaffarpur in Title Suit No. 518 of 2007, whereby the<\/p>\n<p>                       prayer of the petitioner for recalling the PW Nos. 1, 2,<\/p>\n<p>                       3, 5 and 6 for their further cross examination has been<\/p>\n<p>                       rejected.\n<\/p>\n<p id=\"p_3\">                                 The       learned   counsel    for   the      petitioner<\/p>\n<p>                       submitted that at the time of argument it was felt that<\/p>\n<p>                       the said PWs have not been cross examined on certain<\/p>\n<p>                       points and the petitioner also offered cost but the<\/p>\n<p>                       learned     court    below    rejected   the   prayer     without<\/p>\n<p>                       considering the facts that further cross-examination is<\/p>\n<p>                       necessary. The learned counsel for the petitioner relied<\/p>\n<p>                       upon a decision of the Apex Court reported in 2011<\/p>\n<p>                       (2) PLJR 139.\n<\/p>\n<p id=\"p_4\">                                 From perusal of the order it appears that the<\/p>\n<p>                       evidence was closed on 8.12.2010 and the case was<\/p>\n<p>                       fixed for argument immediately on 21.12.2010. At this<\/p>\n<p>                       juncture the petitioner filed an application for recalling<\/p>\n<p>                       the said witnesses on the ground that the said<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                  2<\/span><\/p>\n<p>witnesses are required to cross-examine further on<\/p>\n<p>certain grounds. From perusal of the application it does<\/p>\n<p>not appear that on what point the cross-examination is<\/p>\n<p>required. So far the decision cited by the petitioner is<\/p>\n<p>concerned in the said very decision the Apex Court held<\/p>\n<p>that for recall or re-opening the evidence of a party the<\/p>\n<p>court exercises power under Section 151 of the Code of<\/p>\n<p>Civil Procedure. The Apex Court further held that the<\/p>\n<p>power to recall any witness is not intended to be used<\/p>\n<p>to fill up omission in evidences of a witness who has<\/p>\n<p>already been examined. It has specifically been held<\/p>\n<p>that if there is a time gap between the completion of<\/p>\n<p>the   evidence   and   hearing   of   the   arguments   for<\/p>\n<p>whatsoever reason and if in that period the party comes<\/p>\n<p>across some evidence which he could not lay his hands<\/p>\n<p>earlier or some evidence in regard to the conduct or<\/p>\n<p>action of the other party comes into existence, the<\/p>\n<p>court may in exercise of its inherent power under<\/p>\n<p>Section 151 C.P.C. permit the production of such<\/p>\n<p>evidence if it is relevant and necessary in the interest of<\/p>\n<p>justice.\n<\/p>\n<p id=\"p_5\">           Here only a bald statement has been made on<\/p>\n<p>the ground that it is necessary for further cross-<\/p>\n<p>examination without any clarification. From perusal of<\/p>\n<p>the impugned order it appears that the learned court<\/p>\n<p>below observed that sufficient time was granted to the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                        3<\/span><\/p>\n<p>       petitioner for cross-examining the witnesses and senior<\/p>\n<p>       counsel Sri Gulab Rabbani has fully cross-examined the<\/p>\n<p>       witnesses. However, at the time of hearing another<\/p>\n<p>       senior counsel was engaged.\n<\/p>\n<p id=\"p_6\">                Considering the above facts and circumstances<\/p>\n<p>       of the case, in my opinion, it is not a fit case where<\/p>\n<p>       supervisory   jurisdiction   under   <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article   227<\/a>   of   the<\/p>\n<p>       Constitution of India be exercised as the court below<\/p>\n<p>       has not acted beyond his jurisdiction. Accordingly, this<\/p>\n<p>       writ application is dismissed.\n<\/p>\n<p id=\"p_7\">\n<pre id=\"pre_1\">S.S.
