BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the State of Gujarat through the Public<br \/>\nProsecutor seeking Leave to Appeal against judgment and order dated<br \/>\n15th December 2009, passed by the learned Additional<br \/>\nSessions Judge and Special Judge, 1st Fast Track Court,<br \/>\nPanchmahals at Godhra in Special Case No. 4 of 2001 (ACB).\n<\/p>\n<p id=\"p_1\">2.0\tThe<br \/>\nlearned Additional Public Prosecutor strenuously submitted that the<br \/>\nlearned Judge has committed an error in recording acquittal of all<br \/>\nthe accused for the offences punishable under <a href=\"\/doc\/1131784\/\" id=\"a_1\">Sections 408<\/a>, <a href=\"\/doc\/1326844\/\" id=\"a_1\">409<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_2\">420<\/a>,<br \/>\n<a href=\"\/doc\/556166\/\" id=\"a_3\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_4\">471<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_5\">114<\/a> of the Indian Penal Code and <a href=\"\/doc\/324254\/\" id=\"a_6\">Section 7<\/a> of the<br \/>\nPrevention of Corruption Act by giving them benefit of doubt.\n<\/p>\n<p id=\"p_2\">2.1\tThe<br \/>\nlearned Additional Public Prosecutor submitted that if the learned<br \/>\nJudge had appreciated the evidence in its true perspective, the<br \/>\nlearned Judge would not have erred in recording acquittal.  The<br \/>\nlearned Additional Public Prosecutor invited the attention of the<br \/>\nCourt to the relevant deposition, more particularly, where the case<br \/>\nis that, a person was died a month before, even his thumb impression<br \/>\nis obtained on a statement that he has received the Buffalo.<br \/>\nSimilarly, a person, who is educated, his Statement with thumb<br \/>\nimpression is sought to be relied upon to contend before the Court<br \/>\nthat he has also received Buffalo.  The learned Additional Public<br \/>\nProsecutor submitted that the matter requires consideration so as to<br \/>\nsee that a message goes to the people that the benefits, which flow<br \/>\nfrom the Government policies, must go to the persons for whom, the<br \/>\nbenefits are meant for.\n<\/p>\n<p id=\"p_3\">2.2\tThe<br \/>\nlearned Additional Public Prosecutor also invited the attention of<br \/>\nthe Court to different grounds, which are set out in the Appeal Memo.<br \/>\n The learned Additional Public Prosecutor pressed into service the<br \/>\nrelevant grounds and requested that he matter be considered by this<br \/>\nCourt.\n<\/p>\n<p id=\"p_4\">3.0\tRule.\n<\/p>\n<p id=\"p_5\"> Learned advocate Mr. Parghi for the respondents waives service of<br \/>\nthe process of Rule.\n<\/p>\n<p id=\"p_6\">4.0\tOn<br \/>\nperusal of the judgment and order and on perusal of the grounds set<br \/>\nout in the Appeal Memo, this Court is of the opinion that, the matter<br \/>\nrequires consideration.
