HEMA, J.\n\n               ---------------------------------------------------\n                       B.A. No. 2681 of 2010\n               ---------------------------------------------------\n                Dated this 20th day of July, 2010.\n\n\n                                   ORDER\n<\/pre>\n<p id=\"p_1\">      Petition for bail.\n<\/p>\n<p id=\"p_1\">      2.  The alleged offence            is under <a href=\"\/doc\/34296573\/\" id=\"a_1\">Section 22(c)<\/a> of the<\/p>\n<p>Narcotic Drugs and Psychotropic substances Act (for short<\/p>\n<p>&#8216;<a href=\"\/doc\/1727139\/\" id=\"a_1\">NDPS Act<\/a>&#8216;). Petitioner was allegedly found in possession of 32<\/p>\n<p>ampules     of   Lupigesic,       which       is    the     trade   name   of<\/p>\n<p>Buprenorphine. The crime was detected on 16.3.2010 and the<\/p>\n<p>petitioner was arrested from the spot.\n<\/p>\n<p id=\"p_2\">      3. Learned counsel for petitioner submitted that petitioner<\/p>\n<p>is in custody for the past 126 days. Going by the decision in<\/p>\n<p><a href=\"\/doc\/1813727\/\" id=\"a_2\">Micheal Raj v. Intelligence Officer<\/a> (2008 (2 ) KLT 36), unless the<\/p>\n<p>quantitative analysis is made, the quantity of Bupernorphine in<\/p>\n<p>the article cannot be assessed. Hence, it cannot be said that<\/p>\n<p>large commercial quantity is involved in this case. Therefore, it<\/p>\n<p>has to be deemed that quantity involved is lesser than the<\/p>\n<p>commercial quantity and petitioner is entitled for bail under<\/p>\n<p><a href=\"\/doc\/839149\/\" id=\"a_3\">Section 167(2)<\/a> of Cr.P.C. since he is in custody for the past<\/p>\n<p>more than     60 days, it is submitted. It is also                argued that<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">[B.A.No.2681\/2010]                   2<\/span><\/p>\n<p>petitioner has not committed offence, going by the provision<\/p>\n<p>contained in under Rule 66 of the NDPS Rules because, as<\/p>\n<p>per the said provision, 100 dosage of the drug can be kept in<\/p>\n<p>possession of a person even without prescription.<\/p>\n<p id=\"p_3\">       4. This petition is strongly opposed. Learned Public<\/p>\n<p>Prosecutor submitted that petitioner is involved in other cases<\/p>\n<p>for offences under <a href=\"\/doc\/1727139\/\" id=\"a_4\">NDPS Act<\/a>. If the petitioner is released on<\/p>\n<p>bail, it is likely that he will abscond. It is also submitted that in<\/p>\n<p>the light of the notification dated 18th November, 2009, the<\/p>\n<p>quantity involved in this case is commercial quantity. As per<\/p>\n<p>the notification, the quantities shown in column 5 and 6 of the<\/p>\n<p>Table relating to the respective drugs shown in column 2 shall<\/p>\n<p>apply to the entire mixture of any solution or any one or<\/p>\n<p>more narcotic drugs or psychotropic substances of that<\/p>\n<p>particular drug.\n<\/p>\n<p id=\"p_4\">       5.    Going   by    the   above   notification  date   dated<\/p>\n<p>18.11.2009, the total quantity of Bupernorphine           found    in<\/p>\n<p>possession of petitioner is 64 ml. which will come to about 60<\/p>\n<p>grams. Hence, quantity involved is commercial quantity and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">[B.A.No.2681\/2010]                 3<\/span><\/p>\n<p>petitioner is not entitled for bail on default, it is argued. It is<\/p>\n<p>also submitted that in the light of the notification, it cannot be<\/p>\n<p>said that Micheal Raj&#8217;s case still holds field. According learned<\/p>\n<p>public Prosecutor, it is in the light of Micheal Raj&#8217;s case that<\/p>\n<p>the notification was introduced. Learned       Public   Prosecutor<\/p>\n<p>also submitted that petitioner has also no case that he was<\/p>\n<p>keeping contraband article for personal use. Unless there is an<\/p>\n<p>admission that it was kept in possession for personal use,<\/p>\n<p>Rule 67 will not apply.\n<\/p>\n<p id=\"p_5\">      6. On hearing both sides, I am satisfied that petitioner is<\/p>\n<p>involved    in various other    cases   of similar nature.    The<\/p>\n<p>offence under <a href=\"\/doc\/34296573\/\" id=\"a_5\">Section 22(c)<\/a> of NDPS Act involves commercial<\/p>\n<p>quantity and, as    per <a href=\"\/doc\/496325\/\" id=\"a_6\">Section 37<\/a> of NDPS Act,         no person<\/p>\n<p>accused of an offence punishable for offences            involving<\/p>\n<p>commercial quantity shall be released on bail, in cases where<\/p>\n<p>Public prosecutor opposes the application, uncles the court is<\/p>\n<p>satisfied that there are reasonable grounds for believing that<\/p>\n<p>petitioner is not guilty of such offence and that he is not likely<\/p>\n<p>to commit any offence while on bail. Petitioner is not able to<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">[B.A.No.2681\/2010]              4<\/span><\/p>\n<p>substantiate the twin conditions in 37(1)(b)(ii) of <a href=\"\/doc\/1727139\/\" id=\"a_7\">NDPS Act<\/a>.<\/p>\n<p>At any rate, considering the antecedents, it is likely that<\/p>\n<p>petitioner may repeat the offence. In such circumstances, bail<\/p>\n<p>cannot be granted.\n<\/p>\n<p id=\"p_6\">      Petition is dismissed.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                    K.
