The PIO made a<br \/>\nmisleading and wrong statement in his first reply. Therefore the PIO is liable under The Service Rules.\n<\/p>\n<p id=\"p_8\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_9\">The following were present<br \/>\nAppellant : Dr. Jitendra Nath Gupta;\n<\/p>\n<p id=\"p_10\">Respondent : Mr. Ramesh Chand, KGO on behalf of Mr. Ashok Gupta, PIO &amp; SDM(Civil Lines);\n<\/p>\n<p id=\"p_11\">               Mr. Rakesh Kumar, APIO &amp; Sub-Registrar(Kashmere Gate);<br \/>\nThe appellant had sought copy of the &#8220;The Delhi Document Writers Licensing Rules, 1966&#8221;. Though the<br \/>\nPIO apparently knew that the information would be available with Registrar DC North he did not seek the<br \/>\nassistance of Registrar, DC North and provided the information but only stated that it pertain to registrar<br \/>\nDC North. Subsequently this information was provided to the Appellant when he went for the first<br \/>\nhearing on 04\/10\/2010.\n<\/p>\n<p id=\"p_12\"> Decision:\n<\/p>\n<p id=\"p_13\">The Appeal is allowed.\n<\/p>\n<p id=\"p_14\">      The information has been provided to the Appellant.\n<\/p>\n<p id=\"p_15\">The issue before the Commission is of not supplying the complete, required information by the PIO<br \/>\nwithin 30 days as required by the law.\n<\/p>\n<p id=\"p_16\">From the facts before the Commission it appears that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. It appears that the PIO&#8217;s actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1).<br \/>\nA showcause notice is being issued to him, and he is directed give his reasons to the Commission to show<br \/>\ncause why penalty should not be levied on him.\n<\/p>\n<p id=\"p_17\">He will present himself before the Commission at the above address on 27 January 2011 at 11.30am<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as mandated<br \/>\nunder <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1). He will also send the information sent to the appellant as per this decision and<br \/>\nsubmit speed post receipt as proof of having sent the information to the appellant.\n<\/p>\n<p id=\"p_18\">If there are other persons responsible for the delay in providing the information to the Appellant the<br \/>\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before the<br \/>\nCommission with him.\n<\/p>\n<p id=\"p_19\">This decision is announced in open chamber.\n<\/p>\n<p id=\"p_20\">Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per <a href=\"\/doc\/383252\/\" id=\"a_3\">Section 7(6)<\/a> of RTI Act.\n<\/p>\n<p id=\"p_21\">                                                                                                        Shailesh Gandhi<br \/>\n                                                                                              Information Commissioner<br \/>\n                                                                                                        03 January 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
