Justice P.BHAVADASAN\n\n Dated :01\/02\/2010\n\n O R D E R\n                           P.BHAVADASAN, J.\n                           ---------------------------\n                       Crl.M.C No.325 OF 2010\n                        --------------------------------\n             Dated this the 1st day of February 2010\n              -----------------------------------------------------\n\n                                   ORDER\n<\/pre>\n<p id=\"p_1\">           This is a petition filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Cr.P.C<\/p>\n<p>seeking to have Annexure A II charge Sheet and all further<\/p>\n<p>proceedings in C.C No.1285\/2009 pending before the Judicial First<\/p>\n<p>Class Magistrate Court &#8211; I, Ernakulam quashed.<\/p>\n<p id=\"p_1\">           2. Petitioners are the accused in Crime No.832\/2009 of<\/p>\n<p>Ernakulam Town North Police Station for having offences<\/p>\n<p>punishable under <a href=\"\/doc\/1868826\/\" id=\"a_1\">Sections 498(A)<\/a>, <a href=\"\/doc\/1128948\/\" id=\"a_2\">120(B)<\/a> and <a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a> IPC.                  After<\/p>\n<p>investigation, final report was filed. Cognizance was taken by the<\/p>\n<p>court as per C.C No.1285\/2009. It is unnecessary to go into the<\/p>\n<p>details of the case for a simple reason that this petition can be<\/p>\n<p>disposed of in a very short term.\n<\/p>\n<p id=\"p_2\">           3. It is pointed out that the parties have settled the<\/p>\n<p>dispute between them. They therefore pray that a queitus may<\/p>\n<p>be given to the matter.\n<\/p>\n<p id=\"p_3\">           4. It is true that the offences are under Sections 498<\/p>\n<p>(A), 120(B) and 34 of <a href=\"\/doc\/1569253\/\" id=\"a_4\">IPC<\/a> are not compoundable but one should<\/p>\n<p>notice that since the disputes are settled by parties and there is<\/p>\n<p>Crl.M.C No.325 OF 2010            Page numbers<\/p>\n<p>no public policy involved, the reliefs can be moulded. In the light<\/p>\n<p>of the decision reported in <a href=\"\/doc\/1442974\/\" id=\"a_5\">Madan Mohan Abbot v. State of<\/p>\n<p>Punjab<\/a> (2008(3) KLT 19 Sessions Court ) and Manoj<\/p>\n<p>Sharma v State (2008(4) KLT 417) there is no reason as to<\/p>\n<p>why the prayers should not be accepted.<\/p>\n<p id=\"p_4\">             5.
