Justice ANTONY DOMINIC\n\n Dated :25\/05\/2010\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                    ================\n                W.P.(C) NO. 15855 OF 2010 (F)\n                =====================\n\n             Dated this the 25th day of May, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioner submits that he is advised for recruitment as<\/p>\n<p>Police Constable in Kerala Armed Police I Battalion. He submits<\/p>\n<p>that he is not deputed for training for the reason that he is<\/p>\n<p>accused in Crime No.1504\/09 of Central Police Station, Ernakulam<\/p>\n<p>and Crime No.139\/10 of Poochakkal Police Station, Alappuzha.<\/p>\n<p id=\"p_1\">      2.    The contention raised by the petitioner is that for the<\/p>\n<p>mere reason that he is accused in criminal cases, which are<\/p>\n<p>pending trial, he cannot be excluded from training. For this<\/p>\n<p>purpose, he rely on the judgments of this Court in <a href=\"\/doc\/1525017\/\" id=\"a_1\">Christopher<\/p>\n<p>Jose v. State of Kerala<\/a> (1999(3) KLT 285) and <a href=\"\/doc\/219906\/\" id=\"a_1\">Suresh v.<\/p>\n<p>Public Service Commission<\/a> (2008(2) KLT 441).<\/p>\n<p id=\"p_2\">      3.    In several cases of this nature, orders have been<\/p>\n<p>passed by this Court directing that the petitioners be admitted for<\/p>\n<p>training. In view of the above, and also following the principles<\/p>\n<p>laid down by this Court in the aforesaid judgments, it is ordered<\/p>\n<p>that the respondents shall permit the petitioner to attend the<\/p>\n<p>ensuing training after following the procedure prescribed therefor<\/p>\n<p>WPC No. 15855\/10<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  :2 :<\/span><\/p>\n<p>and other Rules relating to the same. It is clarified that if the<\/p>\n<p>petitioner is finally found ineligible based on the judgment of the<\/p>\n<p>Criminal Court to enter or continue in Government service as<\/p>\n<p>Police Constable, the respondents will be free to take appropriate<\/p>\n<p>action including to recover the entire expenses incurred by the<\/p>\n<p>State for providing training to the petitioner. It is also directed<\/p>\n<p>that the petitioner shall execute a bond undertaking that he shall<\/p>\n<p>refund the entire amount incurred by the Government for the<\/p>\n<p>purpose of his training. Upon execution of such bond, along with<\/p>\n<p>others, the petitioner shall also be permitted to attend training.<\/p>\n<p id=\"p_3\">      4.
