03\/   25.07.2011             Heard learned counsel for the applicants as well as learned<\/p>\n
                  counsel appearing for opposite party no.2.\n<\/p>\n
                               Original record of this court has been eaten away by white ant<\/p>\n
                  and as per direction the parties furnished photo state copy of the original<\/p>\n
                  record and accordingly, record was reconstructed.<\/p>\n
                               This petition has been filed under section 482<\/a> of the Cr. P.C<\/p>\n
                  for quashing the order dated 18.6.2007 passed by the learned Sub<\/p>\n
                  divisional     Judicial   Magistrate,   Jehanabad   in   Complaint    case<\/p>\n
                  no.352\/2007       corresponding to Trial no.681\/2009 by which and<\/p>\n
                  whereunder he having found prima facie case under sections 323<\/a>, 498A<\/a><\/p>\n
                  of the IPC and 4 of the Dowry Prohibition Act<\/a> against the applicants<\/p>\n
                  and other accused ordered to issue process against the applicants as well<\/p>\n
                  as other accused to procure their attendance for facing trial.
\n                            2<\/span><\/p>\n
          Opposite party no.2 filed complaint case bearing Complaint<\/p>\n
case no. 352\/2007 against the applicants and five other co-accused<\/p>\n
persons and enquiry under section 202<\/a> of the Cr.P.C was made in<\/p>\n
respect of allegation levelled in complaint petition and having<\/p>\n
conducted enquiry prima facie case under sections 323<\/a>, 498A<\/a> of the IPC<\/p>\n
was found against the applicants and five rest accused persons and<\/p>\n
accordingly, learned Sub divisional Judicial Magistrate, Jehanabad<\/p>\n
passed order dated 18.6.2007 in the manner as stated above.<\/p>\n
          Learned counsel for the applicants submits that the applicants<\/p>\n
have been made accused nos. 6 and 7 in the complaint petition and, as a<\/p>\n
matter of fact, they are uncles of husband of opposite party no.2 and<\/p>\n
they reside separately from the husband of opposite party no.2 and<\/p>\n
furthermore, no specific overt-act has been attributed against them. It is<\/p>\n
further contended by him that husband of opposite party no.2 earlier<\/p>\n
filed a suit for restitution of conjugal right and after filing of the suit<\/p>\n
opposite party no.2 brought above stated complaint case and<\/p>\n
subsequently, aforesaid suit for restitution of conjugal right was<\/p>\n
withdrawn by the husband of opposite party no.2 as she was not ready<\/p>\n
to lead her conjugal life. It is further contended by him that after<\/p>\n
withdrawal of the aforesaid suit, the husband of opposite party no.2<\/p>\n
filed a suit for divorce in which a decree for judicial separation was<\/p>\n
granted which is annexure 6 of this petition. It is further contended by<\/p>\n
him that even after passing of the decree of judicial separation, opposite<\/p>\n
party no.2 did not turn up and never came at her matrimonial home and,<\/p>\n
thereafter, after expiry of statutory period, the husband of opposite party
\n                            3<\/span><\/p>\n
no.2 filed Matrimonial Title Suit no. 72\/2010 for divorce and the<\/p>\n
aforesaid suit was decreed by the Principal Judge, Family Court, Ranchi<\/p>\n
vide judgment dated 21.6.2010.\n<\/p>\n
          On the other hand, learned counsel appearing for opposite<\/p>\n
party no.2 supported the order under challenge and submitted that if the<\/p>\n
petitioners have any grievance, they may raise the same at the time of<\/p>\n
framing of the charge.\n<\/p>\n
          Having heard rival contentions of both the parties I have gone<\/p>\n
through the record. It is an admitted position that the applicants are<\/p>\n
uncles of the husband of opposite party no.2 and from perusal of the<\/p>\n
contents of complaint petition which is annexure 1 of this petition it<\/p>\n
would appear that no specific overt-act has been attributed against the<\/p>\n
applicants. It is well known that section 498A<\/a> of the IPC has been<\/p>\n
enacted to check the dowry related offences but it is seen that now a<\/p>\n
days, it has become fashion to implicate almost all in -laws including<\/p>\n
grand father, grand mother and even minor children of the family of<\/p>\n
groom.\n<\/p>\n
          In the present case, although there is some sort of allegation<\/p>\n
against in-laws of the husband of opposite party no.2 but it would<\/p>\n
appear from complaint petition that opposite party no.2 has not even<\/p>\n
whispered even a single word against the applicants. Therefore, in my<\/p>\n
view, the prosecution of the applicants is nothing but only an abuse of<\/p>\n
the process of law. Therefore, I think it proper to exercise the power<\/p>\n
vested in this court under section 482<\/a> of the Cr. P.C.<\/p>\n
          On the basis of aforesaid discussions, impugned order dated
\n                                     4<\/span><\/p>\n
         18.6.2007 is, hereby, quashed in respect of the applicants only.<\/p>\n
                   It is made clear that the findings\/ observations given by this<\/p>\n
         court in this order shall not affect the case of the rest accused of<\/p>\n
         Complaint case no. 352\/2007.\n<\/p>\n
                   Accordingly, this application stands disposed off on<\/p>\n
         admission stage itself.\n<\/p>\n
